But, because the ambit of a design right extends to the registered design and any similar or identical design, the similarity of a design is an issue for the purpose of Design Infringement. <\/p>\n\n\n\n<p>In\nmaking a judgement regarding the similarity of a design, it is common for\ndesigns to be considered the same after comparing the two designs and finding\nresemblance:<\/p>\n\n\n\n<ul><li>The overall dominant constitution\nand the precise constitution of both designs;<\/li><li>The featured of the designs;<\/li><li>A common foremost constitution\nin both designs;<\/li><li>Only a slight difference in\nboth designs is not notable;<\/li><\/ul>\n\n\n\n<p>According to the <strong><em>Design Act, 2000<\/em><\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1917?sam_handle=123456789\/1362\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong><em>, <\/em><\/strong>the piracy of registered design comes under the encroachment of design. <strong><em>Section 22 of the Design Act<\/em><\/strong> mentioned that any fraudulent or clear copying of a design that has been registered already without the permission of the owner of the registered owner is illegal. The section also prohibits importing any substance or material, which is in close similarity to a design already registered. An infringement is said to be if any individual, without proceeding with the approval of the original.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_for_a_Design_Protection_from_Design_Infringement\"><\/span>Requirements\nfor a Design Protection from Design Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Design\nshould be unique or new;<\/li><li>A\ndesign shouldn\u2019t have been revealed to the public earlier;<\/li><li>A\ndesign should be considerably differentiated from other known designs or\ncombinations. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Rights_of_Owner_under_the_Design_Act\"><\/span>What are the\nRights of Owner under the Design Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The right to apply for Design\nRegistration in any of the classes in which the design is registered;<\/li><li>The exclusive right to publish\nor cause to be revealed or published, any articles in any classes of goods or\nproducts in which the design is registered to which such a design is applied;<\/li><li>The right to import for the\npurposes of sale of any articles belonging to the classes of goods in which the\ndesign is registered &amp; have applied to it.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Remedies_for_Design_Infringement\"><\/span>Remedies for\nDesign Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According\nto the Design Act, the liability of the one who violates the design is\nmentioned under Section 22(2) of the Act. It is the same section that provides\nthe remedies for Design Infringement to the registered owner. Hence, the\nliability of the violating party of the above-mentioned Act is as follow:<\/p>\n\n\n\n<ul><li>Under Section 22 (2)(a) of the\nDesign Act, the one who violates shall pay Rs. 25,000\/- for every violation.\nThe total amount shall sum up to Rs. 50,000. The above amount is for the\nrecovery of the Infringement.<\/li><li>Under Section 22(2)(b), it is\nmentioned that the owner of the registered design is covered under certain\nrights wherein it can call for damage recoveries and make the violating party\nliable.<\/li><\/ul>\n\n\n\n<p>For\nexample, in Videocon Industries vs Whirlpool of India Limited, the Bombay High\nCourt arrived at a judgment as to the plan of Section 22 of the Act, which\npermits actions against &#8220;any individual&#8221; in this section. A\nregistered design can be abolished, or registration placed aside, or a\nregistered owner can be restrained by order of injunction from practising the\nuse of such design either by High Court following <strong><em>Section 22 of the Design Act<\/em><\/strong>\nor by Controller following <strong><em>Section 19 of the Design Act<\/em> <\/strong>under\nthe conditions in a case. Suppose a certified owner doesn\u2019t apply for their\ndesign to a product for sale or associated with the before-mentioned sale. In\nthat instance, another registered owner cannot have recourse to <strong><em>Section\n22 of the Act<\/em><\/strong>.<\/p>\n\n\n\n<p>Hence,\nthe remedies for Design Infringement under Section 22 were only available to\nuse disputed design. In Section 22 and sub-section 1 to 3 in distinct, it is\nshown that the infringement suit of a registered design extends against any\nindividual that would incorporate a registered owner. Hence, a registered owner\nof a registered design can file a suit for Infringement against the infringers.\nThe reason behind forcing liability upon the violators is to cover for the loss\nthat the registered owner faces. The owner also holds the responsibility to\nmark all the articles under the registered design to take vital steps in the\nfurther process of Design Infringement. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_Claim_for_the_Remedies_for_Design_Infringement\"><\/span>Who can Claim\nfor the Remedies for Design Infringement?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section\n55 of the Copyright Act provides the scope of civil remedies available on the\nregistered work of the owner. It helps to seek remedies, file a suit for\ninjunction against anyone who violates the registered article or work under the\nAct. The claimant also enjoys the privilege along with profits gained by the\nviolating party upon the infringed or violated design. Any one of the following\namongst owners of a registered design, legal heirs, or joint owners can see\nremedies for Design Infringement.<\/p>\n\n\n\n<p>Therefore,\nin the matter of <strong><em>Som Distillaries and Breweries Limited vs Carlberg Breweries<\/em><\/strong>,\nin a judgment, the Delhi High Court upheld the maintainability of a composite\nsuit for Design Infringement and passing off. A claimant can join two causes of\naction:<\/p>\n\n\n\n<ul><li>Infringement by the defendant\nof the claimant\u2019s design;<\/li><li>Passing off by the defendant of\nthe larger trade dress of the claimant\u2019s products or articles.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is concluded that it is vital to know the remedies for Design Infringement so that the owner can avoid such infringements in future.
