According to the report of\nDeloitte India, 2021, the e-gaming industry is expected to expand at a compound\nannual growth of 40% by 2022. This report enlightens the significance of\nprotecting both the technology &amp; creativity that is used by this industry.<\/p>\n\n\n\n<p>Patents\nare used to safeguard the inventive game design elements\/gameplay, the\nnext-generation hardware, the technical solutions, and the technical\ninnovations like networking, database design, or software.<\/p>\n\n\n\n<p>For\nexample, <strong><em>Odyssey System <\/em><\/strong>is a video game invented by Ralph Baer, which\nwas permitted the 1<sup>st<\/sup> Patent in the history of video games in 1968.\nHe had designed or created an apparatus that, once attached to a TV set,\nallowed users to manipulate rudimentary lines &amp; dots across the TV as a\npart of a tennis-like game. However, for most of the coming years thereafter,\nPatents will only be used to safeguard the gaming hardware, i.e., the actual\nmachines used to play the video games. For example, Truevision3D, Torque Game Engine, etc.<\/li><li><strong><em>Novel Game Concepts<\/em><\/strong>: For instance, the idea of player wisdom is patented by Nintendo, wherein the more insane the player becomes, the more the player will knowledge changes in the game that may impact the storyline for the game and\/or obstruct the player&#8217;s capability to process through the same.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_Obtain_Patents_in_E-gaming_Industry\"><\/span>Procedure to\nObtain Patents in E-gaming Industry<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before starting the procedure for <a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\"><strong>Patent Registration<\/strong><\/a>, two things must be done; first, the decision should be made whether the applicant desires to move forward individually or engage a professional and secondly, a detailed Patentability Search must be executed to find out the opportunities of getting a Patent:<\/p>\n\n\n\n<ul><li>The first step is to draft a\nPatent application (Complete\/Provisional) <strong><em>Form 1 and Form 2<\/em><\/strong>.<\/li><li>The second step is to file the\nPatent application in India. Extra forms to\nbe submitted are:<\/li><li><strong><em>Form 5<\/em><\/strong>:\nThis form is the Declaration as to inventorship (only to be filed with the\ncomplete Patent application).<\/li><li><strong><em>Form 26<\/em><\/strong>:\nThis form is for the authorisation of a Patent agent.<\/li><li><strong><em>Form 28<\/em><\/strong>:\nTo be submitted by the small entity or start-up (only required if you are\nclaiming start-up or small entity status).<\/li><li>Publication of Patent\napplication is to be made (<strong><em>Form 9<\/em><\/strong>).<\/li><li>After that, the examination of\nthe Patent application is to be requested (<strong><em>Form 18<\/em><\/strong>).<\/li><li>The Patent is granted.<\/li><li>Payment of Renewal Fee has to\nbe done annually.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing Patents in E-gaming Industry, it concluded that there has always been controversy regarding the categorisation of online games as a whole, that is, whether they are multimedia work, audio-visual work, or primarily, a computer program.
