Something\nthat has been there in nature but never came before humans and has been\nrecognised now; hence, it will be treated or considered as new.<\/li><\/ul>\n\n\n\n<p>For\nexample, fossils, Scientists discover this, that have existed for long years\nbut have never been recognised by humans before. Another example of discovery\nis the new species of animals and plants. Hence, the things which were there in\nnature for quite a long time but were not identified by us humans would come\nunder the vision of discovery.<\/p>\n\n\n\n<ul><li><strong><em>Invention<\/em><\/strong>:\nThe creation of something unique or new or the process of creating that never\nexisted before by using someone&#8217;s intelligence, skills, or knowledge is called\nan invention. The creation of something new with the help of someone&#8217;s ideas or\nexperiments comes under the meaning of an invention.<\/li><\/ul>\n\n\n\n<p>For\nexample, the creation of cell phones, computers, satellites, or TVs never\nexisted before. These are created by scientists by using their experiments\n&amp; ideas. But, remember that the parts which were used in creating such\ninventions already existed before, but the scientists used such parts in the\ncreation, and that is called an invention.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difference_Between_Discovery_and_Invention\"><\/span>Difference\nBetween Discovery and Invention<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>You\ncan check the difference between Discovery and Invention as per the Patent Act\nbelow:<\/em><\/strong><\/p>\n\n\n\n<ol><li><strong><em>Occurrence<\/em><\/strong>: The occurrence of discoveries is natural; but, inventions are human-made occurrences of objects or things.<\/li><li><strong><em>Originality<\/em><\/strong>: Although both invention and discovery are considered new or unique since discovery is related to the findings of something that already existed in nature, discovery is not new or original. However, the invention or creation is related to the creation of new things by using prior existing things; therefore, an invention is new and original.<\/li><li><strong><em>Prior Existence<\/em><\/strong>: Discoveries are something which is already existed, but we didn&#8217;t have the knowledge regarding the same till it was recognised, whereas inventions are the things that never existed before, but only the parts or things which were used in creating such invention existed before.<\/li><li><strong><em>Involves<\/em><\/strong>: Inventions involves experiments, whereas discoveries involve exploration.<\/li><li><strong><em>Patentability<\/em><\/strong>: A discovery is not patentable or not liable for <a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\"><strong>Patent Registration<\/strong><\/a>, whereas an invention is patentable.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Correlation_Between_Discovery_and_Invention\"><\/span>Correlation\nBetween Discovery and Invention<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After\ndiscussing the difference between discovery and invention, let\u2019s understand the\ncorrelation between them. Let\u2019s take an example of the telescope; it was\ninvented by a Dutchman, an eyeglass maker. It was because of the invention or\ncreation of the telescope that Galileo Galilei was able to look far into the\nsky to discover the mountains of the moon. Galileo didn&#8217;t invent the mountains\nof the moon, but rather he discovered them with the help of invention, i.e.,\nthe telescope.<\/p>\n\n\n\n<p>Similarly,\ninventions can lead to discoveries, and discoveries can also lead to\ninventions. For instance, Benjamin Franklin discovered the electrical effects\nof lightning, which further led him to invent the lightning rod, which is in\nuse and helps in making buildings much safer during thunderstorms. Therefore,\nsometimes discovery and invention correlate with each other.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Discovery_and_Invention_under_the_Patents_Act\"><\/span>Discovery and\nInvention under the Patents Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li><strong><em>Discovery under Patents Act<\/em><\/strong>: The Patents Act states that discovery is not patentable and is excluded from Patent Registration or protection. <strong><em>Section 3 (c) &amp; (d) of the Patents Act<\/em><\/strong><sup><a href=\"https:\/\/ipindia.gov.in\/writereaddata\/Portal\/ev\/sections\/ps3.html\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> clearly states that discovery of something that already exists is not patentable under the Patents Act, only inventions are patentable, and discoveries are not patentable.<\/li><\/ul>\n\n\n\n<p>The\nreason for discovery being non-patentable under the Act is that discovery of a\nnew form, substance, etc., is not a new thing. It already exists in nature, and\ntherefore, it cannot be treated as a new invention since it didn&#8217;t involve any\ninventive steps, skills, etc. Hence, such a discovery wouldn&#8217;t be treated as an\ninvention and shall be non-patentable under the Trademark Act.<\/p>\n\n\n\n<ul><li><strong><em>Invention under Patents Act<\/em><\/strong>:\nThis Act defines an invention as a new or original product or a process that\nhas an inventive or creative step and has some industrial applicability. For an\ninvention to be eligible to obtain a Patent Registration, it has to fulfil\nconditions which are given below:<\/li><li>It must be new or unique;<\/li><li>It must have industrial\napplicability;<\/li><li>It must involve some inventive\nstep;<\/li><li>It shall not come under the\nvision of Section 3 and 4 of the Act.<\/li><\/ul>\n\n\n\n<p>If\nall such conditions are fulfilled, then the proposed invention can be patented\nunder the Act. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing the difference between discovery and invention as per Patent Act, it is concluded that they both may sound the same, but they have two different meanings. Invention is different from discovery and vice-versa. However, the term or word discovery is not clearly defined in the Act, which creates a lot of confusion or mess in the minds of people.
