This right gives the authority to the owner that\nno one can use once it is patented, for selling in the market\/producing it in\nany place or manufacturing the product without the consent of the Patent owner.\nThe Patent Right is not only for products but also for the processes by which a\nproduct is obtained. However, the process or the products has to be new or\nincludes some innovative step in it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_is_it_necessary_to_file_International_Patent_Application\"><\/span>Why is it\nnecessary to file International Patent Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For protecting invention, <a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/copyright-registration\"><strong>Patent Registration<\/strong><\/a> is taken by people, MNCs, universities, and research institutions. Since Patent protection is jurisdiction-definite in nature, it only gives protection for the country in which the Patent Application is filed. An International Patent Application aids the Patent owner or inventor to seek Patent protection based on the priority date of the initial Patent application in other countries also. Hence, there is a need for International Patent protection. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Different_Ways_to_File_an_International_Patent_Application\"><\/span>What are the\nDifferent Ways to File an International Patent Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>There\nare two different ways to file an International Patent Application, and you can\ncheck the same below:<\/em><\/strong><\/p>\n\n\n\n<ul><li><strong><em>PCT Application<\/em><\/strong>:\nThe Patent Cooperation Treaty came into existence in 1970, and the Treaty,\nwhich like any other Treaty, is a lawful agreement entered into between various\nnations. The purpose of the PCT (Patent Cooperation Treaty) is to simplify the\ninitial filing process, making it easier &amp; initially cheaper to file a\nPatent application in an immense number of countries. You can achieve this by\nfiling an International Patent Application.<\/li><\/ul>\n\n\n\n<p>Usually,\nit may be filed with the National Patent Office of the contracting State of\nwhich the inventor or Patent owner is a national or resident or, at the\napplicant\u2019s option, with the <strong><em>International Bureau (IB) of WIPO in Geneva<\/em><\/strong>.\nIf the inventor or applicant is a national or resident of a <strong><em>Contracting\nState Party<\/em><\/strong> to the <strong><em>EPU (European Patent Convention), <\/em><\/strong>the\n<strong><em>Harare\nProtocol<\/em><\/strong> on Patents and Industrial Designs, the <strong><em>Bangui Agreement <\/em><\/strong>or the <strong><em>EPC (European\nPatent Convention), <\/em><\/strong>the International Patent Application may also be\nfiled with the <strong><em>EPO (European Patent Office), the ARIPO or African Regional\nIntellectual Property Organisation, OAPI or EAPO <\/em><\/strong>respectively.<\/p>\n\n\n\n<p>Filing\na Patent Cooperation Treaty Application or PCT Application has the effect of\ndesignating all Contracting States bound by the Patent Cooperation Treaty on\nthe International filing date. The effect of the International Patent\nApplication is the same in each proposed State as if a National Patent\nApplication (NPA) had been filed with the NPO (National Patent Office) of that\nproposed State.<\/p>\n\n\n\n<ul><li><strong><em>Paris Convention Route<\/em><\/strong>: This is the second way to file an International Patent Application. This means you can file Patent Applications in the <strong>PCC (Paris Convention Countries<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Paris_Convention_for_the_Protection_of_Industrial_Property\"><strong>[1]<\/strong><\/a><\/sup><strong>)<\/strong> (member states which takes part in the Paris Convention for protection of industrial properties). The Paris Convention is considered a global treaty. This Convention allows the inventors for filing Patent applications known as <strong><em>Priority Applications<\/em><\/strong>, and it is filed on a specific date known as the Priority Date.<\/li><\/ul>\n\n\n\n<p>In\ncase the applicant wants to get a Patent Right in only one particular country,\nthen by taking the approval or consent in that place, the Patent application\ncan directly be filed in such a nation where he had the interest of filing. In\nthis type of instance, there is no rule of the Paris Convention because there\nis no priority claimed. However, if the applicant or inventor wants to file an\nInternational Patent Application in various countries, then the Paris\nConvention can be applied. The process of filing remains almost the same; the\nonly difference in the application is that it can be filed first in the\noverseas county, and within 12 months of time, the Patent Applications can be\nclaimed to be filed in the rest countries. If you go to the Paris Convention\nRoute, then you have 12 months of time from the date of the primary Patent\nApplication to file a Patent application in other nations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_File_an_International_Patent_Application\"><\/span>How to File an\nInternational Patent Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For\nfiling an online International Patent Application there are two different ways\nin which you can do it:<\/p>\n\n\n\n<ol><li>File the Patent application\ndirectly globally in any overseas country without filing the Patent application\nin India.<\/li><li>Or else file the Patent\nApplication in India first and then go for International filing of the\napplication for Patent protection in any of the foreign nations.<\/li><\/ol>\n\n\n\n<p>In\nboth ways, it is compulsory before filing to inform about it in the <strong><em>IPO\nor Indian Patent Office<\/em><\/strong>. The Patent Office replies within 21 days.<\/p>\n\n\n\n<p>Section\n39 of the Indian Patent Act states that if an individual is a resident of\nIndia, then he or she cannot file a Patent application outside India without\nasking for prior approval from the Indian Patent Office. The permission should\nbe in written form, which should be given by the Controller.<\/p>\n\n\n\n<p>The\noutside overseas Patent Applications are given to the Patent Application of\nNational Patents. All Patents are limited to a specific region. If you desire\nto safeguard your invention in other nations, you can do that via the PCT Route\nor Paris Convention, as we discussed above, or even directly.
