Unlike jurisdictions like the USA, the Trademark Regime in Singapore doesn&#8217;t require any evidence of use to be filed before the Registration is granted.<\/li><li><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\"><strong>Trademark Registration<\/strong><\/a> under the Trademark Act of Singapore is only effective in Singapore. As Singapore is a contracting country or nation under the Madrid Protocol, an international application may be filed via IPOS in Singapore after the Trademark has been filed in Singapore.<\/li><li>As per the Act, there is no time limit for filing. However, it should be noted that a lawsuit for an infringement of a registered Trademark is only possible if the Trademark is registered. A registered Trademark in Singapore is valid for 10 years and can be renewed further for ten years.<\/li><li>With the introduction of Service Mark (SM) Registration, the Trademark classes have been extended from International Classification 35 to 45. As an outcome of the inclusion of service marks, the search for prior rights will now extend to cover; concerning Trademarks applied on products, those services which are closely related to the products for which Registration is sought, and with respect to Service Marks, the examination will comprise marks for products which are closely related to those services.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Criteria_for_Trademark_Registration_in_Singapore\"><\/span>Criteria for\nTrademark Registration in Singapore<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nis the criteria for Trademark Registration in Singapore:<\/em><\/strong><\/p>\n\n\n\n<ol><li>The mark should be unique and\noriginal;<\/li><li>One should be able to represent\nor show it graphically;<\/li><li>A Trademark shouldn&#8217;t be\nidentical to an existing Trademark;<\/li><li>The mark should enable\ncustomers from differentiating the business from other identical services;<\/li><li>It shouldn&#8217;t include\ndescriptive words that show a product or service or a common word in any\nlanguage or trade.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Advantages_of_Registering_a_Trademark_in_Singapore\"><\/span>Advantages of\nRegistering a Trademark in Singapore<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare the advantages\/benefits of Trademark Registration in Singapore:<\/em><\/strong><\/p>\n\n\n\n<ul><li>It provides the right to use\nthe mark;<\/li><li>Benefiting from the rising\nmarket value of the mark;<\/li><li>Excluding others from copyright\nit;<\/li><li>License for commercial use by 3<sup>rd<\/sup>\nparty hence creating a source of revenue;<\/li><li>Up to 400% tax rebates from the\nGovernment of Singapore under the <strong><em>PICS (Productivity &amp; Innovation Credit\nScheme) <\/em><\/strong>to offset costs you paid for registering your Trademark.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_get_Trademark_Registration_in_Singapore\"><\/span>Procedure to\nget Trademark Registration in Singapore<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Step\n1: Recognise Class of Goods or Services<\/em><\/strong>:\nBefore filing an application for Trademark Registration, the owner of Trademark\nor an applicant has to decide on the types of products or services for which\nTrademark Registration is sought. Products &amp; Services are appropriately\ncategorised from classes 1 to 45 under the <strong><em>International Classification of Goods &amp;\nServices (ICGS)<\/em><\/strong>.<\/p>\n\n\n\n<p><strong><em>Step\n2: Trademark Search<\/em><\/strong>: After recognising the\nclasses, it is advisable for you to conduct a Trademark Search in the records\nmaintained by the <strong><em>Singapore Registry of Trademarks<\/em><\/strong>. This is to make sure that\nthere is no existing Trademark that is similar to the one you plan to use,\nparticularly in your business area.<\/p>\n\n\n\n<p><strong><em>Step\n3: Filing of an Application<\/em><\/strong>: After the above step,\nyou need to fulfil the application form. The minimum filing requirements\ninclude:<\/p>\n\n\n\n<ul><li>A statement that you request\nfor Registration;<\/li><li>Your address &amp; name;<\/li><li>A clear graphical\nrepresentation of your mark or brand. For marks including a 3-d shape of the\nproducts or packaging, line drawings should clearly show all dimensions of the\nmark;<\/li><li>A list of products &amp;\nservices that you are registering to the mark;<\/li><li>A declaration of your\nconcerning use of the Trademark.<\/li><\/ul>\n\n\n\n<p><strong><em>Step\n4: Examination by Intellectual Property Office of Singapore (IPOS)<\/em><\/strong>:\nOnce the application has been received, IPOS will examine it to make sure that\nthe application meets the minimum filing necessities. Once the minimum filing\nnecessities are met, the filing date is accorded &amp; a Trademark number is\nissued. This information is sent through the Acknowledgment letter. If one\/more\nof the minimum filing necessities are not fulfilled, a Deficiency Letter will\nbe sent to remedy within two months from the Letter date, and this time\nduration is not extendible.<\/p>\n\n\n\n<p>In\nthe occasion that the applicant doesn&#8217;t remedy the deficiencies or remedies the\ndeficiencies out of time, the Intellectual Property Office of Singapore will\nsend a letter informing the applicant that the Trademark application is Deemed\nNever to Have Been Made.<\/p>\n\n\n\n<p><strong><em>Step\n5: Examination for Conflicts with Present Trademarks and Validity<\/em><\/strong>:\nAfter the above step, the Registrar will execute a formal search for\nconflicting marks, geographical names &amp; conformity to the International\nClassification of Products &amp; Services. In the case of pharmaceutical\nproducts, the Trademark Registry will also need to check whether the mark\nincludes safeguarded <strong><em>INN or International Non-proprietary Name<\/em><\/strong>.\nThe INNs, provided by the WHO, are generic names for particular pharmaceutical\nsubstances. The Trademark application will be scrutinised to find out whether\nthe mark is registrable in accordance <strong><em>with Singapore Trademark Laws<\/em><\/strong>.<\/p>\n\n\n\n<p>If\nthe necessities are not satisfied, IPOS will issue a Letter specifying the\nrequirements or refusals. The response should be submitted within four months\nfrom the issuance date of the IPOS letter. If extra time is required to respond\nto the IPOS letter, a request for a time extension before the expiry needs to\nbe submitted. If no response or request for a time extension is received within\nthe stipulated time period, the Trademark will be shown as Withdrawn.<\/p>\n\n\n\n<p><strong><em>Step\n6: Publication or Advertisement for Public Scrutiny<\/em><\/strong>:\nAfter all the steps, the application will be published or advertised and made\navailable to the public. Within 2 months of the publication period, any party\nwill be able to oppose the Trademark Registration. If the Trademark Office gets\nan objection from any party, the applicant or owner will be informed and must\nrespond. A decision on the Trademark application will be made after hearing\nboth parties.<\/p>\n\n\n\n<p><strong><em>Step\n7: Registration of Trademark<\/em><\/strong>: If there is no\nopposition, the Certificate of Registration would be issued, and Trademark\nwould be granted protection for ten years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Trademark registered under Singapore Trademark Act is valid only in the territory of Singapore.
