Unintentional Copyright Infringement is one of the most\nregularly claimed defences in Copyright Infringement Lawsuits. Many defendants\ninsistently over-emphasise the defence without completely understanding what it\nmeans and what is required to establish it successfully. Understanding what an\nunintentional infringer defence is and what it is not vita for the defendant to\nknow when &amp; how to claim a defence or the petitioner to know how to\novercome a defence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Unintentional_Copyright_Infringement_in_India\"><\/span>Unintentional\nCopyright Infringement in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Section 55 (1) of the Copyright Act, 1957<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> tells about Unintentional Copyright Infringement. This section provides that if the defendant at the infringement date proves that he or she was not aware &amp; had no reasonable ground to believe that Copyright existed in work, then the Plaintiff is not eligible for any remedy other than an injunction regarding the Infringement and the whole\/any part of the profit made by the defendant from the sale of violating copies of a declaration or order, as the Court may consider fitting in those conditions. In simple terms, Plaintiff will have only civil remedies against the infringer defendant.<\/p>\n\n\n\n<p>In\nthe matter of <strong><em>Jwala Prasad vs Ghaffur Baksh<\/em><\/strong>, the Court held that in case if\nthe work is vast and the reproduced portion is separable from the unobjectionable\npart, the pirated or reproduced work will be stopped from publishing but where\npirated work cannot be separated from the lawful work the Court will not delay\nin permitting to restrain the publication of the overall work.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Preventive_Civil_Remedies\"><\/span>Preventive\nCivil Remedies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>One of the most standard remedies used by authors or creators in the case of <a href=\"https:\/\/swaritadvisors.com\/blog\/copyright-infringement-and-remedies-in-india\/\" class=\"text-primary\"><strong>Copyright Infringement<\/strong><\/a> is Primarily Civil. Civil Remedies are available to the proposed Copyright creator or author under <strong><em>Section 55 of the Copyright, 1957<\/em><\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_an_Interlocutory_Injunction\"><\/span>What is an\nInterlocutory Injunction?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>This\nInjunction is the most vital remedy against Copyright Infringement. The\ninjunction means a judicial process by which one who is frightened to infringe\nor has infringed the legal\/impartial rights is restrained from sustaining such\nan act\/is directed to restore or recover the matter to the position in which\nthey stood earlier to the action.<\/p>\n\n\n\n<p>In\nthe matter of <strong><em>R.M Subbiah vs N. Sankaran Nair<\/em><\/strong>, the Madras High Court held\nthat \u201cInjunction is an adequate remedy permitted by a court in use of its judicial\ndiscretion. It has to be regarded from different facets that arise from each\ncase&#8217;s specific set of circumstances. There may be matters or instances in\nwhich the grant of an injunction, whether permanent or temporary, will only\nreach the ends of justice, and extra protection for the preservation of the\nrights of the challenging or exacting party cannot at all be thought of. There\nmay also be cases or instances where the injunction remedy has to be made\nresilient and adaptable to the situations arising in each case. A firm or\ncompany invocation without considering flexibility in applying the rule as to\nthe Injunction might result in difficulty sometimes that cannot be cured\nlater&#8221;.<\/p>\n\n\n\n<p><strong><em>There\nare three various factors that should be considered for the grant of\nInterlocutory Injunction:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Establishment of prima facie\ncase;<\/li><li>Balance of convenience in\nfavour of Plaintiff or petitioner;<\/li><li>Irreparable injury would be\ncaused to Plaintiff or petitioner.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compensatory_Civil_Remedies\"><\/span>Compensatory\nCivil Remedies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Such\nremedies against Copyright Violation can be categorised into three different\nparts:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Damages;<\/li><li>Damages for conversion or\ndelivery up of violating copies;<\/li><li>Account of profit.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Damages_%E2%80%93_Unintentional_Copyright_Infringement\"><\/span>Damages \u2013 Unintentional\nCopyright Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\npurpose or objective of an award of damages is to restore the petitioner to\ntheir position before the violation. Such injuries are compensatory. Copyright\nViolation is a tort, and the usual principle in tort law is that losses must be\ncompensatory. Damages in a fight to put the victim back to their place before\nthe tort. If the Infringement is proven, damages are believed.<\/p>\n\n\n\n<p>In\nthe case of <strong><em>K Mayuri vs Microsoft Corporation<\/em><\/strong>, the Delhi High Court\nobserved that Damage has traditionally been defined as monetary compensation,\nobtainable by success in action, for a wrong which is a tort or violation of\nthe contract. Hence, the general concept of damages is to compensate a\nplaintiff for loss &amp; injury and can also be applied to as compensatory or\noffsetting damages, which are awarded to recompense a petitioner for damages\nwhich he or she has suffered or is expected to suffer and to reinstate\nsomething that the Plaintiff has suffered or is likely to fail because of the\nillegal act of the defendant. The primary objective of the damages is to\nrestore those losses to Plaintiff. But, as tort litigation has appeared, the\nconcept of damages is not limited to compensation for loss &amp; damages alone.\nThere are 3 types of damages awarded by courts: Nominal Damages, Compensatory\nDamages, and Exemplary Damages.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Damages_for_Delivery_up_or_Conversion\"><\/span>Damages for\nDelivery up or Conversion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>&nbsp;In a case for damages for conversion, it&#8217;s\nprotection if the defendant during conversion of the violating copies proves\nthat he or she was not aware and has no rational grounds to believe that\nCopyright existed in work or that he or she has reasonable grounds for\nbelieving that such documents don\u2019t raise Copyright Infringement in work. The\nremedies of damages for Copyright Infringement and conversion are cumulative\n&amp; not an alternative.
