Even we are not the actual owner of the work; we are using it\nwithout any permission. There are different ways to attain authority to use a\ncopyrighted work or creation. It can be purchased\/, or a license to use the\nwork can be taken from the actual owner. Along with these, there are other ways\nof getting approval to use the work, like using the exceptions &amp;\nlimitations of the Copyright Act. One can use the copyrighted or registered\nworks which are in the public domain even without consent. As per the <strong>Copyright Act, 1950<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>, Copyright is defined as a bunch of rights which comprises rights of reproduction, adaption, communication to the public, and translation of the work. Copyright is the special right provided by the law to creators or authors of literary, musical, dramatic and artistic works, producers of Cinematograph films &amp; sound recordings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Rights_Does_Copyright_Law_provide_in_the_USA\"><\/span>What Rights\nDoes Copyright Law provide in the USA?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nCopyright Protection in the USA provides the owners with the following\nexclusive rights:<\/p>\n\n\n\n<ul><li>Right to reproduce and make\ncopies of actual work;<\/li><li>Right to publicly display the\nactual work;<\/li><li>Right to prepare derivative\nworks;<\/li><li>Right to distribute or spread\ncopies to the public by a sale\/another form;<\/li><li>Right to perform sound\nrecordings openly via digital audio;<\/li><li>Right to openly or publicly\nperform the work.<\/li><\/ul>\n\n\n\n<p>The\ndistinction between expression &amp; idea is key to Copyright Law. Hence, the\nCopyright Law safeguards the expression of thought but does not safeguard the\nidea itself. This distinction or uniqueness is termed the idea-expression\ndifference of view from the <strong><em>Copyright Act, 1976<\/em><\/strong>. Copyright Laws enable or allow\nauthors to benefit from their creative work &amp; foster innovation. It proves\nrights to creators or authors to safeguard their work for a limited time, but\nit was also set up to encourage creativity &amp; learning. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Types_of_Works\"><\/span>Different\nTypes of Works <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare the different types of works safeguarded by Copyright are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Musical works;<\/li><li>Audio-visual works;<\/li><li>Architectural works;<\/li><li>Sound recordings works. <\/li><li>Literary works;<\/li><li>Derivative works. <\/li><li>Compilation works;<\/li><li>Choreographic &amp; pantomime\nworks;<\/li><li>Pictorial and graphical works;<\/li><li>Sculptural work;<\/li><li>Dramatic works.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Levels_of_Copyright_Protection_in_the_USA\"><\/span>What are the\nLevels of Copyright Protection in the USA?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare four simple levels of Copyright Protection in the USA that you need to\nfollow to protect your work:<\/em><\/strong><\/p>\n\n\n\n<ul><li><strong><em>Make sure that your work is\nmarked properly <\/em><\/strong>or correctly: A notice will\nprevent Copyright Infringement, as it describes that the work is safeguarded\nunder law. However, a Copyright notice is not required, as work is\nautomatically safeguarded under Copyright protection Law. Proper notification\nwill show that someone has an awareness of Copyright Law and takes the\ninfringements of work extremely.<\/li><li><strong><em>Register your original work<\/em><\/strong>:\nTo register for Copyright work, one needs to go to the <strong><em>eCo Online System<\/em><\/strong> and\ncreate an account, and fill up the online form with some basic fees.<\/li><li><strong><em>Register or keep supporting\nevidence or proof<\/em><\/strong>: Those are as follows:<\/li><li>Evolution of ideas;<\/li><li>Watermarking or footprints.<\/li><li><strong><em>Agreement between co-authors<\/em><\/strong>:\nWho will be the Copyright owner, if the work is a Joint Venture &amp; what will\nbe the owner\u2019s status when someone leaves. This is decided by the mutual\nagreement between them.<\/li><\/ul>\n\n\n\n<p>Even Copyright Registration is not obligatory; it&#8217;s preferred for various reasons. Many prefer to register just because they want to have a Registration Certificate along with the evidence of their Copyright on the public record. Copyrighted works are also eligible for legal damages and fees of attorney incurred in the litigation process after success. Lastly, if Registration occurs within 5 years of publication, it is considered prima facie evidence of ownership in a court of law.<\/p>\n\n\n\n<p>When it meets the basic necessities, Copyright is automatically vested to the author of the actual work. Registration is not needed, but Registration  enhances all the rights of the owner concerning Copyrights in different ways. <a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/copyright-registration\"><strong>Copyright Registration<\/strong><\/a> is vital before a lawsuit is filed, and Registration  increases the possibility of amounts of statutory damages received in case of Copyright Infringement.
