According to <strong><em>Section 2(d) of the Designs Act, 2000<\/em><\/strong>,\nDesign refers to only the features of shape, pattern, ornament, configuration,\nor composition of lines or colour or their combination thereof applied to any\narticle, whether 2-d or 3-d or in both forms, by any industrial process or\nmeans, whether mechanical, manual, or chemical, separate or combined which is\nthe completed article appeal to &amp; are judged simply by the eye, but it\neliminates any principle, mode, construction, as defined in <strong><em>Clause\n(V) of sub-section of Section 3 of the Trade &amp; Merchandise Marks Act, 1958<\/em><\/strong>,\nartistic works or property mark as defined under <strong><em>Section 2(c) of the Copyright\nAct, 1957<\/em><\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_an_Assignment\"><\/span>What is an\nAssignment?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nassignment is a legal term that refers to the transfer of property, rights, or\nother benefits from one individual to another (assignor). Both property law\n&amp; contract law make use of this assignment term. The assignment term can\nrelate to either the act of transferring or the transferred benefits, rights,\nor property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assignment_of_Design_Rights\"><\/span>Assignment of\nDesign Rights<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Section\n30 of the Design Act<\/em><\/strong>, as amended by Rules 32, 33,\n34 &amp; 35 of the <strong><em>Design Rules, 2001<\/em><\/strong>, recognised contracts for the Assignment of\nDesign Rights and set up a method for their recording. Section 30(1) of the Act\nfacilitates that if an individual acquires the Copyright in a registered Design\nthrough transmission, assignments, or other legal means, he or she may apply to\nthe Controller in the given form to register their title. As per Section 30(3)\nof the Design Act, 2000, an Assignment of Design Rights should be in written\nform, and the agreement between both the parties should be lessened to the form\nof an instrument personify all of the terms &amp; conditions governing their\nrights &amp; obligations, and the application for title Registration under such\ninstrument should be filed in the suggested manner with the Controller within\nthe specified time, i.e., 6 months of the execution date. The person registered\nas the Design owner has the exclusive right to assign their rights, as per\nSection 30(4) of the Design Act, 2000.<\/p>\n\n\n\n<p>Only\nif the Copyright of Design is statutorily recognised under the necessities of\nthe Designs Act is it protected. Similarly, 3<sup>rd<\/sup> party rights\nobtained via licenses or assignments are only effective if they are properly\nregistered in accordance with the necessities of the Act and the Rules enacted\nthereunder. Under the Law of Design, there is no concept of a common-law\nlicense.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assignment_of_Design_Rights_with_the_help_of_Agreements\"><\/span>Assignment of\nDesign Rights with the help of Agreements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Assignment\nAgreements deals with the transfer of IP Rights from one individual or company\nto another. An Intellectual Property Agreement is a documented &amp; enforceable\ncontract that completes &amp; formalises a purchase and sale of IPRs between\ntwo organisations. Patents, Trademarks, and\/or Copyrights are an example of\nIntellectual Property that can be purchased. Assignment Agreements differ from\nlicense agreements in that an Assignment Agreement transfers ownership of IP\nfrom the assignor to the assignee; on the other side, a licence agreement only\npermits the licensee to use the IP for a definite time.<\/p>\n\n\n\n<p>An\nAssignment Agreement can&#8217;t be compared to a negotiating document since, in a\nnegotiation, the transferee may get a superior title than the transferor, which\ncannot occur in a transfer or assignment. An Assignment Agreement may comprise\nan overall and exclusive sale of the rights, granting the assignee complete\nownership of IPRs to exploit them in any way, shape, or form it sees fit,\nsubject to any constraint set for the in the Assignment Agreement. These\ncontracts are governed or regulated in India under the <strong><em>Indian Contract Act, 1972 &amp;\nthe Indian Stamp Act, Of 1899<\/em><\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_Assignment_of_Design_Rights_under_Design_Act_2000\"><\/span>Process of\nAssignment of Design Rights under Design Act, 2000<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>After <a href=\"https:\/\/swaritadvisors.com\/design-registration\" class=\"text-primary\"><strong>Design Registration<\/strong><\/a>, an ownership application under Rule 33 of the Design Rules, 2001 should be made to the Controller for the title Registration in the new owner&#8217;s name;<\/li><li>The agreement of Assignment of Design Rights should be written, and all of the parties&#8217; concerns must be given in the form of the instrument, including all the terms &amp; conditions, as per Rule 37 of the Design Rules;<\/li><li>After all, necessities have been completed, and the Assignment of Design Rights will be enforceable from that date;<\/li><li>Within 6 months of the implementation or execution date of the instrument, a title registration application should be submitted. This period can be extended for an extra 6 months.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong>Design Act, 2000<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1917?locale=hi\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> and Copyright Act safeguard the rights of the actual designer &amp; deal with the transfer of rights to succeeding owners. Section 30 of the Act and Rules 32-35 of the Design Rules, 2001 deal with the Assignment of Design Rights.
