The <a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/bocw-registration\"><strong>BOCW Act<\/strong><\/a> is beneficial for implementing laws against strong work durations &amp; sturdy working conditions.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_of_BOCW_Scheme_in_India\"><\/span>Benefits of BOCW Scheme in\nIndia<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nare some benefits of the BOCW Scheme:<\/p>\n\n\n\n<ol><li><strong><em>Create Awareness<\/em><\/strong>: There\nis an urgent necessity for states to make an intensive effort to create\nawareness of the BOCW Scheme &amp; register workers. This must happen in rural\nareas and by developers on construction sites.<\/li><li><strong><em>Clarify Eligibility for Scheme Benefits<\/em><\/strong>: Workers\ncan apply for BOCW Schemes only after a certain period of being registered with\nthe board. The biggest challenge is that by the time workers become eligible\nfor these Schemes, most of them have already migrated to another location and\nthis makes it difficult for them to avail the benefits of the Scheme. This\nrequirement should be casual so that workers apply for all schemes right after\nregistration\/along with the registration.<\/li><li><strong><em>Implement a Standard Structure Across\nStates<\/em><\/strong>: The Centre must take action in streamlining the\nimplementation of the BOCW Act across states in India. Considering the mobile\nnature of the staff, it would be easier if the same BOCW Card were applicable\nin all states of India. This would definitely help workers to avail of scheme\nbenefits quicker.<\/li><li><strong><em>Relax Conditions of the 90 days Employment\nCertificate<\/em><\/strong>: It is challenging for most workers to get this\ncertificate which makes it hard to obtain the BOCW Card made. The eligibility\ncriteria for this certificate can be relaxed by making it 90 days annually. <\/li><li><strong><em>Clarify the Renewal Process<\/em><\/strong>: If a\nworker has already registered for the card, they should be allowed for the\nrenewal within a 90 days certificate from the contractor or by self-declaration.\nThey must have to provide proof again if there have been any alterations to\nthese documents.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_BOCW_Scheme_during_Covid-19_Pandemic\"><\/span>Role of BOCW Scheme during Covid-19\nPandemic<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Because\nof the pandemic, there has been a significant impact on the employment of\nconstruction workers during the Covid-19 pandemic. Due to the complete lockdown\nin India, the rate of unemployment among construction workers has arisen. With\nan aim to provide financial help &amp; relief to construction workers, the\nCentral Government directed all the State Governments of India to use the\nunutilised cess welfare fund as these funds provide the social securities to\nthose construction workers or labourers who are registered with their\nrespective State Governments.<\/p>\n\n\n\n<p>As per\nthe report of the Ministry of Labour &amp; Employment, till March 2019, there\nwas approx. Rs. 49,625 crores of cess reserved by the States &amp; UTs, but only\nless than Rs. 20,000 has been utilised. There are huge differences in the\namount of cess collected among the states. During the lockdown, the Government\nof the States &amp; Union Territories (UTs) utilise the remaining cess funds\nfor the welfare of construction workers or labourers during the pandemic &amp;\nalso by implementing those unutilised funds for the upliftment of corona\nwarriors such as medical staff, police, doctors, etc.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_it_mandatory_to_register_under_BOCW_Scheme\"><\/span>Is it mandatory to register\nunder BOCW Scheme?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section\n7 of the BOCW Act, 1996, talks about the Registration of an Establishment. It\nsays that every employer of the construction work shall apply for an\napplication to the registration officer for Registration of an Establishment.\nThe application shall make an application for registration:<\/p>\n\n\n\n<ul><li>If the establishment starts operating its\nfunction after the commencement of the BOCW Act, the establishment must make an\napplication within 60 days from the date of its commencement;<\/li><li>If the establishment starts functioning before\nthe commencement of the BOCW Scheme or Act, then the establishment is needed to\nmake an application within 60 days from the date of commencement of such Scheme\nor Act.<\/li><\/ul>\n\n\n\n<p>If a\nregistering officer is satisfied with the reason for late registration, he or\nshe may grant registration, he or she may grant registration for that\nestablishment, and if all the forms &amp; documents are prescribed as per the\nterms &amp; conditions, they may issue the certificate of registration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nCentral Government acted the BOCW Scheme while giving the freedom to the State\nGovernment to lay out some proper procedures to help the unskilled labourers,\ngiving that the laws set in the Act are not breached.
