In India, a Copyright Society is registered under\n<strong><em>Section\n33 of the Copyright Act, <\/em><\/strong>and such a society is formed by authors &amp;\nother Copyright owners, which may include Licensing Entities by virtue of an\nassignment from the original author. The business of granting license\nconcerning dramatic, musical, literary, and artistic works incorporated in\nCinematograph films or sound recordings shall be carried out only via a\nCopyright Society duly registered under the said Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difference_between_PPL_and_IPRS_License_in_India\"><\/span>Difference between PPL and IPRS\nLicense in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li><strong><em>Meaning of PPL<\/em><\/strong>: PPL stands for Phonographic Performance Limited, which is a separate organisation which provides licenses to use pre-recorded songs or music on radio\/TV, in public places or on the internet on behalf of record companies &amp; performers. Initially, the <strong><em>IPI or Indian Phonographic Industry<\/em><\/strong> came into existence which was an association of phonogram producers established in 1936. The primary aim was to administer the broadcasting rights &amp; public performance and that&#8217;s why PPL came into existence in 1941, just like IPRS.<\/li><\/ul>\n\n\n\n<p><strong>Following are some categories of Music\nLicenses under PPL:<\/strong><\/p>\n\n\n\n<ol><li>Radio License for Government-owned Radio\nstation, Private FM or Community Radio Station;<\/li><li>License to play music at public events like DJ\nparties, promotion events, shows, etc.;<\/li><li>License to play pre-recorded music as background\nmusic in public. With PPL License, one cannot organise any type of event,\nconcert, etc. Moreover, for such performance, you need to obtain a separate\nlicense;<\/li><li>License for temporary storage, transfer or\nembodiment of sound recordings.<\/li><\/ol>\n\n\n\n<ul><li><strong><em>Meaning of IPRS<\/em><\/strong>: IPRS\nstands for Indian Performing Right Societies and it was established to protect,\nmonitor, and enforce the rights, privileges, and interests of its members,\ncomprising of composers, authors &amp; publishers of literary and\/or musical\nworks and is the sole representative body of authors, publishers, and composers\nof literary &amp; musical works in India. The members of IPRS have executed\nassignment deeds, exclusively assigning their Public Performing Rights\nconcerning their musical and\/or literary works in favour of IPRS. The primary\nrole of IPRS is to collect royalties from users of music who communicate the\nmusical or literary work to the public &amp; then disburse the same to its\nmembers.<\/li><\/ul>\n\n\n\n<p><strong>Following are some categories of Music\nLicenses under IPRS:<\/strong><\/p>\n\n\n\n<ol><li>Music License for Public Performance in hotels,\nmalls, pubs, multiplex, premises, banquets, etc.;<\/li><li>Music License for the use of sounds or music on\ncommercial TV, advertisement, etc.;<\/li><li>Music License for non-interactive &amp;\ninteractive music streaming on the internet;<\/li><li>License for broadcasting music on TV &amp;\nRadio;<\/li><li>License for Caller Ring Back Tone or Ringtone.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Are_PPL_and_IPRS_the_same_thing\"><\/span>Are PPL and IPRS the same\nthing?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>No, there is a huge difference between PPL and IPRS License<sup><a class=\"text-primary\" href=\"https:\/\/iprs.org\/\"><strong>[1]<\/strong><\/a><\/sup> in India. In the case of PPL, it collects &amp; distributes money on behalf of performers of art &amp; record companies from users for using recorded music or song. Whereas IPRS collects &amp; distributes royalties on behalf of music publishers, composers, and songwriters for the use of musical compositions &amp; lyrics.<\/li><li>For Perform Live Music or Liver Concert: The IPRS issues licenses when a business or any performer wants to conduct a liver concert or live singing on their premises.<\/li><li>For Playing Pre-recorded Song or Music: PPL issues a license when any user or entity wants to play pre-recorded music in their cafes, restaurants, malls, hotels, etc. Also, there is a difference between PPL and IPRS License procedures also.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_of_Obtaining_a_Music_License_in_India\"><\/span>Benefits of Obtaining a Music\nLicense in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Music License allows artists to perform their\nwork in events, concerts, etc.;<\/li><li>Music License augments the popularity &amp;\nawareness regarding specific music or song of an artist;<\/li><li>By obtaining this license, an artist can easily\nuse the platform to showcase their talent to the world;<\/li><li>The creation of an artist is safeguarded by way\nof Copyright as it lessens the chances of copying &amp; stealing the song.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_not_obtaining_a_Music_License\"><\/span>Penalties for not obtaining a\nMusic License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing the difference between PPL and IPRS License, now let\u2019s know the penalties prescribed for not getting a <a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/learning\/things-to-know-about-music-license-in-india\/\"><strong>Music License<\/strong><\/a> in India. Any business that didn&#8217;t get itself registered with the respective Copyright Society (IPRS or PPL) or is involved in doing any activity prescribed under Section 51 is liable for punishment as prescribed under <strong><em>Section 63 &amp; 63A of the Act<\/em><\/strong>.<\/p>\n\n\n\n<p><strong><em>As per Section\n63:<\/em><\/strong><\/p>\n\n\n\n<ol><li>The offender needs to pay a fine of not less\nthan&nbsp; Rs. 50,000 and the same may be\nextended to Rs. 2 lakh;<\/li><li>In many instances, it can also lead to\nimprisonment for 6 months which can be further extended to 3 years.<\/li><\/ol>\n\n\n\n<p><strong><em>As per\nSection 63A:<\/em><\/strong><\/p>\n\n\n\n<ol><li>In several cases, it can also lead to\nimprisonment for 1 year, which can be extended to 3 years;<\/li><li>The offender is accountable for paying a fine of\nnot less than Rs. 1 lakh, which may extend to Rs. 2 lakh.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing the difference between PPL and IPRS License, it is concluded that without PPL or IPRS License, no one is permitted to use the copyrighted music for their commercial benefits.
