In spirit, IPRS is an Association of Composers, Authors &amp; Publishers of musical and literary works associated with such musical works. From a legal constitution perspective, IPRS came into existence in 1969 as a Companies Act, 1956 and is a non-profit making body. This article will discuss the IPRS License for Events in detail.<\/p>\n\n\n\n<p>Copyright is a statutory\nright, like a right granted by the law passed by Parliament. The\nIPRS membership contains virtually all Indian Composers, Authors &amp; Music\nPublishers whose works are publicly performed to any considerable extent.<\/li><li>&nbsp;IPRS has\nAgreements of Reciprocal Representation with similar organizations in more than\n50 countries. <\/li><li>It authorizes all those sister Societies to\nadminister the rights of their members in their respective countries. From\ntheir side, they allow IPRS to help the rights of their members here in India.<\/li><li>The IPRS address more than a million foreign\ncomposers, authors and publishers along<\/li><li>&nbsp;its\naffiliation agreements with similar societies worldwide.<\/li><\/ul>\n\n\n\n<p><strong><em>Note: IPRS is affiliated with the\n\u201cInternational Confederation of World Societies of Authors &amp;\nComposers&#8221; (CISAC) based in Paris, representing more than 4 million\ncreators worldwide.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"IPRS_is_authorized_to_grant_licenses_collect_royalties_as_a_Copyright_Society_in_India\"><\/span>IPRS is authorized to grant licenses\n&amp; collect royalties as a Copyright Society in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>IPRS is a copyright society registered under the\nCentral Government as per Section 33 of the Copyright Act, 1957. <\/li><li>The Central Government issues a conditional\nregistration in favour of IPRS as a Copyright Society with effect from 28\nNovember 2017, which was confirmed vide a Certificate dated 8 June 2018, in\ncontinuation &amp; supersession of the November 2017 certificate.<\/li><li>The registration is valid for five years from\nsuch date of registration.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Work_done_by_IPRS_Administer\"><\/span>Work done by IPRS Administer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>IPRS administers rights regarding Musical Works\nlike musical compositions, tunes, or melodies.<\/li><li>IPRS\nadministers rights in respect of Literary Works like lyrics associated with\nmusical works.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rights_done_by_IPRS_administer\"><\/span>Rights done by IPRS administer.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Copyright Act, 1957\nissued that among the absolute<\/p>\n\n\n\n<p>rights granted to owners\nof rights in respect of their works by the following loosely described right:-<\/p>\n\n\n\n<ol><li>The right to perform the job in public;<\/li><li>The right to transmit the work by broadcast;<\/li><li>The right to transmit the broadcast of the work\nto the public by a loudspeaker;<\/li><li>The right to transmit the broadcast of the work\nto the public by any instrument;<\/li><li>The\nright to make the record in consideration of the work. <\/li><\/ol>\n\n\n\n<p><strong><em>Note: the first four rights are generally referred to in the Industry by the single expression &#8216;Performing Rights<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Performing_rights\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong><em>&#8216;, and the last is referred to as &#8216;Mechanical Rights&#8217; and are administered in place of its members as per the IPRS as assigned.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_of_IPRS_License_for_Events\"><\/span>Benefits of IPRS License for Events<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are numerous\nadvantages to acquiring an IPRS License for Events in India.<\/p>\n\n\n\n<p>Some of the benefits are\nas follows:<\/p>\n\n\n\n<ul><li>IPRS License helps artists or performers to use\nit as a medium to show their talent to the world.<\/li><li>The IPRS license helps increase the popularity\nof the songs or the artist and their events.<\/li><li>The artist&#8217;s creation is well protected after\ngetting the license, so there will not be any chance of stealing an artist&#8217;s\ncreation.<\/li><li>The third party can comfortably download or\nsubscribe to it with the artist&#8217;s name. Nevertheless, to get a general idea,\nthe license fee usually is INR 1.50 per square foot, and the minimum required\nroyalty by the Tariff is INR 50,000.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_the_offender\"><\/span>Penalties for the offender<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 63 &amp; 63 A. of\nthe Copyright Act define that in events, if a person or an entity does not\nfollow the registration procedure orcopyright and practice activities as in\nsection 51 of the Copyright Act 1957, then that person or entity or company\nwill be guilty of the following penalties-<\/p>\n\n\n\n<p><strong>The penalty by the Article 63 is that if any person infringes the s\ncopyright or other rights<\/strong>:<\/p>\n\n\n\n<ul><li>Imprisonment of a duration of at least six\nmonths and up to three years; and<\/li><li>Fine at least 50 000 INR and up to 2 00 000 INR.<\/li><\/ul>\n\n\n\n<p><strong>The sanctions, in article 63, are that when no one infringes copyrights\nor other rights and repeat offender, then:<\/strong><\/p>\n\n\n\n<ul><li>Imprisonment for a term of 1 year up to 3 years;\nand<\/li><li>Fine of less 1 00 000 INR and up to 2 00 000\nINR.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Therefore, we concluded that without the IPRS License, no one could use the copyrighted music for their benefit. Before applying for any IPRS License, one has to be sure about the type of License application. The procedure for obtaining the license is not very straightforward.
