The\noccupier shall apply for the Chief Inspector of Concerned State Government.\nAfter validation of the Site plan and other documents, the chief inspector\nshall grant the factory license.<\/p>\n\n\n\n<p>The Parliament of India introduced the Factories Act, 1948 on 23rd September 1948, which came into effect on 1st April 1949. The Act&#8217;s provisions empowered the State Governments to make their legislation regarding factories&#8217; registration, approval and licensing.<\/p>\n\n\n\n<p>The State Governments\nwere to establish mechanisms by which a Government Authority was to set up an\noffice consisting of Factory Inspectors and a Chief Factory Inspector. They\nwould regulate the setting of new factories and compliance requirements of\nexisting factories as per Sec 6 of the Factories Act (Approval, Licensing and\nRegistration of Factories). the Factories Act, 1948<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The factory owner is to ensure the health,\nsafety and welfare of all the workers when working on the factory premises.<\/li><li>The occupier has to ensure the provisions and\nmaintenance of the plant and machinery so that it is safe to operate without\nhealth risks.<\/li><li>They have to make proper arrangements in the\nfactory to ensure safety during the regular use, handling, storage &amp;\ntransport of articles and substances.<\/li><li>He has to ensure that accurate information,\ninstruction, training, and supervision are provided to the workers, which may\nbe deemed necessary to ensure the health and safety of all workers.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_Criteria\"><\/span>Eligibility Criteria<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The factory or establishment holds ten or more\nworkers employed with power for manufacturing activities.<\/li><li>The factory or establishment holds twenty or\nmore workers employed in using power for manufacturing activities.<\/li><\/ul>\n\n\n\n<p><strong><em>Note: The factories are broadly\nseparated into two sub-categories depending on the process of Hazardous &amp;\nNon-hazardous.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_Factory_license_for_Site_Plan_Approval\"><\/span>Documents Required for Factory license\nfor Site Plan Approval.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Following are the documents required for Factory License<\/strong>:- <\/p>\n\n\n\n<ul><li>Form-1 (Particular of Room in The Factory)<\/li><li>Copy of the factory building plan,<\/li><li>Id and Address proof of the applicant<\/li><li>Latest List of partners \/ Directors \/ Order of the Managing Agent appointed by Central Government\/ State Government \/ Local Authority as an occupier.<\/li><li>If there is a change of Directors, submit Form No. 32 of the      Companies Act,<\/li><li>1956.<\/li><li>Partnership deed \/ Memorandum of Articles of Association.<\/li><li>Bank account details<\/li><li>Expected Date of commencement of work,<\/li><li>Payment receipts<\/li><li>Land ownership document: Land ownership documents (Sale deed\/Rent deed \/ Lease deed) with Land Use conversion document if applicable.<\/li><li>Consent from all authorities<\/li><li>Particulars of equipment<\/li><li>Particulars of hazardous and non-hazardous wastes<\/li><li>Flow chart of the manufacturing process.<\/li><li>List of raw materials used in the manufacturing process.<\/li><li>List of types of machinery installed on the premises.<\/li><li>Such other will be as the Chief Inspector\/Director (ISH) may require.<\/li><li>Tax receipt.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_for_Factory_License_Renewal\"><\/span>Documents required for Factory License\nRenewal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A factory License is valid for up to one year, so you should renew it before its expiry. The license renewal process is the same as the registration process. If the application is complete in all aspects, factory premises shall be Inspected to adjudge suitability for registration and grant of license. If the factory Conforms to the statutory requirements, will grant the license within a month.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, the provisions of the Factories Act 1948 regulate Factory Registration. The Ministry of Labour and Employment manages the Act<sup><a href=\"https:\/\/labour.gov.in\/\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>. Factories Act also control the working condition in factories and deals with different problems concerning the health, safety, efficiency, and well-being of the persons at workplaces.
