The free sales of any weight and measurement items in India are not allowed. Still, it is regulated by the respective State Governments in which the seller of such weight and measurement products is operating its business, per section 23, of the Legal Metrology Act, 2009. Every dealer of weight and measurement products must get a license from its respective zonal of the Legal Metrology Authority of its state. All manufacturers, importer dealers, and repairers require a valid license from the authority of the Legal Metrology Department before conducting their respective activities.<\/p>\n\n\n\n<p>Tools like thermometers,\nbalances, weighing scales, hygrometers pressure monitors, measuring tapes,\netc., fall within the authority of the Legal Metrology Department.<\/p>\n\n\n\n<p>Overall, we can say that\nany device designed for weighing or measuring any product in a certain sum on\nthe imperial or metric scale is within the Legal Metrology Jurisdiction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dealer_License_under_Legal_Metrology_Act\"><\/span>Dealer License under Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Dealer License applies to a person or company complicated in the trading &amp; marketing of weights and measures. For getting the Dealer License, an applicant shall obey the provisions of State Legal Metrology (Enforcement) Rules, 2011 under the <strong><em>Legal Metrology Enforcement Rules, 2010<\/em><\/strong><sup><a href=\"https:\/\/megweights.gov.in\/acts.html\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong><em>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Required_Form_for_filing_to_obtain_Dealer_License_under_Legal_metrology\"><\/span>Required Form for filing to obtain\nDealer License under Legal metrology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>To apply a new application for a Dealer License\nin weights and measurements, Form LD-1 by schedule-IIA is required. <\/li><li>The renewal of the Dealer&#8217;s License Form LD-2 by\nschedule-IIB is required and issued using the Form LD-3 according to schedule\nIII.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_procedure_of_Obtaining_a_Dealer_License_under_Legal_Metrology\"><\/span>The procedure of Obtaining a Dealer\nLicense under Legal Metrology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The state controller of the Legal Metrology\nDepartment of the respective states where such a dealer is operating his business\ngrants the Dealer License obtained under <strong><em>section 23, of the Legal Metrology Act, 2009<\/em><\/strong>.<\/li><li>In India, many State governments have an online\nprocess for applying the dealer, and some states have an offline method.\nHowever, in all cases, the dealer license issuance process is not entirely\nonline.<\/li><li>As it involves inspection by the zonal state\nLegal Metrology Officers. Only after the physical verification of document the\nlegal metrology officer will generally recommend the application for the final\nissuance of the Dealer License.<\/li><li>Many states, while applying for the dealer\nlicense, ask for a copy of the dealer agreement from the original tools\nmanufacturer for which the dealer is applying for the dealer license.<\/li><li>Further, the government authority may also ask\nfor a copy of the No Objection Certificate (NOC) from the manufacturer of\nweight and measurement products.<\/li><\/ul>\n\n\n\n<p><strong><em>Note: apart from the documents,\nthe Legal Metrology Officer will also ask whether the address on which the\ndealer license is applied is a commercial address or a residential address, as\ncommercial address is generally acceptable by Legal Metrology Department.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_to_obtain_Dealer_License_under_Legal_Metrology\"><\/span>Documents required to obtain Dealer\nLicense under Legal Metrology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the\ndocuments required to attach with the Form LD-1 to apply for a dealer license\nunder Legal Metrology:<\/p>\n\n\n\n<ol><li>Business Proof of the Applicant Entity.<\/li><li>PAN &amp; GST of the Applicant Entity.<\/li><li>PAN Card &amp;Aadhar Card of promoters of the\nApplicant Entity.<\/li><li>&nbsp;NOC from\nthe property owner of the Applicant Entity in the Case of rented business\npremises.<\/li><li>Copy of duly registered rent agreement in Case\nof leased business premises.<\/li><li>NOC from the original weight and measuring\ninstrument manufacturer whose products the dealer will sell.<\/li><li>Dealership Agreement with the actual weight and\nmeasuring equipment manufacturer whose products the dealers will sell.<\/li><li>Copy\nof Modal Approval of the weight and measure that you intends to sell.<\/li><\/ol>\n\n\n\n<p><strong><em>Note: The receipt (Original\nTreasury challan) of the fee of 100 rupees is only to be paid into the\nDepartment account. <\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issuance_of_a_DealerLicense_under_Legal_Metrology\"><\/span>Issuance of a DealerLicense under Legal\nMetrology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After receipt of Form\nLD-1 duly annexed with all the documents mentioned above, the licensing\ndepartment will duly inspect the application along with the necessary\ndocuments. If the application form and attachments are correct as required, the\ndepartment will grant a dealer license within 30 days of such receipt.<\/p>\n\n\n\n<p>Still, there might be a\nprobability that the department will refuse the application due to\nnon-compliance with all or any of the requisites. The applicant will duly\ncommunicate the reason for such rejection within 15 days. The procedure of\nissuing the dealer license, to the max, will be completed within the scheduled\ntime.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_renewal_process_of_Dealer_License_under_Legal_Metrology\"><\/span>The renewal process of Dealer License\nunder Legal Metrology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For the dealer license\nrenewal, an applicant must submit Form LD-2 by schedule-IIB. An applicant must\nsubmit 100 rupees for the dealer license renewal under Legal Metrology.<\/p>\n\n\n\n<p><strong><em>Note: If the applicant is a\nsummons for objections, cutting of newspaper wherein a notice is given must be\nfiled with the authority concerned within 7 days.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Decisive, we see that Legal Metrology has definite and stringent rules related to weighing and measuring instruments.
