A need was anticipated to establish central laws about Labour&#8217;s\nsafety and proper organisation of welfare and other aided services. Building\nand other Construction Workers (Employment &amp; Service bet Regulation) Act\n1996 was established regarding workers&#8217; terms and conditions, safety, health\nand welfare measures. To\nfacilitate improvement in their working and provide financial aid under such\nconditions, the government formulated a board for giving financial assistance\nto them for their benefit under various schemes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_apply_for_BOCW_Registration\"><\/span>Who can apply for BOCW Registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Workers can apply for <strong><a href=\"https:\/\/swaritadvisors.com\/bocw-registration\">BOCW schemes<\/a><\/strong><a href=\"https:\/\/swaritadvisors.com\/bocw-registration\" class=\"text-primary\"> <\/a>only after a specific time of being registered with the board. <\/li><li>The challenge is that when workers become eligible to apply for these schemes, most have already migrated to other locations. <\/li><li>It makes it hard for them to avail scheme advantages. <\/li><li>This requirement should be anticipated so that workers can apply for all schemes immediately or with the registration.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Lack_of_Awareness_about_BOCW_Card_Schemes\"><\/span>Lack of Awareness about\nBOCW Card &amp; Schemes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>According to the Ministry of Labour &amp; Employment estimates, there are more than one crore workers in Delhi, Haryana, and Uttar Pradesh, of which only 24 lakh have an active BOCW certificate. <\/li><li>Despite the acclaim for the BOCW Card due to the price transfers provided from the BOCW fund during the lockdown, most of the workers we interact with daily are still unaware of it.<\/li><li>&nbsp;For every 30 workers from construction sites in Delhi NCR in December 2020. <\/li><li>We see that 24 of them did not know about the presence of this document. Besides, among those who knew about it, workers still did not apply for it primarily because they were unaware of the registration process. <\/li><li>We have also seen that workers are doubtful to pay <strong>the government fee (an amount that ranges from INR 20 to INR 105) for the<\/strong> <strong>BOCW<\/strong><sup><a href=\"https:\/\/clc.gov.in\/clc\/acts-rules\/building-and-other-construction-workers\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> card, as they are unaware of the various claim schemes they can avail themselves of once they are registered. <\/li><li>There is an element of lethargy as many have tried to apply several times and failed because of mistakes in the application form and incorrect\/incomplete information in the documents submitted. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_to_Obtain_BOCW_Renewal\"><\/span>Documents Required to\nObtain BOCW Renewal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Following are the documents require getting the BOCW\nRenewal<\/strong>:<\/p>\n\n\n\n<ul><li>Application should be submitted\nin triplicate in Form 1.<\/li><li>Attach a copy of the work order<\/li><li>Copy of Challan<\/li><\/ul>\n\n\n\n<p><strong><em>Note: Without\nthe proper documents with accurate information, BOCW Renewal is impossible.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Complicated_claim_and_BOCW_Renewal_Procedure\"><\/span>Complicated claim and\nBOCW Renewal Procedure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nprocesses to assist benefits of the BOCW schemes also vary from State to State.\nFor example, in Haryana, and can apply for most assertion schemes after a year\nof being registered, while one can start using claim schemes two months after\nbeing reported. Scheme names, benefits, and document requirements vary for each\nscheme and State.<\/p>\n\n\n\n<p>Even\nafter registration, workers must provide documents to apply for and benefit\nfrom schemes.<\/p>\n\n\n\n<p>This\nbureaucratic process does not end for workers after registration. They must\nrenew their registration regularly (every one, two, or three years conditional\non how much they paid the first time) to restore their entitlements. When their\nregistration expires, workers must reapply with the same documents. From our\nresearch, many do not renew their registration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_can_the_Registration_Certificate_be_revoked\"><\/span>When can the Registration Certificate be revoked?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If the registering officer determines that\nan organization&#8217;s registration was obtained through misrepresentation or the\nomission of a material fact, that the provisions of the Act have not been\nfollowed in connection with any work that is carried out by the organisation,\nor for any other reason that the registration has become ineffective or useless\nand is therefore required to be revoked.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If a worker has registered for the BOCW card before, they should be authorised to BOCW renew their license with a new 90-day certificate from the contractor or self-declaration.
