The purpose of the NGO is not to earn\nprofit, since it is a non- profit organisation, but the sole aim of an NGO is\nto perform charitable work for different segments of the society. The Term\n\u201cNon- Governmental Organization\u201d is defined in the Chapter 10, Article 7 of the\nUN Charter. The focus Of NGO\u2019s is on the economic development, emergency\nrelief, women\u2019s rights, child trafficking, children with physical disability,\npolicy advocacy, care for elders and many more aspects. But to initiate this,\nstarting an NGO requires determination, hard work and genuine desire to support\nother and therefore does not only requires money to start it. Hence, this\narticle will discuss about the things to keep in mind while planning to start\nan NGO for the welfare of the people. <\/p>\n\n\n\n<p>To start an NGO, it requires much knowledge, skills and resources with aid from the legal advisors, group of volunteers and government agencies. The formation of an NGO though similar in all the countries must be done in accordance with the rules and regulations of the country which may vary from nation to nation. The purpose of an NGO is to empower the people who are not aware of their powers and legitimate rights. To work for the welfare of the people is the motive of NGOs without expecting any profits or personal gains from it. <\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_65 counter-hierarchy It can be children\u2019s welfare, women\u2019s right, to save\nthe environment, care for the elders etc. a clear statement of the cause and\nmission must be drafted which reflects the purpose for which it stands for, the\ngoals it has, the target group and its objectives. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Set_up_the_board_of_Directors_or_members\"><\/span>Set up the board of Directors or members<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Once the cause\nfor which an NGO is going to start has been decided, the next thing is to\nexecute it by firstly setting up the board of Directors or members who will be\nresponsible and perform the duty to govern the NGO. Always have those who are\nwith the spirit of charity and social welfare, who are like minded and strong\nwilled people to be a part of the organisation of the body. Somebody who is not\ncoming with the aim of uplifting the weaker section of the society or for\ncharitable purpose but is there for earning money should not at all be\nconsidered for NGOs. There is no limit on the number of directors or founder\nmembers to be appointed. <\/p>\n\n\n\n<p>The right people\nmust be found who are skilled, passionate, determined and very much reliable. The\npurpose of NGO is for a social cause and therefore, one must choose correct\npeople for the proper working of it. Further, there is also a need to have\nsupport of the financial advisors, legal advisors having knowledge of legal\nprocedures, technicians, educators, government support etc to start an NGO. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Decide_a_name_for_your_NGO\"><\/span>Decide a name for your NGO <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The next step is\nto decide the name for your NGO. It is an obvious requirement for any\norganisation, to have a name from which it is known by others. The name must be\ncatchy and short, it can be anything be it the reflection of your cause or\npurpose for which the NGO is being set up, any idea that you may have etc. but,\nit should be kept in mind that the name should not be identical or similar with\nthat of the Government Authority Body, any registered company, Board of\nMinistry or any other existing NGO. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prepare_Memorandum_of_Association_MOA_and_Articles_of_Association_AOA\"><\/span>Prepare Memorandum of Association (MOA) and Articles of Association (AOA)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Every NGO is legally required to prepare Memorandum of Association (MOA) and Articles of Association (AOA) under Section 8 Companies Act 2013. The former is a trust deed and the latter specifies the bylaws that have to be followed. The MOA and AOA are the documents which contain the name and the address of the NGO, the goal, objectives and missions it has, information regarding the staffing and human resource, details regarding governing the body members, administrative laws and procedure and all the rules and regulations that are mandatory to follow for the proper functioning of an NGO. The MOA must be drafted in such a manner that it must be in accordance with and fulfil the parameters required for the registration and other purposes. It is advisable to hire legal NGO consultants who are proficient and well versed with the procedure and the requirements better. It is necessary to mention the bylaws that represent the regulations, rules, and the working pattern, responsibilities, working area, operation modes and the objectives of the NGO, before submitting the application for the registration of an NGO. NGO can be formed into three ways that is Trusts, Societies and Section 8 companies. A Trust Deed is required to be prepared if an NGO is formed under Trust, in accordance with the public Trust Act. A memorandum of Societies is required to be prepared if an NGO is formed under Societies, in accordance with the Indian Societies Act, 1860 and MOA and AOA is required to be prepared under Section 8 of the Companies Act, 2013. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Register_your_NGO\"><\/span>Register your NGO <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The next step to start an NGO is that once all the documents are prepared and the required fee is submitted, get your <a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/ngo-registration\"><strong>NGO registration<\/strong><\/a> under any of the following Acts: &#8211; <\/p>\n\n\n\n<ul><li><strong><em>Indian Trusts Act<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>At least two people are required in a charitable trust, but there is no limit of maximum members. <\/p>\n\n\n\n<ul><li><strong><em>Companies Act<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>Registration can be done when it is a Non-profit Company under the <strong>Section 8 of the Companies Act<sup><a class=\"text-primary\" href=\"https:\/\/www.mca.gov.in\/Ministry\/pdf\/CompaniesAct2013.pdf\"><strong><em>[1]<\/em><\/strong><\/a><\/sup><\/strong>, with the Registrar of Companies. <\/p>\n\n\n\n<ul><li><strong><em>Societies Registration Act<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>Minimum seven\nmembers are required to be the members in society. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Start_collecting_funds\"><\/span>Start collecting funds<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Once your NGO is\nregistered, the next step is to start getting funds to run and operate the NGO.\nThis can be done through internal sources like donations, fees, subscription\ncharges etc and through external sources like grants in the form of aid from\nprivate organizations, government or through foreign sources. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Get_connected_and_then_start_your_project\"><\/span>Get connected and then start your project<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>When the\nfundraising process starts, reach out to your networks. Always convey your\npurpose and message to the people to get familiar with the objective behind\nstarting an NGO. Get connected with other various NGOs, government agencies,\nprofessionals, and media houses and corporate and try to come into partnership\nwith them, because the main source of survival of an NGO is mainly through\npartnerships. Therefore, getting connected with the potential partners helps\nyour NGO to establish well and allowing them to believe in the cause you\nsupport. And finally you can start your NGO and achieve the goals and purposes\nthat you aimed for, for providing benefits and uplifting the society and\nhelping the marginalized section to get aware of their rights and to serve a\nbetter tomorrow for them. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Starting an NGO though is a tough job, but the purpose behind it is to work for the welfare of the society, the impoverished communities and uplifting the lives of the people living in miserable circumstances.
