Metrology is governed or managed by the Legal Metrology Act, 2009 in India, which repeals the Standard Weights &amp; Measures Act, 1976 and the Standards of Weights &amp; Measure (Enforcement) Act, 1985. measure trade and commerce.<\/li><li>To introduce and enforce weight and measurement standards.<\/li><li>Weights, measurements, or numbers are used to adapt product manufacturing, sale, and usage.<\/li><li>To rationalise <a href=\"https:\/\/swaritadvisors.com\/model-approval-certificate-for-weights-and-measures\" class=\"text-primary\"><strong>the Indian Metric process<\/strong><\/a> (meter, kilogram, etc.)<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_Legal_Metrology_Act\"><\/span>Role of Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before knowing about various penalties under <strong>Legal Metrology Act<\/strong><sup><a href=\"https:\/\/etula.up.gov.in\/Metrology\/\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong>,<\/strong> first, we see the role of Legal Metrology: <\/p>\n\n\n\n<ul><li>Establishing the Law;<\/li><li>Supervising the Law;<\/li><li>They are facilitating traceability for\nmeasurement and measuring devices.<\/li><\/ul>\n\n\n\n<p><strong><em>Note: Legal Metrology compliments\nindustrial &amp; scientific means and gives a hand in the practical application\nof measurements within the community.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_under_Legal_Metrology_Act\"><\/span>Penalties under Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Following are the different penalties under Legal Metrology Act:<\/strong><\/p>\n\n\n\n<table class=\"wp-block-table\"><tbody><tr><td>\n  <strong>Penal Section<\/strong>\n  <\/td><td>\n  <strong>Offences<\/strong>\n  <\/td><td>\n  <strong>Penalties under Legal\n  Metrology Act<\/strong>\n  <\/td><\/tr><tr><td>\n  <strong>Section 25 <\/strong>\n  <\/td><td>   <strong>Section 8(3)<\/strong> &#8211; Use weight, measure\/numeration   other than the standard weight, measure or enumeration.   <\/td><td>\n  Shall punish with a fine which may extend to Rs.25000\/-\n  and for the second time, imprisonment for a period which may extend to 6\n  months and with a fine.\n  <\/td><\/tr><tr><td>\n  <strong>Section 26<\/strong>\n  <\/td><td>\n  <strong>Section 26<\/strong> \u2013 Alteration of weight &amp;\n  measure\n  <\/td><td>   Shall punish with the fine of Rs.50000\/- and for the second time, imprisonment for 6 months, which may extend to 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 27<\/strong>\n  <\/td><td>\n  <strong>Section 8(4)<\/strong> \u2013 Manufacture of weight or measure\n  not conforming to standards\n  <\/td><td>   Shall punish with the fine of Rs.20000\/- and for the second time, imprisonment for a period which may extend to 3 years with a   fine.   <\/td><\/tr><tr><td>\n  <strong>Section 28<\/strong>\n  <\/td><td>\n  <strong>Section 10 <\/strong>\u2013 Dealing, contract, or transaction\n  concerning items etc., by weight, measure, or numeration than prescribed\n  <\/td><td>   Shall give punishment with a fine of Rs.10000\/- and   for the second time, imprisonment for a period that may extend to 1 year with   a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 29<\/strong>\n  <\/td><td>\n  <strong>Section 11<\/strong> \u2013 Quote\/make announcement\/problem\/\n  exhibit of price list\/changing price than by a standard unit of weight,\n  measure, or number.\n  <\/td><td>   Shall give punishment with a fine of Rs.10000\/- and for the second time, imprisonment for a period that may extend to 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 30 <\/strong>\n  <\/td><td>   <strong>Section 12<\/strong> \u2013 Demanding or Receiving any articles or thing on service in excess or less than the quantity specified by   contract\/agreement.   <\/td><td>   Shall give punishment with a fine of Rs.10000\/- and for the second time, imprisonment for a period that may extend to 1 year with   a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 31<\/strong>\n  <\/td><td>\n  <strong>Section 17<\/strong> \u2013 Maintenance of records,\n  registers by manufacturer, repairer\/dealer, weight production, measure\n  document and register on demand.\n  <\/td><td>   Shall give punishment with a fine of Rs.5000\/- and for the second time, imprisonment for a period that may extend to 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 32<\/strong>\n  <\/td><td>\n  <strong>Section 22<\/strong> \u2013 Failure to get Model Approved\n  <\/td><td>Shall give punishment with a fine of Rs.20000\/- and for the second time, imprisonment for a period that may extend to 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 33<\/strong>\n  <\/td><td>\n  <strong>Section 24<\/strong> \u2013 Use of unverified weight or\n  measure\n  <\/td><td>   Shall give punishment with a fine of Rs.2000\/- which may extend to Rs.10000\/- and for the second time, jail for a term of 1 year   with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 34<\/strong>\n  <\/td><td>\n  <strong>Section 34<\/strong> \u2013 Sale or parcel of commodities,\n  etc., by non-standard weight or measure \n  <\/td><td>   Shall give punishment with a fine of Rs.2000\/- but which may be extended to Rs.5000\/- and for the second time, with imprisonment for a term of 3 months but which may extend to 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 35<\/strong>\n  <\/td><td>\n  <strong>Section 35<\/strong> \u2013 delivering services by\n  non-standard weight\/measure\/numeration\n  <\/td><td>   Shall give punishment with a fine of Rs.2000\/- but which may extend to Rs.5000\/- and for the second time, with imprisonment for   3 months to 1 year and a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 36(1)<\/strong>\n  <\/td><td>\n  <strong>Section 18(1)<\/strong> \u2013 Selling of non-standard packages\n  <\/td><td>   Shall give punishment with a fine of Rs.25000\/- but which may extend to Rs.50000\/- and for the second time, with a fine of   50000\/- which may extend to 1 Lakh or imprisonment for a term 1 year with   fine.   <\/td><\/tr><tr><td>\n  <strong>Section 36(2)<\/strong>\n  <\/td><td>   <strong>Section 18(2)<\/strong> import, manufactures or causes to be manufactured, packed, or imported ant pre-packed commodity with error in net-quantity.   <\/td><td>   Shall give punishment with a fine of Rs.10000\/- or imprisonment for 1 year or with both.   <\/td><\/tr><tr><td>\n  <strong>Section 37<\/strong>\n  <\/td><td>\n  <strong>Section 37<\/strong> \u2013 Contravention through to\n  Government approved Test Centre\n  <\/td><td>   Shall give punishment with a fine of up to   Rs.1000\/-, which may extend to Rs.1 Lakh. On the other hand, a shell provides punishment with imprisonment for a year term of 1 year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 38<\/strong>\n  <\/td><td>\n  <strong>Section 19<\/strong> \u2013 Non-registration by the importer\n  of weight or measure\n  <\/td><td>\n  Shall give punishment with a fine of Rs.25000\/- and\n  for the second time, imprisonment for a term of 6 months. \n  <\/td><\/tr><tr><td>\n  <strong>Section 39<\/strong>\n  <\/td><td>\n  <strong>Section 20<\/strong> \u2013 Import of non-standard weight or\n  measure\n  <\/td><td>\n  Shall give punishment with a fine of Rs.50000\/- and,\n  for the second time, jail for a period that may extend to 1 year.\n  <\/td><\/tr><tr><td>\n  <strong>Section 40<\/strong>\n  <\/td><td>\n  <strong>Section 15<\/strong> \u2013 Obstructing Director or Legal\n  Metrology Officer or Controller\n  <\/td><td>   Shall be punished with jail for 2 years and for the second time, with jail for a term of 5 years.   <\/td><\/tr><tr><td>\n  <strong>Section 41<\/strong>\n  <\/td><td>\n  <strong>Section 41<\/strong> \u2013 Giving incorrect details or a\n  false return.\n  <\/td><td>   Shall give punishment with a fine of Rs.5000\/- and, for the second time, with imprisonment for a term of 6 months Shall give punishment with a fine of Rs.5000\/- and for the second time,   jail for a period that may extend to 1 year with a fine.      <\/td><\/tr><tr><td>\n  <strong>Section 42<\/strong>\n  <\/td><td> <strong>Section 42<\/strong> \u2013 Vexatious Search   <\/td><td>   Shall be punished with jail for a term which may extend to 1 year or with a fine of Rs.10000\/- or both.   <\/td><\/tr><tr><td>\n  <strong>Section 43<\/strong>\n  <\/td><td><strong>Section 43<\/strong> \u2013 authentication in Contravention   of Act and Rules   <\/td><td>\n  Shall be punished with jail for 1 year or a fine of\n  Rs.10000\/- or with both.\n  <\/td><\/tr><tr><td>\n  <strong>Section 44<\/strong>\n  <\/td><td><strong>Section 44 \u2013<\/strong> Counterfeiting seals, etc.   <\/td><td>   Shall give punishment with jail for a term of 6   months but which may extend to 1 year, and for the second time, imprisonment for a period of 1 year, which may extend to 5 years.    <\/td><\/tr><tr><td>\n  <strong>Section 45<\/strong>\n  <\/td><td>\n  <strong>Section 23<\/strong> \u2013 Manufacturer of weight or\n  measure without a license\n  <\/td><td>   Shall give punishment with a fine which may extend to Rs.20000\/- and for the second time, jail for a term which may extend to one year with a fine.   <\/td><\/tr><tr><td>\n  <strong>Section 46<\/strong>\n  <\/td><td>\n  <strong>Section 23<\/strong> \u2013 Sale\/Repair of weight\/Measure\n  without a license\n  <\/td><td>\n  Shall give punishment with a fine of Rs.5000\/- and\n  for the second time, with jail for a term of 1 year with a fine.\n  <\/td><\/tr><tr><td>\n  <strong>Section 47<\/strong>\n  <\/td><td>\n  <strong>Section 47<\/strong> \u2013 Tampering with License\n  <\/td><td>\n  Shall give punishment with a fine of Rs.20000\/- and\n  for the second time, with jail for a term of 1 year and fine.\n  <\/td><\/tr><tr><td>\n  <strong>Section 49<\/strong>\n  <\/td><td>\n  <strong>Section 49<\/strong> \u2013 Offences by Companies\n  <\/td><td>   Shall be liable to be a delivering appeal against and punished and the power of the court to publish the name, business place, etc., of companies convicted.   <\/td><\/tr><tr><td>\n  <strong>Section 52(3)<\/strong>\n  <\/td><td>\n  <strong>Section 52(1)<\/strong> \u2013 Provision of rule made under the\n  Act.\n  <\/td><td>In making a rule in this Section, the Central   Government may provide that a violation thereof shall give punishment with a   fine of Rs.5000\/-.   <\/td><\/tr><tr><td>\n  <strong>Rules 32(2) under\n  Legal Metrology (Packaged Commodities) Rules, 2011<\/strong>\n  <\/td><td>   <strong>Rule 18(2) 0f Legal   Metrology (Packaged Commodities) Rules, 2011<\/strong> \u2013 Sale of any packed form commodity at a price exceeding the MRP.   <\/td><td>\n  Shall give punishment with a fine of Rs.2000\/-\n  <\/td><\/tr><tr><td>\n  <strong>Rules 32(2) under\n  Legal Metrology (Packaged Commodities) Rules, 2011<\/strong>\n  <\/td><td>   <strong>Rules 18(5) under   Legal Metrology (Packaged Commodities) Rule, 2011 \u2013 <\/strong>obliterate smudge change the MRP   shown by the packer, importer or manufacturer   <\/td><td>\n  Shall give punishment with a fine of Rs.2000\/-\n  <\/td><\/tr><tr><td>\n  <strong>Rule 32(1) of Legal\n  Metrology (Packaged Commodities)Rules,2011<\/strong>\n  <\/td><td>\n  <strong>Rule 27&nbsp; to 31- <\/strong>Non-registration of packers, importers, and\n  manufacturers of packed commodities\n  <\/td><td>\n  Shall give punishment with a fine of Rs.4000\/-\n  <\/td><\/tr><tr><td>\n  <strong>Section 53(3)<\/strong>\n  <\/td><td>\n  <strong>Section 53(1)<\/strong>&#8211; Provision of Rule made under the\n  Act.\n  <\/td><td>\n  In forming any rule in this Section, the Central\n  Government may provide that a violation thereof shall punish with a fine of\n  Rs.5000\/-.\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The regulation for controlling measurements and measuring devices is facilitated under the Legal Metrology Act.
