In case the labelling standards are not adhered to by\nthe manufacturer, then the product shall be treated as &#8216;Misbranded&#8217; as per the\nDrugs and Cosmetics Act, 1940. The misbranding of the product shall have\nconsequences such as suspension\/ cancellation of license and criminal\nprosecution. These products might also be sealed and confiscated to prevent\ntheir sale in the market. Under the head \u201cIngredients\u201d    The concentration of all the ingredients must be mentioned\u00a0     The order of the ingredients must be in descending order of the weight or concentration.      \u00a0   <\/td><\/tr><\/tbody><\/table>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  <strong>Type<\/strong>\n  <\/td><td>\n  <strong>Information<\/strong>\n  <\/td><\/tr><tr><td>   The following information can be published on either inner or outer labels.   <\/td><td>       Details regarding batch code- The details should be preceded by \u2018batch\u2019 batch no\u2019 or \u2018lot\u2019 lot number\u2019    Number for manufacturing license- the details must be preceded by \u2018M\u2019, \u2018M.L. No.\u2019  or \u2018Mfg. Lic. No\u2019      <\/td><\/tr><\/tbody><\/table>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  <strong>Type<\/strong>\n  <\/td><td>\n  <strong>Information<\/strong>\n  <\/td><\/tr><tr><td>   Labelling information is to be published for <strong>Outer Labels only.<\/strong>   <\/td><td>\n  Net contents of the product (weight of solids, liquids,\n  semi-solids)\n  <\/td><\/tr><tr><td>\n  Number of items in the package (if it is more than one)\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  <strong>Type<\/strong>\n  <\/td><td>\n  <strong>Information<\/strong>\n  <\/td><\/tr><tr><td>\n  Labelling information to be published for <strong>Inner Labels only.<\/strong>\n  <strong>(Applicable only to\n  cosmetics linked with hazards)<\/strong>\n  <\/td><td>\n  Directions for use must be stated\n  <\/td><\/tr><tr><td>\n  Any possible hazard, caution, warning or directions\n  <\/td><\/tr><tr><td>\n  Names of all the ingredients that are poisonous or hazardous\n  <\/td><\/tr><tr><td>   <strong>If non-hazardous then only the declaration mentioned for inner and outer labels shall be mentioned.<\/strong>   <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Declaration_on_Imported_Cosmetics_as_per_Cosmetic_rules\"><\/span>Mandatory Declaration on Imported Cosmetics as per\nCosmetic rules.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Cosmetics imported to India must make\ncertain declarations per the cosmetics rule. The government has made no\nexceptions for imported cosmetics, and the importer must provide all the\ninformation the domestic manufacturer provides.<\/p>\n\n\n\n<p>The following information must be declared\nas per Labelling Standards for Cosmetics:<\/p>\n\n\n\n<ul><li>The number of  Import registration certificates- This number should be preceded by &#8220;RC&#8221;. &#8220;RC no.&#8221;, &#8220;Reg.Cert.no&#8221;<\/li><li>Name of the importer<\/li><li>Address of the importer<\/li><li>Address of the manufacturing unit- In case the manufacturer doesn&#8217;t want to declare this the address of the original manufacturing country would suffice.<\/li><li>If the country of import does not require a manufacturing license number the same can be omitted.<\/li><li>Special declaration for Hair Dyes:<ul><li>The manufacturer of hair dyes needs to mention a caution- This caution must state that the product has the potential to cause skin irritation and that the product should not be used on eyelashes or eyebrows as it can cause blindness.<\/li><li>Hair dyes contain various strong chemicals it can cause skin inflammation. The manufacturer must print directions that state the method to test whether the product can cause harm to your skin.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Relaxation_to_Labelling_Standards_on_small-sized_packages_for_Cosmetics\"><\/span>Relaxation to Labelling Standards on small-sized packages for Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Cosmetic rules small sized packages are\nexempted from certain Labelling Standards for Cosmetics such as<\/p>\n\n\n\n<ul><li>A small-sized packaging need not mention the manufacturer&#8217;s address in detail. A shortened address with the pin code will be enough.<\/li><li>The small-sized cosmetics need not mention their batch name if they weigh up to 10 grams or 25ml in a liquid state.<\/li><li>The declaration of the content and the list of ingredients need not be made by the manufacturer of cosmetics that do not exceed 30 grams or 60 ml.<\/li><li>However, the manufacturer must comply with and imprint other vital information required on the packaging.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BIS_Standards_Applicable_to_cosmetics\"><\/span>BIS Standards Applicable to cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The cosmetic rules specify <strong><a href=\"https:\/\/swaritadvisors.com\/bis-certification\" class=\"text-primary\">BIS<\/a><\/strong> standards that are applicable to cosmetic products. These standards are mentioned in the Ninth Schedule of cosmetic rules. The schedule mentions 37 product categories that need to obtain BIS standards. The BIs requirement shall be applicable to both international and domestic products.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_declaration_on_packages_under_LMPC_rules_2011\"><\/span>Mandatory declaration on packages under LMPC rules, 2011<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The manufacturer must need to adhere to the <strong>Legal metrology packaged commodity rules 2011<\/strong><sup><a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=1842006\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> along with the cosmetic rules. Additional declarations that need to be made are:<\/p>\n\n\n\n<ul><li>Generic name of the product<\/li><li>M.R.P (maximum retail price) of the product<\/li><li>Contact details of the customer care (phone number and email id)<\/li><li>Date of import in cases wherever applicable<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> Labelling Standards for Cosmetics are set by the cosmetic rules of 2020. The manufacturers must comply with all the rules set by the concerned authorities.
