required for making cosmetics in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A manufacturer requires to obtain the following licenses <strong>for making cosmetics in India<\/strong>:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"License_for_Manufacturesale_distribution\"><\/span>License for Manufacture\/sale\/ distribution<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Drugs and\ncosmetic rules state that a manufacturer needs to obtain a license of Form 32\nby applying for Form no.31 with state license authority. The manufacturer shall\nbe able to manufacture 10x of all the cosmetics categories mentioned in\nSchedule M-II of the rules.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Loan_License_for_Manufacturing_of_cosmetics\"><\/span>Loan License for Manufacturing of cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The manufacturer\nhas the provision for obtaining a loan license under Form 32-A by applying for\nan application for a loan as mentioned under Form 31-A, with licensing\nauthority of the state.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"License_for_grant_of_approval_for_carrying_out_tests_or_cosmetics\"><\/span>License for grant of approval for carrying out tests or\ncosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The manufacturer\nhas to get approval for conducting tests on cosmetics and raw materials (Form\n37). If the manufacturer fails to comply with\nthese provisions, the license may not be granted. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_eligibility_requirements_for_working_staff_in_a_cosmetic_manufacturing_unit\"><\/span>The eligibility requirements for working staff in a\ncosmetic manufacturing unit<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nmanufacturers must ensure that the staff that is employed in the manufacturing\nprocess must possess the knowledge and technical know-how and fulfil the\nfollowing requirements:<\/p>\n\n\n\n<ul><li>Diploma in Pharmacy \u2013 that is approved by the Pharmacy Council of\nIndia under the Pharmacy Act, 1948<\/li><li>Must be Registered under the Pharmacy Act, 1948<\/li><li>The candidate must have cleared the intermediate examination and\nhave chemistry as one of the core subjects.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rules_for_labelling_of_products\"><\/span>Rules for labelling of products<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>Details such as the product&#8217;s name, the manufacturer&#8217;s name, and the\npremises&#8217; complete address must be clearly stated on the inner and outer\nlabels. <ul><li>The outer label must clearly specify the ingredients being used in\nthe product\u2019s manufacturing.<\/li><\/ul><ul><li>The inner label must have directions to use, possible hazards and\nrelevant warnings to ensure safety printed over it.<\/li><\/ul><ul><li>The product must contain the Batch number that is preceded with the\nletter B and the Manufacturing number preceded with the letter M over the\nlabel.<\/li><\/ul><ul><li>Other labelling requirements as per the BIS must also be provided.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_of_the_factory\"><\/span>Requirements of the factory:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Manufacturing factory must comply with the conditions mentioned in schedule M-II <strong>for making cosmetics in India<\/strong>. These are:<\/p>\n\n\n\n<ul><li>Location of the factory: it is essential that the area where the\nmanufacturing factory is situated must be kept clean and hygienic. The\nmanufacturer must ensure that the factory does not function near a residential\narea.<\/li><li>Factory Building: The walls of the factory building must able to be\nwashable, dust and dirt free. The rooms in the building must be at least six\nfeet from the floor in height. The factory building must be kept free from\nrodents, insects etc.<\/li><li>Water: The manufacturer must ensure that the factory has proper\nsystems installed for the disposal of the document.<\/li><li>Staff: The staff should not be suffering from any infectious\ndisease. The manufacturer must provide its staff with safety equipment such as\ngloves, masks, and uniforms. Along with this a First Aid facility should also\nbe made available in the factory.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_Cosmetic_Registration\"><\/span>Documents Required for Cosmetic Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The documents required for <strong>making cosmetics in India are:<\/strong><\/p>\n\n\n\n<ul><li>Proof of ownership of the premises<\/li><li>Documents showing the constitution of the firm<\/li><li>A Declaration form<\/li><li>Blueprint of the site plan<\/li><li>Affidavit of partners, directors and proprietor as per the act<\/li><li>A copy of Certificate registration from the<strong> Pharmacy Council of India<\/strong><sup><a href=\"https:\/\/www.pci.nic.in\/\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><\/li><li>A copy of the pharmacist\u2019s experience certificate<\/li><li>Copy of qualification of pharmacist and other relevant members<\/li><li>Affidavit of registered pharmacist on full-time employment attested by the Notary public<\/li><li>Appointment letter of the registered pharmacist<\/li><li>Application forms (31,31-A or 36) are downloaded in PDF format.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_manufacturer_registration_for_making_cosmetics_in_India\"><\/span>Process of manufacturer registration for making cosmetics\nin India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The manufacturer of cosmetics can apply for\na licensing process will be as follows:<\/p>\n\n\n\n<ul><li>The manufacturer must visit the SUGAM portal<\/li><li>Then, the applicant must click on the Login\/ signup button <\/li><li>On the registration purpose, select the purpose as &#8216;Cosmetic Registration&#8217; and click on the submit button.<\/li><li>The applicants must enter details as prompted. Then upload the documents (ID proof of authorised signatory, Declaration form, letter from the pharmacist)<\/li><li>After this, a verification Link will be sent to the registered mail id. Click on the verification Link, and the application shall be advanced for approval from the concerned authority.<\/li><li>The authority shall forward the registration approval to the registered email id.<\/li><li>After approval, the applicant must re-login to the portal by entering the user id and password.<\/li><li>Choose the department and the form type in the form submission section.<\/li><li>Select the type of application on the portal.<\/li><li>Click on the continue button after submission of the application<\/li><li>The portal shall show the preview of the application again, check for any errors and then click on save and continue.<\/li><li>After this, the user will be redirected to a checklist page. Here the user has to upload each document individually and hit the submit button.<\/li><li>The <strong><a href=\"https:\/\/swaritadvisors.com\/cdsco-cosmetic-import-registration\" class=\"text-primary\">CDSCO<\/a><\/strong> shall grant the registration to the manufacturer for<strong> making cosmetics in India.<\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> For making cosmetics in India, the manufacturer must obtain all the licenses as laid down by the government. Along with this, the manufacturer has to follow labelling rules and maintain factory conditions as per the drugs and cosmetics act.
