The European Union Trademark is indeed a unitary\ntitle covering all 28 members of the EU.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Filing_Requirements_in_the_EU\"><\/span>Filing Requirements in the EU<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nofficial languages of the European Union Intellectual Property Office are\nFrench, Italian, Spanish, English, or German. Applications for Trademark\nRegistration in the European Union can be filed in any of the 23 languages of\nthe EU, a 2<sup>nd<\/sup> language which is one of the EUIPO&#8217;s official\nlanguages, must be stated as a possible language for revocation, opposition, or\ninvalidity proceedings. If the application of the Registration was filed not in\none of the official languages, then the translation in the selected official\nlanguage should be provided to the Office.<\/p>\n\n\n\n<p><strong><em>To get\nthe filing date of an application for Trademark Registration in the European\nUnion should contain:<\/em><\/strong><\/p>\n\n\n\n<ol><li>Request for Trademark Registration;<\/li><li>List of the products and\/or services;<\/li><li>Trademark Representation;<\/li><li>Details of the applicant.<\/li><\/ol>\n\n\n\n<p>If priority is claimed, a certified copy of the Priority Document should be submitted to the Intellectual Property Office within 3 months from the date of filing the application. The results of\nboth Search Reports &amp; Surveillance Letters are for information only; only\nupon the owners&#8217; opposition to these earlier rights can cancel the\nRegistration.<\/p>\n\n\n\n<p><strong>Step 3: Examination<\/strong>:\nDuring the examination, your Trademark is examined to see whether it is unique\nor not. An application for Trademark Registration shall be rejected by the\nEUIPO in whole\/in part if it doesn\u2019t meet the examined requirements.<\/p>\n\n\n\n<p><strong>Step 4: Publication<\/strong>: Once\nthe search report is sent to the applicant, then the EUIPO will publish the\nTrademark application in the Trademark Journal in 23 EU official languages.<\/p>\n\n\n\n<p><strong>Step 5: Opposition<\/strong>: Within\na period of 3 months of the publication date, an opposition may be submitted.\nAn opposition notice is generally based on the following 2 reasons:<\/p>\n\n\n\n<ol><li>The 3<sup>rd<\/sup> party has a previous right (or more than one) &amp; believes that yours will, if registered, conflict with it or;<\/li><li>The 3<sup>rd<\/sup> party considers that your Trademark shouldn&#8217;t be accepted. You can file an opposition by filing an application form &amp; paying the requisite fee.<\/li><\/ol>\n\n\n\n<p>One in\n5 applications for European Union Trademarks is opposed by the Trademark owners\nthat are already on the market. The EUIPO decides on these disputes after other\napplicants, opponents &amp; parties have submitted arguments &amp; evidence.\nThe applicant can minimise the risk of opposition by searching for potential\nconflicts before they apply.<\/p>\n\n\n\n<p><strong>Step 6: Registration<\/strong>: If\nthe application for Trademark Registration in the European Union and the sign\nto which it relates meets all the requirements, the subject matter of the\napplication will be registered as a Trademark. After Registration, the EUIPO\nissues a Trademark Registration Certificate. In case your application is\nrejected, it is still possible to convert (IP Bridge) your European Union\nTrademark application into national Registrations, provided no conflict exists.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_and_Renewal_of_Trademark_Registration_in_the_European_Union\"><\/span>Validity and Renewal of\nTrademark Registration in the European Union<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The validity of Trademark Registration in the European Union is for 10 years from the filing date &amp; can be renewed for successive ten years. The owner of a Trademark may request for the renewal of the term during a 6-month period prior to the expiry date of Trademark Registration.
