A trademark provides a distinctive identity to a brand and sets a certain standard of quality for its products which can be trusted by people. Trademark registration is important as a brand shall lose its distinctive characteristic if a trademark is not provided to it. Generally, there are three symbols that are most commonly used to signify the trademark rights, that are, Trademark Symbol <strong>\u2122, <\/strong>Service mark symbol SM and Registered Symbol \u00ae. The use of these symbols depends upon the nature of the goods and services sold and the trademark application with the trademark registry one or more of these marks can be used. It creates a distinctive identity of the product sold by a particular brand. Common trademarks include logos, name, words, symbols and even sounds. To protect a company\u2019s mark from being used illegally by others, trademark protection is necessary. Trademark protection not only stops other persons from illegally using a registered mark but also does not allow a mark quite similar to a well-known mark to get registered. Hence, trademark registration in accordance with the rules and regulations prescribed under the <strong><em>Indian Trademark Act 1999 <\/em><\/strong>is important for a brand to protect its mark from being infringed by others. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Trademark_Symbols_used_in_India\"><\/span>Different Trademark Symbols\nused in India <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Trademark Symbols provides protection to different brands registered under the Trademarks Act. There are usually 3 different trademark symbols which are used in India. The TM symbol is used to indicate the fact that a trademark application is made with respect to the trademark and serves as a warning for counter- fitters and infringers that may be sued. Registering a trademark gives an exclusive right to a company or a person providing a legal evidence of ownership of a particular trademark. <\/p>\n\n\n\n<p>To obtain a trademark an individual\nor a company has to file a trademark application with the Trademark Registry\nand only then the company or the individual shall have the right to use the TM\nsymbol. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Service_mark_Symbol_SM\"><\/span>Service mark Symbol, SM<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The service mark\nsymbol, SM is used to denote that the trademark applied for services of such\nbusiness. SM is used with the trademark application filed by the applicant\nunder class <strong><em>35- 45<\/em><\/strong>. Some applicants prefer to use TM symbol for trademark\napplication filed under <strong><em>class 1- 34<\/em><\/strong> and SM for trademark\nfiled under class 35- 45. Using SM mark for trademark application under <strong><em>class\n35- 45<\/em><\/strong> and TM symbol for all classes are both acceptable. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Registered_Symbol_%C2%AE\"><\/span>Registered Symbol \u00ae<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The \u00ae symbol indicates that a particular mark is registered and the owner\nof the well known mark can now enjoy the legal protection from any violation\nand infringement of trademark laws in India. A registered symbol \u00ae prevents the unauthorized use or copying\nof the registered mark. However a registered mark comes with a legal binding,\nthat is, the using of \u00ae symbol is\nlegally allowed only when the trademark is registered with the Trademark\nregistry. Using of the \u00ae symbol after\nmerely filing the application for trademark registration or without getting a\nparticular mark registered by the registry is considered to be unlawful and\nillegal in India. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_registration_procedure\"><\/span>Trademark\nregistration procedure <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To register a\ntrademark, the below mentioned steps are required to be followed: &#8211; <\/p>\n\n\n\n<p><strong>Step 1<\/strong><\/p>\n\n\n\n<p>The first step\nis that the applicant if required look for a brand name which has a distinctive\nidentity. A brand name which is unique will easily be noticed by the people and\ntherefore one must search a mark which does not resemble to the already\nexisting registered mark. <\/p>\n\n\n\n<p><strong>Step 2 <\/strong><\/p>\n\n\n\n<p>The applicant after finalizing a name having a distinctive identity shall apply for the trademark application. A Form TM- 1 has to be filled under the Trademarks Act to proceed further. <\/p>\n\n\n\n<p><strong>Step 3 <\/strong><\/p>\n\n\n\n<p>The applicant\nafter filing the application form is required to file a registration\napplication in order to get its trademark protected under the Indian Trademarks\nAct. The registration of the trademark is done with the Trademark Registry. <\/p>\n\n\n\n<p><strong>Step 4 <\/strong><\/p>\n\n\n\n<p>Once the application is submitted, an\nexamination officer shall be appointed by the Trademark Registry who shall\nexamine the application. If the examination officer after examining the\napplication is satisfied, he shall approve the registration of the mark.\nHowever, is the examination officer is not satisfied with the application; he\nshall pass a refusal order for the same. <\/p>\n\n\n\n<p><strong>Step 5<\/strong><\/p>\n\n\n\n<p>Once the application is approved by the examination\nofficer, it is published in the Trademarks Journal for scrutiny. If no person\nraises any opposition within a period of <strong><em>3 months<\/em><\/strong>, then the trademark\napplication is accepted for registration. <\/p>\n\n\n\n<p><strong>Step 6 <\/strong><\/p>\n\n\n\n<p>A Trademark registration certificate is provided to the\ntrademark holder once the trademark application is accepted and registered by\nthe Trademark Registry.
