The creator is given an exclusive right over the\nuse of his or her creation for a specified period of time. Intellectual property\nright is in itself a very broad term. It is the outcome of human intellect\nwhich includes creativity, invention, trademarks, songs, brand etc. It protects\nthe rights of the creator of the original work and provides many legal rights\nas well. Efforts in terms of\nmanpower, energy, time, money, skill and etc are required to create or invent\nsomething new and original. Such creation and invention that takes place is\nclearly an intangible property of the person who created or invented it. And\nthus, it also needs to be protected in some or the other way. Legal rights are\nprovided to the creator or innovator to get the economic benefits on such\ncreation and invention. Therefore, Intellectual Property Rights are the\nexclusive territorial rights which are provided to the owner of the original\nwork, by which the owner can sell, license, assign, buy his intellectual\nproperty similar to that like physical property. <\/p>\n\n\n\n<p>The registration of IPR at the legal authorities is important in some tangible or presentable form to claim all the benefits upon registration. The Trademarks Act, 1999 provides the\nrules and procedures which are required to be followed in order to register a\ncertain trademark and get all the legal rights and benefits that can be enjoyed\nby the owner of the trademark upon the registration. <\/p>\n\n\n\n<p>Trademark helps the companies to make their\nown reputation, recognition and trust amongst the customers. In many cases, the\ncustomers rely on the trademarks when it is difficult to inspect the quality of\nthe product or service. <\/p>\n\n\n\n<p>The Indian Trademarks Act states that any\nmark which is distinctive, that is, a mark which is capable of distinguishing\ngoods and services of one undertaking from another and is capable of being\nrepresented geographically can be a trademark. <\/p>\n\n\n\n<p>The initial trademark registration in India\nis for <strong><em>10 years<\/em><\/strong> and thereafter it is required to be renewed from time\nto time. The applicant can apply for trademark registration with the Registrar\nof Trademarks Office. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Patents_Act_1970\"><\/span>Patents Act,\n1970<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A patent is an intellectual property right\ngranted to the inventor to use and commercially exploit his\/ her invention.\nThis exclusive right is granted by the concerned government office for his\nnovel technical invention. The Patent Act, 1970 lays down all the necessary\nprovision related to the grant, ownership, exploitation, revocation, term etc\nof patents. <\/p>\n\n\n\n<p>The term invention means any solution to a\nproblem in terms of development of a process or a product. Patents are\nconsidered the most valuable among the different types of IPR. <\/p>\n\n\n\n<p>In order to patent any invention, the\nfollowing criterion is required to be fulfilled: &#8211; <\/p>\n\n\n\n<ul><li><strong>Usefulness: <\/strong>The invention must be applied for practical\npurpose or must have industrial applicability. <\/li><li><strong>Non-Obviousness:<\/strong>Any invention\ndone by any an ordinary skilled person is obvious and cannot be patentable\nunder the Patents Act. Therefore, it is necessary that the invention must not\nbe obvious for patentability. <\/li><li><strong>Novelty: <\/strong>An invention must be a new technology which has not been published\nearlier or available in prior art of the country or anywhere in the world\nbefore the date of fling a patent. <\/li><\/ul>\n\n\n\n<p>The term of patent in India is <strong><em>20\nyears<\/em><\/strong> from the date of filing the patent application. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Copyright_Act_1957\"><\/span>Copyright Act,\n1957<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Copyright protect the ideas of authors,\ncreators and artists of an original work. That is, the Copyright Act, 1957\ncovers the creative aspects of intellectual property. The development of the\nsociety and country depends upon the creativity of the people. Copyright law\nencourages such type of activities. Copyright law protects the expression of\nidea of author but not the idea as such. It protects the rights of the creator\nof the original work by prohibiting the use of such work by any other person\nwithout the consent of the copyright holder. Copyright laws cover literary and\nscientific works, musical, artistic, computer programmes, photographic,\ncinematograph, dramatic, sound recordings, architectural works. <\/p>\n\n\n\n<p>The term for protection of <strong><a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\">copyright registration\nin India<\/a><\/strong> is for <strong><em>60 years<\/em><\/strong> for literary, musical,\ndramatic and artistic works after the death of the creator. And in cases of\nsound recording and film term is <strong><em>60 years<\/em><\/strong> from the beginning of\ncalendar year next following year in which it is published or released. Besides\nthese, the author gets the moral, economic and statutory rights under the\nCopyright Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Designs_Act_2000\"><\/span>Designs Act,\n2000<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The creative activity of achieving an\nornamental or aesthetic appearance of mass products produced or articles is\ncovered under the industrial designs. The Designs Act, 2000 was implemented to\nbring growth and development in industrial designs. If protects and safeguards\nthe artistic aspect that is, the designs of industrial products. The design can\nbe expressed as either two dimensional or three dimensional forms.<\/p>\n\n\n\n<p>Designs refer to shape, pattern,\nconfiguration, ornament, lines, colour, and surface etc appearance related\nfeatures of industrial products. The duration of protection of industrial\ndesign is for <strong><em>10 years<\/em><\/strong> in India and can be extended further for <strong><em>5\nyears<\/em><\/strong>.<\/p>\n\n\n\n<p>Besides these, some other intellectual property\nlaws enforced in India includes:<\/p>\n\n\n\n<ul><li>Semiconductor Integrated Circuit Layout Design\nAct, 2000.<\/li><li>Geographical\nIndications of Goods (Registration &amp; Protection) Act, 1999.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Landmark_Judgments_on_IPR_Law\"><\/span>What are the\nLandmark Judgments on IPR Law? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With the implementation of these\nlegislations, there have been number of disputes in intellectual property\nrights law that came before the courts. Over the years, the courts have been\nadjudicating countless intellectual property rights disputes as people are now\nmuch aware of the legal rights they possess in case of any infringement occurs\nfor their protected work and seek legal relief for such damages and\ncompensation against such infringement. Some of the landmark judgments on IPR law\nin India are as follows: &#8211; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bajaj_Auto_vs_TVS_Motor_Company_Limited_JT_2009_12_SC_103\"><\/span>Bajaj Auto vs.\nTVS Motor Company Limited JT 2009 (12) SC 103 <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Apex Court, by this landmark judgment\ndirected all the courts in India for speedy trial and disposal of the intellectual\nproperty related cases. In this present case, a patent dispute subsisted for\nover two years between two companies involved in a dispute for using twin spark\nplug engine technology.<\/p>\n\n\n\n<p>Noticing the pendency of appeals related to\nthe intellectual property rights cases in Indian Courts, J. Maekandey Katju and\nJ. Ashok Kumar Ganguly directed all the Indian Courts for speedy trial and\ndisposal of suits relating to matters of trademarks, patent and copyrights. The\nApex court directed that the judgments must be given within four months from\nthe date of the institution of such suits and further stated that all the\ncourts and tribunals in the country must carry out the aforesaid orders\nfaithfully and punctually. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bayer_Corporation_vs_Union_of_India_1622009_DLT_371\"><\/span>Bayer\nCorporation vs. Union of India 162(2009) DLT 371<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this present case, Bayer Corporation\nattempted to link the case of patent infringement to granting marketing\napproval of a drug made by Cipla. It filed an inventive writ petition in\nHon\u2019ble High Court of Delhi that since the applications of Cipla \u201cSORANIB\u201d\ninfringed its patent, its marketing approval application under the Drugs act\nshould be entertained or processed. This was the first time that an attempt to\nlink drug approval to patent infringement was made in India. <\/p>\n\n\n\n<p>The Hon\u2019ble High Court of Delhi stated that\nthere is not Drug Patent Linkage mechanism in India and the determination of\npatent standards can only be done by the Controller of patent having the\nauthority. <\/p>\n\n\n\n<p>It was held that mere market approval of\ndrug does not result in patent infringement and the jurisdiction of it does not\nlie with the Drug authorities. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Novartis_vs_Union_of_India_Civil_Appeal_No_2706-2716_of_2013_arising_out_of_SLP_C_NO_20539-_20549_of_2009\"><\/span>Novartis vs.\nUnion of India (Civil Appeal No. 2706-2716 of 2013 arising out of SLP (C) NO.\n20539- 20549 of 2009) <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this present case, an application was\nfiled by Novartis to patent one of its drugs called \u201cGleevec\u201d by covering it\nunder Section 3 of Patents Act, 1970 as invention. The application was rejected\nby Apex Court on the grounds that Novartis failed to meet the requirement of\nnovelty. That there was no invention of a new drug, as the mere discovery of an\nalready existing drug is not an invention. Also, thereby failing to qualify\ntest of invention as given under section 2(1) (j) and 2(1_ (ja) of the Patents\nAct as a result of various disclosures and publications already made about the\n\u201cBeta Crystalline\u201d form of compound used in the drug, Imatinib Mesylate.\nFurther the Apex Court interpreted efficacy as laid down in section 3(d) of the\nAct on lines of therapeutic efficacy and not merely physical efficacy and Novartis\nfailed to meet the requirements under section 3(d) of the Act. <\/p>\n\n\n\n<p>The Supreme Court preferred the therapeutic\nefficacy interpretation over physical efficacy on the fact that the compound\nwas of medical value. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Coca-_Cola_Company_vs_Bisleri_International_Pvt_Ltd_Manu_De_2698_2009\"><\/span>Coca- Cola\nCompany vs. Bisleri International Pvt. Ltd Manu\/ De\/ 2698\/ 2009<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this present case, the Hon\u2019ble High Court\nof Delhi held that if threat of infringement exists, then this court would have\nthe jurisdiction. And stated that exporting of goods from a country shall be\nconsidered as sale within the country from where export of goods has been taken\nplace and the same would amount to infringement of Trademark. <\/p>\n\n\n\n<p>The defendant Bisleri Ltd. had sell the\ntrademark MAAZA including its know- how, Intellectual property rights,\nformulation rights and goodwill through a master agreement. It applied for\nregistration of TM MAAZA in Turkey and imported fruit drinks under the same\nname. The Court held that the intention of using the trademark besides indirect\nor direct use of the trademark was enough and sufficient to give jurisdiction\nto the court to decide this issue. The Hon\u2019ble High Court granted an interim\ninjunction against the defendant (Bisleri). <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Yahoo_Inc_vs_Akash_Arora_Anr_78_1999_DLT_285\"><\/span>Yahoo!, Inc. vs.\nAkash Arora &amp; Anr. 78 (1999) DLT 285<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this present case, the plaintiff was the\nowner of the Trademark \u201cYahoo!\u201d and domain name \u201cYahoo.Com\u201d.
