The provisions relating the\nexclusive marketing rights were repealed and a provision for enabling grant of\nmandatory license was introduced. The patent system in India is controlled and\nadministered by the Controller General of Patents, Trademarks, Designs and\nGeographical indications. Each office has its own territorial jurisdiction for\nreceiving applications of patent and is empowered to deal with it in accordance\nwith the sections of patent act. <\/p>\n\n\n\n<p>Patent is a legal document that is granted by the government depending on the national rules and gives the inventor or creator of the invention the exclusive rights to use, make and sell the creation for a specified period of time. The product that is produced by the process\nis also protected under the patent laws. And in case of patents relating to the\nproducts, the act provides the exclusive right to the creator or inventor to\nprevent the unauthorized persons from using, making or offering for sale,\nimporting or selling the product in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_Inventions_under_Patent_Law\"><\/span>What are Inventions under Patent Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>Section\n2(1) (j)<\/em><\/strong> of the Patent Act, 2005 defines \u201cinvention\u201d as a new process\nor product involving an inventive step and capable of industrial application.\nFurther, according to <strong><em>Section 2(1) (l)<\/em><\/strong> of the act, \u201cnew\ninvention\u201d means any invention or technology which has not been foreseen by\npublication in any document or been used in the country or any part of the\nworld before the date of filing the application for patent with the complete\nspecification, that is, the subject matter has not come in public domain does\nnot form part of the state of the art. <\/p>\n\n\n\n<p>Therefore, in\naccordance with the definition of the new invention, the act states about the absolute\nor complete novelty, that is, such invention should not have been used or\npublished in any part of the world. That is, the invention must be new and there\nshould not be any existential trace of it or should never have been in the\npublic domain. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Inventive_Step_or_Non_Obviousness\"><\/span>Inventive Step\nor Non Obviousness<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The invention\nmust not be obvious to a person skilled in the same field as the invention\nrelated to. It must be inventive and non- obvious to a person skilled in the\nsame field. The invention must be unique in itself. Any improvement done by an\nindividual in the current technology cannot be patented. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Capable_of_Industrial_Application\"><\/span>Capable of\nIndustrial Application<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>And invention\nmust be capable of industrial application. That is, an invention cannot exist\nin abstract. It must be capable of being applied in any industry and must have\npractical utility in order to be patentable. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Useful\"><\/span>Useful <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The invention\nmust be useful. It should add value to the common man\u2019s life and should not\nbenefit or support the use of illegal things or any immoral purposes. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Disclosure_of_an_Enabling_Patent\"><\/span>Disclosure of an Enabling Patent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It means a\npatent draft specification must disclose the invention properly and\nsufficiently, so as to enable a person skilled in the same field as the\ninvention related to, to carry out the invention without any undue efforts. If\nno disclosure of enabling patent is made under patent specification, then a\npatent will most definitely not be granted. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_File_a_Patent_Application\"><\/span>Who can File a Patent Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to <strong><em>section\n6<\/em><\/strong> of the patents act, an application for a patent can be filed by any\nof the following persons either alone or jointly with any other person: &#8211; <\/p>\n\n\n\n<ul><li>Any person claiming to be the true or first\ninventor of an invention. <\/li><li>Any person being the legal assignee of the\nperson claiming to be the true of first inventor in respect to the rights to\nmake such application. <\/li><li>By the legal representative of deceased person\nwho immediately before his death was entitled to make such application. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Manner_in_which_the_Application_for_Patent_to_be_Submitted\"><\/span>Manner in which the Application for Patent to be Submitted <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to <strong><em>Section\n7<\/em><\/strong> of the Patents act, every application for patent shall be for the one\ninvention only.
