The initial step of registration is the trademark search,\nand after that, you can apply for trademark registration. Trademark Search\nensures that there is no related or matching or similar trademark exists or\nalready registered. According to Section 18 of the Act, the applicant for\nregistration can be made in definite form.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_for_Trademark\"><\/span>Application for Trademark<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Once the trademark search is done, then the applicant can file the application for trademarks for different categories of goods and services. For drafting an application, documents collection and registration filing will take around <strong><em>2 to 3 working days<\/em><\/strong>. After that, the Registrar publishes the trademark application in\nthe trademark journal within <strong><em>6 months for acceptance<\/em><\/strong>. Once the\napplication is published in the trademark journal, the same can be objected or\nopposed by the other person if they find similar marks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Objection\"><\/span>Trademark Objection<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In\nthe trademark registration process, an advertisement is made so that the public\nhas a chance to raise any trademark objection against pending trademark\napplication. But the opponents get a fair chance to defend their trademark\nagainst pending marks that may be identical to others.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Inspection_Report\"><\/span>Inspection Report<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In\nthis step, the Ministry inspect the logo or name applied under different\nsections of the Act. Therefore, the Ministry issued an inspection report either\naccepting or objecting the trademark. If there is no trademark objection, the\ntrademark will be allowed to advertise. Otherwise, the trademark application is\ninspected by the Trade Marks Office, and it will take <strong><em>around 2 to 4 month time<\/em><\/strong>\nfrom the date of filing of objections raised. Also, these trademark objections\ncan be raised on:<\/p>\n\n\n\n<ul><li><strong>Absolute\nGrounds:<\/strong> Uniqueness, devoid of unique name or logo, not\ncapable of distinguishing goods or services, and so on.<\/li><li><strong>Relative\nGrounds:<\/strong> In case the trademark is similar with any\nalready registered trademark on the Trademark Register.<\/li><\/ul>\n\n\n\n<p>Once\nthe inspection report has issued, the applicant should file a response within 1\nmonth from a receipt of an inspection report failing which an application is\nconsidered to have been abandoned by the applicant. If the response filed by\nthe applicant influences the Trademarks Office, an application is advertised\nfurther in the Trademark Journal. On the other hand, if an inspector or an\nexaminer has further objections, the hearing will be offered to the applicant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Journal_Publication\"><\/span>Trademark Journal Publication<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\na trademark registration is not opposed within <strong><em>4 months <\/em><\/strong>advertisement\ndate in the trademark journal, then the application for the trademark must be\ncontinued for registration. Any third party can raise trademark opposition\nagainst the registration within <strong><em>4 months <\/em><\/strong>of trademark publication in\nthe journal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Opposition\"><\/span>Trademark Opposition<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Any\nindividual can oppose the application for trademark registration by submitting\na written notice and paying suggested fees within <strong><em>4 months <\/em><\/strong>from the\napplication&#8217;s advertisement date to the Registrar. If any individual opposes\nthe trademark application, then the Registrar serves the same to an applicant\nof the opposed mark within <strong><em>2 months<\/em><\/strong>. If no opposition is made,\nthen the trademark application will be continued for registration.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Counter-Statement\"><\/span>Counter-Statement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nan applicant receives any trademark opposition within <strong><em>4 months, <\/em><\/strong>they have to\nfile a reply within <strong><em>2 months<\/em><\/strong> from the receipt of notice of trademark opposition. If\na reply against the opposition is not filed, then a ministry will unrestricted\nthe trademark. The opponent will get another chance to file a reply against an\napplicant, and they will also get 2 months to file second counter statement.\nHence, within <strong><em>2 months<\/em><\/strong> of such notice by an applicant, a counter-statement\nmust be filed to the Registrar.&nbsp; The\ncounter-statement is also functioned to an opponent by the Registrar as well.\nDepend upon the counter statements and oppositions, and the Registrar will\ndecide whether the application for trademark registration is to be accepted or\nnot. Both the parties have a right to call against any decision made by\nRegistrar. An appeal or petition can be filed before the IPAB (Intellectual\nProperty Appellate Board).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Hearing\"><\/span>Hearing<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This\nis the last stage of the opposition, where both parties debate and put their\nforth statements. After hearing both parties, the officer will pass necessary\norder. If an order goes into the favour of an applicant, then the trademark\nwill get registered; otherwise, it will get unrestricted by the officer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Registration\"><\/span>Trademark Registration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Following\nare some conditions where an applicant will receive the trademark certificate:<\/p>\n\n\n\n<ul><li><strong>In\ncase of Opposition:<\/strong><em>\n<\/em>When an officer pass the hearing order in favour\nof an applicant.<\/li><li><strong>If\nno Opposition is raised:<\/strong> After the accomplishment of 4\nmonths of trademark publishing in the journal.<\/li><\/ul>\n\n\n\n<p>In\nboth the conditions mentioned above, an applicant shall be approved with the\nregistration certificate that ends the timeline for trademark registration\nprocess. After receiving a registration certificate, the applicant can use the\n\u00ae symbol with its brand logo or name.&nbsp;\nThe applicant can also download the trademark registration certificate\nfrom the official portal by entering the application number.<\/p>\n\n\n\n<p>The\nRegistrar accepted the trademark, and in the end, the entry is made in the\ntrademark register. The complete timeline for trademark registration process\nmust not exceed <strong><em>12 months<\/em><\/strong> from the date of trademark application, and after\nevery 10 years, you have to renew the trademark.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A trademark application can go through a timeline for trademark registration process. However, if the brand name is distinctive and not similar to other registered trademarks, one can get the registration certificate in 6 to 8 months.
