In laymen sense, it is a way of granting\nexclusive rights for a certain period of time to the inventor.&nbsp; <\/p>\n\n\n\n<p>Further, the term right includes the authorities as\nfollows:<\/p>\n\n\n\n<ul><li>Power to Sell;<\/li><li>Power to Use;<\/li><li>Power regarding\nthe Import of Product;<\/li><li>Power to\nRestrict other from using the product without permission;<\/li><li>Power to\nProcess, etc.;<\/li><\/ul>\n\n\n\n<p>&nbsp;Also, it\nshall be relevant to state that an inventor must consider the factors listed to\nobtain <strong><a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\">Patent Registration in\nIndia<\/a><\/strong>:<\/p>\n\n\n\n<ul><li>Novelty;<\/li><li>Non Obviousness;<\/li><li>Industrial\nApplicability;<\/li><\/ul>\n\n\n\n<p>Also, in India, a Patent Registration remains valid for a period of 10 years, starting from the date of grant of Patent Registration.<\/p>\n\n\n\n<p><strong>Also, Read:<\/strong> <mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/swaritadvisors.com\/blog\/patent-law-in-india\/\">Everything You Must Know About Patent Law in India<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Provisions_of_Draft_Patents_Amendment_Rules_2021\"><\/span>Key Provisions of Draft Patents (Amendment) Rules 2021<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The key provisions of the Draft Patents (Amendment)\nRules 2021 are as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_of_Rule_2_ca\"><\/span>Insertion of Rule 2 (ca)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>By way of the Draft Patents (Amendment) Rules 2021, the government has decided to insert the term Eligible <a href=\"https:\/\/en.wikipedia.org\/wiki\/Educational_institution\">Educational Institution<\/a> under Rule 2 (ca). The term Eligible Education Institution means an institution constituted by the Central, State, or Provincial Act, which has been controlled or owned by the Government. Also, these institutions are wholly or substantially financed by government.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_of_Second_Proviso_in_Rule_7_1\"><\/span>Insertion of Second Proviso in Rule 7 (1)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In Rule 7 (1), the second proviso inserted, states\nthat in the case of a small entity, eligible institution, start up, every\ndocument furnished for which a fee has been prescribed needs to be accompanied\nwith Form 28.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_24_C\"><\/span>Substitution in Rule 24 C<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Based on the changes made in the Drafts Patent\n(Amendment) Rule 2021, Clause k of Sub Rule (1) of Rule 24 C will be\nsubstituted with \u201cthat the said applicant is an eligible educational\ninstitution\u201d. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_of_Rule_7_3\"><\/span>Substitution of Rule 7 (3)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nin case an application is processed by a natural person, small entity,\nstart-up, or by any eligible educational institution, and the same is fully or\npartly transferred in favour of an individual other than a natural person,\nsmall organisation, start-up, or eligible educational institution, then, in\nthat case, the difference, if in case any, in the scale of fees amongst the\nfees that has been charged from the natural person, start-up, eligible\neducational institution, or small organization and the fees charged from any\nindividual other than a natural person, will be paid by way of the new\napplicant, together with the request for such transfer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_of_First_Schedule\"><\/span>Substitution of First Schedule<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Based on the provisions of the Drafts Patents\n(Amendment) Rules 2021, the existing principal rules, for Table I of the first\nschedule, will be substituted with the new one as provided in the amended\nregulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In\na nutshell, the Ministry of Commerce and Industry has passed notification\nconcerning the Drafts Patent (Amendment) Rule 2021.
