A copyright owner is entitles to get following rights:<\/p>\n\n\n\n<ul><li>Publish the work.<\/li><li>Produce work in the public. <\/li><li>Perform work in public.<\/li><li>Translate the work. <\/li><li>Make any record or cinematograph film of the\nwork. <\/li><li>Broadcasting of work. <\/li><li>Making adaptation of the work. <\/li><li>Making copies of work and distributing it. <\/li><li>Making derivatives of the work. <\/li><li>Preventing others from making unauthorized use\nof copyrighted work. <\/li><\/ul>\n\n\n\n<p>The term of <strong><a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\">copyright<\/a><\/strong> in case of musical, literary, artistic or dramatic work is the lifetime of the author while for posthumous publication, cinematograph films, record etc; the term is 60 years from the date of the publication. Infringement is occurred when a person intentionally or\nunintentionally uses or copies the owners work without credit. In many cases, the application filed for\ninterlocutory relief rarely goes beyond the interlocutory stage. Three\nrequirements are to be fulfilled to grant interlocutory injunction, that is,\nfirstly there must be a prima facie case. Secondly there is a need of balance\nof convenience ad lastly, there must exist an irreparable injunction. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pecuniary_Remedies\"><\/span>Pecuniary\nRemedies<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Three pecuniary remedies can be availed by the copyright owners under Section 55 and 58 of the Copyright Act, 1957.<\/p>\n\n\n\n<ul><li> <strong><em>Firstly<\/em><\/strong>, an account of profits that allows the owner to seek the sum of money made equal to the profit made through the unlawful conduct.<\/li><li><strong><em>Secondly<\/em><\/strong>, compensatory damages which allows the copyright owner to seek the damages he suffered because of the infringement. <\/li><li><strong><em>Thirdly<\/em><\/strong>, conversion damages which are evaluated according to the value of the article. <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Anton_Pillar_Orders\"><\/span>Anton Pillar\nOrders<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>This remedy gets its name from the holding in Anton Pillar AG vs. Manufacturing Processes. The <a href=\"https:\/\/en.wikipedia.org\/wiki\/Anton_Piller_order\">Anton Pillar Order<\/a> mentions the following elements:<\/p>\n\n\n\n<ul><li><strong><em>Firstly<\/em><\/strong>, an injunction restraining the defendant from infringing or destroying the goods.<\/li><li><strong><em>Secondly<\/em><\/strong>, an order allowing the layer of the plaintiff to search the premises of the defendant and take goods in their safe custody.<\/li><li><strong><em>Thirdly<\/em><\/strong>, an order that the defendant must be directed to disclose the names and addresses of the consumers and suppliers.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mareva_Injunction\"><\/span>Mareva\nInjunction<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>This remedy comes into play when the court believes that the defendant is probably trying to delay or obstruct the execution of any decree that is being passed against him. Thereby, the court has the power to direct the defendant to place any part or whole of his property under the court\u2019s disposal as may be sufficient to satisfy the decree. This is provided in Order <strong>XXXVIII, Rule 5 of the Civil Procedure Code, 10908<\/strong>. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Norwich_Pharmacal_Order\"><\/span>Norwich\nPharmacal Order<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>This order is\nusually passed when some information is required to be discovered from the\nthird party.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Criminal_Remedies_for_Copyright_Infringement\"><\/span>Criminal\nRemedies for Copyright Infringement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The following\ncriminal remedies are provided for infringement under the Copyright Act, 1957:<\/p>\n\n\n\n<ul><li>Imprisonment that is up to 3 years but not less\nthan 6 months.<\/li><li>Fine that may not be less than 50,000 but may\nextend up to 2, 00,000. <\/li><li>Search and seizure of infringed goods. <\/li><li>Delivery of infringed goods to the original\ncopyright owner. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The copyright laws are important for the development of the society as creativity is an important essence for growth.
