In India, <strong><a href=\"https:\/\/swaritadvisors.com\/society-registration\" class=\"text-primary\">Society Registration<\/a><\/strong>\ncan be done under the Societies Registration Act, and after the registration,\nit is mandatory to file all the compliances under Societies Registration Act,\n1860.<\/p>\n\n\n\n<p>After\nintroducing <strong><em>CSR or Corporate Social Responsibility<\/em><\/strong> provisions in Companies\nAct, 2013 and the number of societies wanting to get registration has increased\nwith great speed. The societies planning\nto seek registration are instructed to consult this Act also before proposing\nthe name for Society Registration.<\/li><li>If the suggested name is\nidentical by which any other society has been registered or look like such name\nwhich is likely to deceive the member of a society or the public, such name may\nbe avoided.<\/li><li>The MOA (Memorandum of\nAssociation) must contain the following details or information:<\/li><\/ul>\n\n\n\n<ol><li>Society\u2019s Name.<\/li><li>Society\u2019s Objects.<\/li><li>The names\/professions\/addresses\nof the governors, directors, council, committee, or other governing body to\nwhom by the guidelines of the Society and the management of Society&#8217;s affairs\nis entrusted.<\/li><\/ol>\n\n\n\n<ul><li>A copy of the Society&#8217;s Rules\nand Regulations, certified to be a precise copy by not less than 3 members of\nthe governing body and it must be filed with the MOA (Memorandum of\nAssociation).<\/li><li>All the signatures of the keen\npersons or subscribers given in the MOA must be witnesses by an Oath\nCommissioner, Advocate or Gazette Officer, Notary Public or Magistrate 1<sup>st<\/sup>\nClass with their original rubber stamps and complete in all respect.<\/li><li>Always remember that the member\nof the Governing Body cannot be outside the list of the keen subscribers or\npersons to the Memorandum.<\/li><li>All the Society&#8217;s Rules and\nRegulations must be filed along with the MOA with registering.<\/li><li>If all the rules and\nregulations of the Society are unreliable with the provisions of the Societies\nRegistration Act, 1860 and they are not valid and simple filing with\nregistering authority for the purpose of Society registration cannot make them\nvalid.<\/li><li>Affidavit of Rs. 10\/-\nNon-Judicial Stamp Paper from the Society\u2019s Secretary\/President must be\nequipped regarding the relationship between the subscribers to the Memorandum\nand an affidavit that the Society&#8217;s name will be transformed if the proposed\nname already found registered in our records.<\/li><li>Rs. 50\/- registration fee will\nbe demanded when the formalities are complete, and the Registrar of the\nSocieties will approve the grant of registration.<\/li><li>Election Card or Ration Card or\nany other ID proofs of all the proposed persons are required.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Mandatory_Post-Registration_Compliances_under_Societies_Registration_Act_1882\"><\/span>What are the Mandatory Post-Registration Compliances under\nSocieties Registration Act, 1882?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A\nmost common problem has been noticed after the Society Registration is that\nthey do not follow the Mandatory Post-Registration Compliances under Societies\nRegistration Act, 1882, which may attract penalty to Society and its members\nalong with Society Registration may be liable to cancellation. Every Society in\nIndia has to work within the context, as mentioned in the Memorandum of\nAssociation and Rules &amp; Regulations as described at the time of\nregistration.
