idea of the creator, author and artist which is related to the\nmass communication. The copyright law protects only form of expression of idea\nand not the idea as such. The growth and development of the society or the\ncountry is based upon the creativity and skills or its people. There such\nactivities are encourages under the copyright law. The purpose of copyright is\nto reward and secure the general benefits that is, the labor of the authors on\nthe work produced by them. It encourages the creators, artists or authors to\nproduce with more work on regular basis. <\/p>\n\n\n\n<p>it shall be noted that a copyright remains valid for a period of 60\nyears in India for the dramatic, literary, artistic and musical works after the\ndeath of the author or creator. And in the case of the sound recording and\ncinematograph films the term is 60 years, starting from the commencement of the\ncalendar year next following year in which it is released or published. Besides\nthis, the authors are also given the statutory, economic and moral rights under\nthe copyright law once the copyright registration is done.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_is_there_a_need_for_protect_under_copyright_law\"><\/span>Why is there a\nneed for protect under copyright law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The copyright protection creates an atmosphere conducive to the creativity. <\/li><li>It encourages and induces to create more and motivates the other people to create since it recognizes the work. <\/li><li>Work that is created by a particular person cannot be claimed for ownership by someone else over many years. <\/li><li>It provides many legal rights and benefits to the creator or author of the original work once the copyright is registered under the copyright act. <\/li><li>It provides recognition of the original work of the author or creator.<\/li><\/ul>\n\n\n\n<p><strong>Also, Read:<\/strong> <mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/swaritadvisors.com\/blog\/legal-actions-taken-against-copyright-infringement\/\">What are the Legal Actions Taken Against Copyright Infringement?<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prerequisites_to_get_protection_under_the_copyright_law\"><\/span>Prerequisites\nto get protection under the copyright law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In order to get the protection under the copyright law, it is\nnecessary that the work should possess the following:<\/p>\n\n\n\n<ul><li>It must be an original work-\nthe original work means that such work is created from the inspiration and is\nnot copied from any other already existing work. It is important that the work\nis created for the first time. <\/li><li>The work must be fixed in\ntangible form- the work must be presented or expressed in a physical form and\nit should be capable of being recognized in a fixed form that is in its\nexistence or tangible form such as on documents, paper, recording on optical\nmedia, paintings, web servers and etc. <\/li><li>The work must be a first\npublication- the work that is original must not be published before. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Work_in_which_copyright_subsists_matters_which_are_copyrightable_Section_13\"><\/span>Work in which copyright subsists\/ matters which are copyrightable Section 13 <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the matters which are copyrightable: &#8211; <\/p>\n\n\n\n<ul><li>According to the section 13 of the Copyright Act, the copyright shall subsist in the following classes of work throughout India, such as:<\/li><\/ul>\n\n\n\n<ol><li>original Dramatic, Artistic, Literary, musical works<\/li><li>Sound recording<\/li><li>Cinematograph films<\/li><\/ol>\n\n\n\n<p><strong>Examples:<\/strong><\/p>\n\n\n\n<ul><li>Literary works includes poems,\nnovels, film scripts, scientific articles. <\/li><li>Artistic work included\ncartoons, maps, paintings, drawing sculpture, design, photographs<\/li><li>Choreographic works such as\ndance or ballet<\/li><li>Musical work such as musical\npieces with or without words. <\/li><li>Cinematograph work such as\nfilms, video games, television shows<\/li><\/ul>\n\n\n\n<p>The word original is not clearly defined under the copyright act but\nit is largely understood as work that \u201cowes its origin to the author\u201d. It is\nnecessary that the work must originate from the labour and skills of the author\nand must not be copied from any other work. Also the word \u201coriginal\u201d is\nprefixed to the literary, musical, dramatic and artistic works and not to the\nsound recordings and cinematograph films as the latter are the works that are\nmade by using the former categories of works. <\/p>\n\n\n\n<p><strong>For example:<\/strong> Cinematograph film is made by using a script which a form of a\nliterary work. Even though there is no expression stipulated regarding the\n&#8220;originality&#8221; concerning the sound recordings, and cinematograph\nfilms, copyright does not subsist in a cinematograph film if the substantial\npart of that film is an infringement of copyright in any other work.<\/p>\n\n\n\n<p>Copyright does not exist in a sound recording made in respect of\ndramatic, musical, literary work, if in sound recording the copyright of such\nwork is infringed.<\/p>\n\n\n\n<p>According to Article 9(2) of the TRIPS and Article 2 of WCT, 1996 is\nthat copyright does not subsist in ideas and it only protects original\nexpression of the ideas. That is, the copyright protection is available for works\nwhich are in tangible form.<\/p>\n\n\n\n<ul><li>The copyright shall not in in\nof the work stated in sub- section (1) other than the work to which the\nprovisions of section 40 or 41 shall apply, unless:<\/li><\/ul>\n\n\n\n<ol><li>In case of published work,\nwhere it is first published in India, or where it is first published outside\nIndia, the author is at the date of such publication or in case of the death of\nthe author at that date, was a citizen of India. <\/li><li>In case of unpublished work,\nother than architectural work, the author at the time or date of the making of\nthe work a citizen of India or domiciled in India. <\/li><li>In case of architectural work,\nsuch work is located in India<\/li><\/ol>\n\n\n\n<p><strong>Explanation:<\/strong> In case of joint authorship work, the conditions conferring\ncopyright stated in this sub- section shall be satisfied by all authors of the\nwork. <\/p>\n\n\n\n<ul><li>Copyright shall not subsist in:<\/li><\/ul>\n\n\n\n<ol><li>Any cinematograph film if the\nsubstantial part of the film is a copyright infringement in other work. <\/li><li>Any sound recording made in\nregard to the dramatic, literary or musical work if when making the sound\nrecording the copyright work is infringed. <\/li><li>The copyright in sound\nrecording or in cinematograph film shall not affect the separate copyright in\nwork in respect of which or the substantial part of which the film or in any\nother case the sound recording is made. <\/li><li>In the case of architectural\nwork, the copyright shall subsist only in the design and artistic work and will\nnot extend to method or processes of construction. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Defining_Copyright-_Section_14\"><\/span>Defining\nCopyright- Section 14 <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under the Copyright Act, 1957 copyright means the exclusive right\nsubjected to the provisions of the act, to do or authorize to do any of the\nbelow mentioned acts in respect of a work or any substantial part thereof, such\nas: &#8211; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_case_of_dramatic_literary_or_musical_work_not_being_a_computer_programme\"><\/span>In case of dramatic, literary or musical work not being a\ncomputer programme<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>To reproduce work in any\nmaterial form which also includes storing it in any manner, be it any medium by\nelectronic means;<\/li><li>Issuing copies of work to the\npublic but not being the copies that are already in circulation;<\/li><li>To perform or communicate the\nwork in public;<\/li><li>To make any work which is a\ncinematograph film or a sound recording;<\/li><li>Making any translation of the\nwork; <\/li><li>Making any adaptation of the\nwork; <\/li><li>To do any act specified or\nstated in relation to the work in sub- clause (i) to (vi) which is related to\nthe translation or adaptation of work.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_case_of_computer_programme\"><\/span>In case of computer programme<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>To do any of the acts which are\nstated in clause (a) <\/li><li>To give or sell on commercial\nrental or offer for sale any copy of the computer programme<\/li><\/ul>\n\n\n\n<p>Provides that such commercial rental does not apply in computer\nprogramme where the programme is not an essential object of rental.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_case_of_an_artistic_work\"><\/span>In case of an artistic work<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li> To reproduce such work in any material form that includes:<\/li><\/ul>\n\n\n\n<ol><li>To store it in any form or medium by electronic or other means.<\/li><li>Depicting in three- or two- dimensional work.<\/li><li>Depicting in two- or \u2013 three- dimensional work. <\/li><\/ol>\n\n\n\n<ul><li>Communicating the work in public.<\/li><li>To issue the copies of the work in order to provide it to the public, but not being the copies that are already being circulated<\/li><li>Including work in any cinematograph film <\/li><li>Making adaptation of work <\/li><li>In relation to the adaptation of work, doing any act specified in relation to the work in sub clauses (i) to (iv) <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_the_case_of_cinematograph_film\"><\/span>In the case of cinematograph film <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>Making a copy of the film that\nincludes:<\/li><li>A photograph of any image\nforming the part thereof; <\/li><li>Storing it in any form or\nmedium by electronic or other means <\/li><li>To give or sell on commercial\nrental or offer for sale or for rental any copy of the film; <\/li><li>To communicate the film to the\npublic<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_the_case_of_sound_recording\"><\/span>In the case of sound recording <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>To make sound recording\nembodying it that is, storing it in any form or medium by electronic or other\nmeans; <\/li><li>To give or sell on commercial\nrental or offer for sale or such rental any of the sound recording;<\/li><li>Explanation: for the purpose of\nthis section, any copy which has been already sold shall be considered to be a\ncopy already in circulation. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Special_provision_regarding_copyright_in_designs_capable_of_being_registered_or_is_registered_under_the_Designs_Act_2000_%E2%80%93_Section_15\"><\/span>Special\nprovision regarding copyright in designs capable of being registered or is\nregistered under the Designs Act, 2000 \u2013 Section 15 <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The copyright of work shall not\nsubsist under the Copyright Act in any design which is registered under the\nDesigns Act, 2000. <\/li><li>The copyright of work in any\ndesign that is capable of being registered under the Designs Act, 2000 but that\nis not registered yet, shall cease as soon as any article to which the design\nhas been applied is reproduced more than 50 times by the industrial process by\nthe owner of the copyright or with license, by any other person. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Copyright_of_Work_not_allowed_except_as_provided_under_the_Act-_Section_16\"><\/span>Copyright of\nWork not allowed except as provided under the Act- Section 16 <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>No person is shall be entitled to copyright any work or any similar rights in the work whether unpublished or published, otherwise than under and in accordance with the provisions of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_Act\">Copyright Act<\/a>, or any other law for the time being in force. That is, matters which are copyrightable are only those as specified under the copyright act. however, nothing in this section shall be construed as abrogating any right or jurisdiction to restrain the confidence or breach of trust. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_Conclusion\"><\/span>&nbsp;Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The copyright of original work provides recognition and encourages the creator or author of the work to continue making more and more such work. The subject matters which are copyrightable includes artistic, literary, dramatic and musical work and also includes sound recording and cinematograph films which are protected under the section 13 of the act as stated above in the article.
