In some countries like the United States of America (USA), an assignment\nwithout Goodwill is not allowable, but in India, it is allowable. If there is a\nchance of creating confusion in the public minds with regard to the registered\ntrademark, the Trademark Act, 1999 puts certain restrictions on such\nassignments. It also defines that a trademark can be assigned in part with or without <a href=\"https:\/\/en.wikipedia.org\/wiki\/Goodwill\">Goodwill<\/a>. All the trademark assignments can be made on Form 23 or Form 24 of the trademark.<\/li><li><strong><em>Assignment of the Unregistered Trademark: <\/em><\/strong>Under Section 39 of the Trademark Act, 199 specifies that any unregistered trademark can be further transmitted or assigned with or without the Goodwill. One can make an appeal for the same under <strong><em>Form TM-16<\/em><\/strong>.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Trademark_Assignment_in_India\"><\/span>Procedure for Trademark Assignment in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nis the procedure for Trademark Assignment in India:<\/p>\n\n\n\n<ul><li>First, the application must file an application\nfor the Trademark Assignment, and the plan can be made by the assignee or\nassignor or both. Provide all the details of the transfer under Form TM-P.<\/li><li>Once you draft the application, then submit the\napplication to the&nbsp; Trademark Registrar.\nThe same must be done within six months of gaining ownership.<\/li><li>The Registrar&#8217;s direction is compulsory before\nthe expiry of six months in the case when Trademark Assignment is done with the\nGoodwill or of a registered mark.<\/li><li>Registrar will stipulate the advertisement of <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\">Trademark Registration<\/a><\/strong>.\nOnce the requirement is done, the applicant can create an advertisement\naccordingly.&nbsp; The applicant is required\nto submit an advertisement copy and direction of the Registrar in the office.<\/li><li>In the end, once the Registrar approves the\napplication and all the documents submitted, they will officially transfer the\ntrademark from the original owner to the future owner.<\/li><\/ul>\n\n\n\n<p><strong><em>Note: <\/em><\/strong>After\nthe procedure for Trademark Assignment, the name of the receiving owner is\nregistered as a new owner or proprietor. After this, the assignee is able to\nuse the registered trademark as per the agreement terms. Trademark Assignment\napplication can be made in <strong><em>Form-24<\/em><\/strong>.
