The Intellectual Property Law has control over tangible assets, just as the law safeguards the ownership rights of personal property.<\/p>\n\n\n\n<p>These\nrights are not dissimilar from other property rights. It helps the owner or\ninventor or creator to get benefit from the product, as the product was a first\nidea which is created or innovated by the owner. The Intellectual Property\nRights supports the owner or innovator to safeguard his or her innovation or\ncreation from using, copying, dealing or damaging by some unauthorized person\nwithout taking permission from the original owner of the invention. IP Law\nstops the illegal use of the innovation, and also, the unauthorized user has to\npay off for any damages caused. The primary objective\nof safeguarding the work is to prevent distribution, replication, or\nunauthorized copying of such works. Copyright Registration doesn\u2019t protect the\nidea, but it safeguards the expression of an idea. It is the easiest and\ncheapest form of Intellectual Property Right to get. The universal symbol use\nfor Copyright Protection is \u00a9, and it valid till the person is alive and for\nseventy years after the expiry of the copyright owner. Some Copyright\nProtections are automatically formed; however, it is advisable to obtain a\nCopyright Registration with the registering Copyright Authority in India. Any\nindividual violating the use of Copyright can be sued or fined for Copyright\nViolation. The regulation related to the Copyright Protection in India is the <strong><em>Copyright\nRules, 1958 and the Copyright Act, 1957<\/em><\/strong>.<\/p>\n\n\n\n<p><strong>Following are two different components of\nCopyright Protection:<\/strong><\/p>\n\n\n\n<ul><li><strong><em>Economic Rights: <\/em><\/strong>Economic\nRights give the owner control or regulate the usage of its innovation or\ncreation in any ways appropriate for the owner. The ways offered to the\noriginal owner are making copies, the performance of their work in public,\nbroadcasting, issuing copies of work to the public. Economic Rights also help\nin attaining an economic reward for the owner&#8217;s work.<\/li><li><strong><em>Moral Rights: <\/em><\/strong>These\nrights are not transferable, and the owner is given the right to be identified\nas the original or real owner of the work. The exclusive right to any\ndisfigurement or misrepresentation of work is also given to the owner of the\nwork.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark\"><\/span>Trademark<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It\u2019s a\nword, symbol, design, or phrase by which a company recognizes their products or\nservices and differentiates them from other products or services supplied or\nmanufactured by other opponents in the marketplace. The main objective of\nTrademark is to create a link in the customer\u2019s mind between different products\nor services that a company offers and then distinguish them from other\ncompany\u2019s products or services in the market.<\/p>\n\n\n\n<p>A\nTrademark includes any signs which are capable of being symbolized,\nparticularly words, graphically, including personal names, logos, numerals, or\nthe packaging &amp; shape of goods. The business owner must file an application\nfor Trademark Registration. <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\">Trademark registration<\/a><\/strong>\nenhances the owner\u2019s rights by offering legal evidence and the public of the\nproduct&#8217;s ownership. A Trademark is proof of the exclusive right of the\nTrademark\u2019s owner and hence, permits the trademark owner to sue the person\nviolating the Trademark use. The Trademark, which is completely registered with\nthe Trademark Registry, is certified to use the \u00ae symbol. A Trademark is valid\nfor ten years, and after that, the owner needs to renew it every ten years as\nsuggested in the Trademarks Act, 1999. Therefore, it can also be said that a Trademark\nworks as an origin&#8217;s symbol for a company, business, or brand in order to\nconnect that origin to common customers.<\/p>\n\n\n\n<p><strong>For Trademark Registration in\nIndia, the mark has to fulfil some conditions, and you can check the same\nbelow:<\/strong><\/p>\n\n\n\n<ul><li><strong><em>The mark should be unique and distinct from\nother registered marks<\/em><\/strong>: A suggested Trademark should not be\nsimilar or identical to any other registered trademark because it will reject\nyour application, so to avoid this, you need to do a Trademark Search before\napplying for Trademark Registration.<\/li><li><strong><em>A trademark should not be common<\/em><\/strong>: A\ntrademark that has a common description for a general class of products or\nservices, rather than the detailed meaning projected by the Trademark&#8217;s owner.\nA Trademark naturally becomes \u201cgeneral\u201d when the products or services with\nwhich the Trademark is associated have gotten significant mind share.<\/li><li><strong><em>The Trademark should not be descriptive<\/em><\/strong>: A\ndescriptive Trademark is a Trademark that clearly describes any quality,\nfeatures or aspect of the products or services for which they are used.<\/li><li><strong><em>The mark should not be misleading<\/em><\/strong>: The\nTrademark should not incorrectly describe the other similar products or\nservices in the market.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Patent\"><\/span>Patent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A\nPatent provides the owner with an exclusive right to stopother people from\nabusingthe invention of the inventor or owner mentioned in the Patent. It also\ngives the right to eliminate other people from using, making, selling, or\nimporting the patented invention of the owner.<\/p>\n\n\n\n<p>A\nPatent is granted for a particular field in a defined nation and only for a\nmaximum of twenty years. <strong><a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\">Patent Registration<\/a><\/strong>\nis only be granted if the invention\u2019s owner does the full revelation of the\ninvention and publication of the technical information of the invention. A\nPatent can safeguard an original invention for twenty years, and after that,\nyou need to renew the Patent. Therefore, a Patent includes a deal between\nSociety and Inventors.<\/p>\n\n\n\n<p>For inventors,\na Patent is the most essential to protect their invention from competitors.\nWhereas, for Society, a Patent holds on to the improvements of the innovation\nprocess by making a public confession of the invention. In return for such\npublic confession, investment is fortified by the delivery of individuality of\nrights and benefits derivative from such inventions.<\/p>\n\n\n\n<p>The\nregulation which deals with the Protection and Registration of Patent is the <strong><em>Patent\nAct, 1970, and the Patent Rules, 2003<\/em><\/strong>. The Patent Act, 1970, has experienced\nthree modifications in the years 1999, 2002, and 2005. In the year 2005, a\nmodification was introduced regarding the Patent Protection for food, pharma,\nand chemical inventions.<\/p>\n\n\n\n<p><strong>In India, to obtain Patent Registration, an\ninvention must fulfil some criteria, and you can check the same as follows:<\/strong><\/p>\n\n\n\n<ul><li><strong><em>New or Original: <\/em><\/strong>The\ninvention should be original and unique from other inventions and is unknown to\nthe public.<\/li><li><strong><em>Utility: <\/em><\/strong>The\ninvention is measured as useful and valuable.<\/li><li><strong><em>Non-obvious: <\/em><\/strong>The\noriginality of the invention should not be obvious to any who has some\nknowledge regarding the invention. It should be very different and non-familiar\nto the public.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Industrial_Design\"><\/span>Industrial Design<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It\nindicates the creation of a shape, combination of pattern, configuration, or\ncolour in 3-D forms of artistic value. In India, the Design Act only safeguards\ndesigns that are artistic in nature. An industrial design can be a 2-D or 3-D\npattern. Originality and uniqueness are two essential criteria for Design\nRegistration. The designs which are applied by an industrial procedure will\nonly be protected.<\/p>\n\n\n\n<p><strong>The Design Act, 2000 and The Design Rule, 2001 <\/strong>protect the Indian Law of Designs. The Industrial Design Registration grants the design owner the exclusive rights of selling, importing, and applying the design to any product. In India, <strong>the first-to-file system<\/strong> is accepted, and this system means that the original owner of the design should file an application for the registration at the initial point of time. The system helps to find out any possibility of any other individual claiming the rights of the proposed designs of the holder. In India, the validity of Design Registration is for ten years, and it is renewable for the next five years. Any individual can apply for the rights of designs.<\/p>\n\n\n\n<p><strong>Following are some conditions require for\nDesign Registration in India:<\/strong><\/p>\n\n\n\n<ul><li>The design should be original and new;<\/li><li>It should not contain any offensive material;<\/li><li>It should be different from other well-known\ndesigns.<\/li><li>It should not be published in other countries;<\/li><li>It should not be against any public orders;<\/li><li>It should be reproducible for any industrial\nmeans.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Geographical_Indications\"><\/span>Geographical Indications<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It\nstates to an indication that identifies a good as inventing in the territory of\na locality, member, or a region in the region, where the reputation, quality,\nor any other unique features of the good is vitally attributable of the\ngeographical origin of the good.<\/p>\n\n\n\n<p>In\nIndia, the Geographical Indications of Goods (<strong>Protection and Registration<\/strong>), Act 1999 and the Geographical\nIndication of Goods (Regulation and Protection) Rules, 2002control the <strong>Geographical\nIndications Registration process<\/strong>.
