Further, the said  Copyright rules will come into effect from the date of their publication in the Official Gazette.<\/p>\n\n\n\n<p>Also, it shall be noted that the Copyright Rules 2021 seek to make certain changes in the principal law, i.e., Copyright Rules 2013. Moreover, the circular of the amendment was passed under the ambit of the powers provided under section 78 of the Copyright Act 1957.<\/p>\n\n\n\n<p>In this learning article, we will discuss the Right (IPR), other than the Trademarks, Design, and Patent registered\nin India. Further, the provisions of section 14 of the Copyright Act 1957\ndefines the word Copyright. <\/p>\n\n\n\n<p>It shall be noted that the definition of copyright\ncomprises of various forms of rights that exist in different kinds of work,\nsuch as follows:<\/p>\n\n\n\n<ol><li>Literary Work, which\nincludes pamphlets, books, magazines, etc.;<\/li><li>Musical Work;<\/li><li>Dramatics;<\/li><li>Artistic Work, such\nas Photography;<\/li><li>Films;<\/li><li>Architectural Works;<\/li><\/ol>\n\n\n\n<p>Also, it shall be noted that the prime focus behind <a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\"><strong>copyright registration<\/strong><\/a> is to reward the creator for his\/ her creation by safeguarding it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Provisions_of_the_Copyright_Rules_2021\"><\/span>Key Provisions of the Copyright Rules 2021<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The key provisions of the Copyright Rules 2021 can be summarised as:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_2_Sub_rule_1\"><\/span>Substitution in Rule 2 Sub rule (1)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\namendments made in Rule 2 Sub rule (1) can be summarised as:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Clause_b\"><\/span>Clause b<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>It shall be noted that\nin clause (b) of sub rule (1), the words \u2018a Copyright Board as defined in\nsubsection (1) of\u2019 will be substituted with the words \u2018the Appellate Board as\nprovided in\u2019.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Clause_d\"><\/span><strong>Clause<\/strong> <strong>d<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>After the\nprovisions of clause (d), a new clause, namely (da) has been inserted, which\ndeals with the term \u2018journal\u2019, and defines the same as the\ncopyright Journal, which is made accessible at the official website of the\nCopyright Office. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Chapter_II\"><\/span>Substitution in Chapter II<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the principal rules,\nthe title of Chapter II, \u2018THE COPYRIGHT BOARD\u2019 will be substituted with the\ntitle \u2018THE APPELLATE BOARD\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_3\"><\/span>Substitution in Rule 3<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the provisions of Rule 3, the term appellate board means that the chairman and other board members will be appointed based on the provisions of the <strong>Trademarks Act 1999<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Indian_trademark_law\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>.<\/p>\n\n\n\n<p>However, it\nshall be noted that the Technical Member of the Appellate Board for all the\npurposes of the Act will have the qualifications as prescribed in the Tribunal,\nAppellate Tribunal, and other Authorities (Qualifications, Experience &amp;\nother Conditions of Service of Members) Rules 2020. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_7\"><\/span>Substitution in Rule 7<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\namendments made in Rule 7 can be summarised as:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_1\"><\/span>Sub rule (1)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In the\nprovision of sub rule (1), after the words \u2018the owner of the copyright\u2019, the\nwords \u2018through electronic means or\u2019 will be inserted.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_5\"><\/span>Sub rule (5)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In the provision of sub rule (5), the\nwords \u2018published in the journal\u2019 shall be substituted for the words \u2018notified\nin the Official Gazette\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_11\"><\/span>Substitution in Rule 11<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\namendments made of sub rule (1), after the words \u2018shall be served\u2019 on both the\nplaces wherever they occur, the words \u2018through electronic means or\u2019 shall be\ninserted.<\/p>\n\n\n\n<h4 rule (1) <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the provision of the second proviso\nof sub rule (1) in Rule 23, the words \u2018published in journal\u2019 shall be\nsubstituted for the words \u2018notified in the Official Gazette\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" of sub rule (1), the words \u2018immediately after its constitution\u2019\nwill be omitted.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_2\"><\/span>Sub rule id=\"Sub_rule_1-5\"><\/span>Sub rule (1)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In the provision of sub rule (1), the\nwords \u2018through electronic means or\u2019 shall be inserted after the words \u2018application\nshall be served\u2019.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_5-3\"><\/span>Sub rule (5)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In the provision of sub rule (5), the\nwords \u2018published in journal\u2019 shall be substituted for the words \u2018notified in\nthe Official Gazette\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_49_Sub_Rule_1\"><\/span>Substitution in Rule 49 Sub Rule (1)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be\nnoted that in the provision\nof sub rule (1) of Rule 49, the words \u2018one hundred and eighty days\u2019 shall be\nsubstituted for the words \u2018sixty days\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_50_Sub_Rule_2\"><\/span>Substitution in Rule 50 Sub Rule (2)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be\nnoted that in the provision\nof clause (a) of sub rule (2) of Rule 50, the words<strong> <\/strong><strong>\u2018<\/strong>not below id=\"Substitution_in_Rule_55\"><\/span>Substitution in Rule 55<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\namendments made in Rule 55 can be summarised as:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_2-2\"><\/span>Sub rule (2)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In the provision of sub rule (2), the\nwords \u2018rule 67\u2019 shall be substituted for the words \u2018rule 71\u2019.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_of_Sub_rule_3\"><\/span>Insertion of Sub rule (3)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The copyright society\nin respect to the collection of royalty under sub rule (1) and distribution of\nroyalty under sub rule (2) of this rule, will create a mechanism of payment by\nway of electronic modes and will establish a system by which the payments so\nmade are easily traceable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_56_Sub_Rule_1\"><\/span>Substitution in Rule 56 Sub Rule (1)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the provision of sub rule (1) of Rule\n56, the words \u2018and publish\u2019 shall be inserted after the words \u2018frame\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_in_Rule_58\"><\/span>Insertion in Rule 58<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The sub rules\nto be inserted after sub rule (2) of Rule 58 can be summarised as:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_11\"><\/span>Sub rule (11)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>A copyright society\nshould ensure that the case in which the royalty cannot be distributed within\nthe time prescribed in sub rule (8), as the pertinent author or other right\nowner could not be identified or located, then, in that case, such royalties\nare to be kept separate and distinct in the accounts of the copyright society.<strong><\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_12\"><\/span>Sub rule (12)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>&nbsp;A copyright\nsociety needs to take all required measures to identify and find the authors\nand other owners and also publish on its official website, at\nthe end of each quarter, the information as follows:<\/p>\n\n\n\n<ol><li>The\nactual title of the work;<\/li><li>The\nname of the pertinent author and other right owners of the said work, as\navailable, and;<\/li><li>Any\nother pertinent available information which could help in identifying the right\nholder;<\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub_rule_13\"><\/span>Sub rule (13)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>If in case the royalty\ndue to the author and other right owners remains undistributed at the end of\nthe period of three consecutive years, starting from the end of the fiscal year\nin which the collection of the royalty occurred, then, in that case, the copyright\nsociety will transfer such an amount to the welfare fund of the said copyright\nsociety.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_59_Sub_Rule_7\"><\/span>Substitution in Rule 59 Sub Rule (7)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be\nnoted that the tenure of the Chairman and other members of the \u201cGoverning\nCouncil\u201d will be two years, and they will be eligible for re-election as well.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_in_Rule_62\"><\/span>Insertion in Rule 62<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be\nnoted that after the provisions of clause (viii) of Rule 62, a new clause (ix) will\nbe inserted, which states that \u2018the annual transparency report as mentioned under rule 65A\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substitution_in_Rule_64\"><\/span>Substitution in Rule 64<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be\nnoted that in the provision\nof Rule 64, the words \u2018in the physical or digital format\u2019 shall be substituted\nfor the words \u2018maintain the following registers\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_in_Rule_65\"><\/span>Insertion in Rule 65<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The clauses\nto be inserted in Rule 65 can be summarised as:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Clause_viii\"><\/span>Clause (viii)<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>It shall be\nnoted that after the provisions of clause (vii) of Rule 65, a new clause (viii)\nwill be inserted, which states that \u2018the annual transparency report as mentioned under rule 65A\u2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insertion_of_Rule_65A\"><\/span>Insertion of Rule 65A<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It shall be noted\nthat after the provisions of Rule 65, a new Rule 65 has been inserted, which\nstates as follows:<\/p>\n\n\n\n<ol><li>The copyright\nsociety should draw up and formulate a special report to be termed as the \u2018annual\ntransparency report\u2019 for each fiscal year within a period of six months, following\nthe end of that fiscal year. Further, the copyright society will publish on its\nofficial website the \u2018annual transparency report\u2019 and confirm that the said\ntransparency report remains will be available on its official;
