The purpose of granting right under the provisions of the\nCopyrights Act, 1957 is to use, reproduce, or communicate the works to the\npublic at large, for translating, utilizing, and making adaptation of that\nWork. Copyright is an intellectual property giving protection to the creator of\nthe author for expression of ideas.<\/p>\n\n\n\n<p>Copyright gives protection to the creators or owners of the original work from his work being copied or from unauthorized use of the work. Copyright protection is provided under the Copyrights Act, 1957 in India. Therefore, in this blog we will learn about why <a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\"><strong>copyright registration<\/strong><\/a> is required in right given to the author to ensure\nthat nobody else copies his work. A copyright gives the holder of the subject a\nsole and exclusive right over his work. If the copyright work is protected, no\none can replicate, copy, imitate or reproduce the owner\u2019s original work in any\nother manner. A copyright term in India is for a time period of 60 years.\nCopyright is granted for the following works:<\/p>\n\n\n\n<ul><li>Music<\/li><li>Books<\/li><li>Manuscripts<\/li><li>Films<\/li><li>Fashion Designs<\/li><li>Training Manuals<\/li><li>Software<\/li><li>Literary Work<\/li><li>Performance<\/li><li>Paintings etc<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Registration_of_Copyright\"><\/span>The Registration of Copyright<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In order to get the protection under Copyright the owner of the work must get his work registered in accordance with the Act to avail various benefits : The registration of Copyright to the Registrar of Copyrights is divided into six categories: <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" loading=\"lazy\" width=\"579\" height=\"336\" src=\"https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/04\/image-2.png\" alt=\"The Registration of Copyright\" class=\"wp-image-4452\" srcset=\"https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/04\/image-2.png 579w, https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/04\/image-2-300x174.png 300w\" sizes=\"(max-width: 579px) 100vw, 579px\" \/><\/figure><\/div>\n\n\n\n<p>In India, it is not mandatory to register Copyright as the\nregistration is treated only as a record of the fact. The registration of\nownership shall be considered \u201cproof of ownership\u201d Hence, it will be beneficial\nfor the owner to enforce his rights against copyright infringement. The Supreme\nCourt has held it in many cases where registration of Copyright is important to\nclaim rights during infringement. It is imperative to note that there is no\ntime limit prescribed within which the registration of Copyright can be\nattained. Nonetheless, the registration of a copyright can currently take a\ntime of upto 1 to 1 \u00bd years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Steps_for_Copyright_registration_in_India\"><\/span>Steps for Copyright registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To obtain the copyright registration the following steps has to\nbe followed:<\/p>\n\n\n\n<ul><li>An application for registration of Copyright shall include all the      particulars and statements that the owner of the work shall file in the      format of Form IV.<\/li><li>\u00a0The application shall be filed before the Registrar of Copyrights with the required fees as applicable to the office of Registrar at New Delhi, India. Registration of Copyright for separate works requires separate applications.\u00a0<\/li><li>After the application is filed, the Registrar of Copyrights checks and examines the and after 30 days from the date of filing either registers it or if any discrepancy is found then a letter is issued to the Applicant to resolve the discrepancy within the prescribed time of 30 days. If the applicant fails to reply to the letter or fails in resolving the discrepancy, then the application shall be deemed to be abandoned.\u00a0<\/li><li>On the other hand, if the Registrar of Copyrights to his satisfaction finds the reply reasonably correct, then the applied work details shall be entered in the Register of Copyrights.\u00a0<\/li><li>The Registrar of copyrights shall issue the Registration Certificate to the applicant, also known as the Extract of such Register of Copyright.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_and_Information_required\"><\/span>Documents and Information required<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Generally, the given below documents and the details are\nrequisite for filing of copyright registration application:-<\/p>\n\n\n\n<ul><li>Name, address, and nationality of the Applicant.<\/li><li>The author\u2019s name, address, and Nationality.<\/li><li>Where both the author and the applicant are different, then a No Objection Certificate from the Author.<\/li><li>If the application is filed by an attorney on behalf of the Applicant then document of Power of Attorney.<\/li><li>Copy and details about the Work.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_of_Copyright_Registration\"><\/span>Benefits of Copyright Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The benefits of registration are as follows: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"It_provides_legal_protection\"><\/span>It provides legal\nprotection-&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The registration under Copyright serves as an evidence for proving the ownership that the particular work belongs to the author which gives him the legal protection. Sec 48 of the <strong>Copyright Act, 1957<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> gives a prima facie validity to the registration certified by the Registrar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"It_provides_branding_and_goodwill_to_the_owner\"><\/span>It provides\nbranding and goodwill to the owner-<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The registration of Copyright and the certificate provided gives\nthe authentication to the work also making way for marketing the author\u2019s work\nand creating goodwill and a brand by the quality in the mind of the customers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"It_protects_from_unauthorized_use\"><\/span>It protects from\nunauthorized use-&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The registration of Copyright provides legal remedies to the\nauthor and he can claim against copyright infringement, use or reproduction of\nhis work in an unauthorized manner and without his permission.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"It_provides_global_protection\"><\/span>It provides global protection-<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&nbsp;If the owner obtains the\nregistration of Copyright in other countries then the owner can claim the same\nprivileges as the owner has in India.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"It_provides_remuneration_and_royalty_to_the_owner\"><\/span>It provides remuneration and royalty to the owner-\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\ncopyright work can later get translated or adapted and the owner gets entitled\nto claim royalty or remuneration over such adaptation and editing of his\nwork.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_Conclusion\"><\/span>&nbsp;Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The registration of Copyright offers several benefits and the owner\u2019s work is secured and protected from getting infringed.
