A <strong><a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\">copyright<\/a><\/strong> is one of the categories of intellectual property protection. Copyright under the Indian law is granted to the proprietors for protecting their original work. The works that are given protection under the copyright account includes a literary work, artistic work, musical, dramatic, cinematographic and also the sound recordings. An example for the literary works consists of books and computer programs, etc.&nbsp;<\/p>\n\n\n\n<p>The Copyright Act 1957, under section 13 the owner has got the legal right to protect their work from getting copied, used or remade without their permission. The copyright work that is registered is given the protection and only the proprietors can exercise such copyrights. But there are certain exceptions to the copyright protection which shall be dealt in this article in a very detailed manner. Copyright infringement\u00a0means an unauthorized use of someone\u2019s copyrighted work without the owner\u2019s permission. Thus, if someone is using someone else\u2019s copyrighted work and that too without the author\u2019s valid permission is said to have thereby infringed certain specified rights of the copyright holder, which includes rights such as right to distribute, right to reproduce, right to display or the right to perform the protected work.<\/p>\n\n\n\n<p>It is important for considering\nfor the purpose of copyright infringement that the unauthorized person has\ncopied a substantial part of the owners work. Hence, while deciding the case\neven the court also tries to consider, that how an ordinary person shall\nperceive the work that is being infringed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Exception_to_Copyright_Infringement\"><\/span>What is Exception to Copyright Infringement?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>We all know about the Copyright Infringement , however it is not applicable in every case. Section 52 of the <strong>Copyright Act, 1957<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> deals with the exception to Infringement which reads as&nbsp;\u201cCertain acts not to be Infringement of Copyright\u201d.<\/p>\n\n\n\n<p>Furthermore, as the Section 52 is very wide, we will only deal about the same in few parts. We will deal with the Exception in the case of Fair Dealing with any work\u201d.<\/p>\n\n\n\n<p><strong>Section\n52 (1) &#8211; The following given below act shall not amount to an infringement of\ncopyright, namely, \u2014<\/strong><\/p>\n\n\n\n<p><strong>(a)<\/strong>&nbsp;Any&nbsp;<strong>fair dealing<\/strong>&nbsp;with the author\u2019s work, not being a&nbsp;<strong>computer programme<\/strong>, is used for the purposes of\u2014<\/p>\n\n\n\n<p><strong>(i)<\/strong>&nbsp;personal\nor private use, including study and research;<\/p>\n\n\n\n<p><strong>(ii)<\/strong>&nbsp;Criticism\nof the work or review on that work or of any other work;<\/p>\n\n\n\n<p><strong>(iii)<\/strong>&nbsp;The reporting of the current affairs and current events, which shall include the reporting of any lecture being delivered in public.<\/p>\n\n\n\n<p><strong>Explanation \u2014<\/strong>&nbsp;The storing of the author\u2019s work in any electronic medium for the purposes specified in this clause, including any incidental storage in any computer programme which is not in itself an infringing copy, shall not amount to infringement of copyright.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_does_Doctrine_of_Fair_Dealing_mean\"><\/span>What does Doctrine of Fair Dealing mean?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The term&nbsp;<strong>\u201cfair dealing\u201d<\/strong>&nbsp;is\nnot defined anywhere in the Act. It is a legal doctrine which gives permission\nto a person that he can make a restricted or limited use of the copyrighted\nwork without the owner\u2019s permission.<\/p>\n\n\n\n<p>Hence, <strong>Fair Dealing<\/strong> is an exception and limitation to the author\u2019s sole\nand exclusive right granted by copyright law for a creative work. Fair dealing\npermits the use or reproduction or use of copyrighted work in such a manner,\nwhich, but because of the exception created would have resulted in infringement\nof copyright. Thus, it is kept out of the mischief of the copyright law.<\/p>\n\n\n\n<p>The defence of&nbsp;<strong>\u201cfair\ndealing\u201d<\/strong>&nbsp;primarily originated and developed as a&nbsp;<strong>doctrine of\nequity<\/strong>&nbsp;which permits the use of the copyrightable works, and such work\nwhich could have been otherwise prohibited and which if used or reproduced\nwould amount to infringement of the copyright. The main objective behind the\ndoctrine is to avoid the stagnation for the development and growth of\ncreativity for the progress for which the law has been designed.<\/p>\n\n\n\n<p>With the emerging growth, India\nhas seen tremendous technological improvement but still obtains a very fractional\nscope in the law of&nbsp;<strong>fair dealing<\/strong>. But now the continuous advancement\nthrough judicial activism and inventive interpretations has been beneficially\nintroduced in this field.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Explanation_of_Fair_Dealing\"><\/span>What is Explanation of Fair Dealing?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The explanation of fair dealing\nwill depend on whether the person\u2019s use of the copyright material is actually\n\u201cfair\u201d and that would depend completely on the facts and circumstances of the\ncase. There is a very thin line difference between infringement and \u201cfair\ndealing\u201d.<\/p>\n\n\n\n<p>In India, there are no fixed\nguidelines to define the exact passages or the number of words that can be used\nwith limited restriction without the author\u2019s permission. It is on the\ndiscretion of the Court to apply the basic common sense to determine this. Therefore, Fair dealing is a considerable limitation on the owner\u2019s creative right to protect the copyright owner.
