A provisional Patent application is known to be a temporary application that is usually filed when an invention is not finalised. It delivers an application period of twelve months to finalise the finer details and deliver the complete specification application.<\/p>\n\n\n\n<p><strong><em>Step\n2:<\/em><\/strong> Once the Patent application is filed, it will\ntake around eighteen months to have an application enter publication. Once the\nPatent application enters publication, a demand for an examination can be\nfiled. But, some provisions decrease the time of eighteen months usually taken\nfor the publication by filing the request early publication.<\/p>\n\n\n\n<p><strong><em>Step\n3:<\/em><\/strong> An examination request can be filed within 48\nmonths from the priority date. Indian Patent Office (IPO) shall not inspect an\napplication until the examination request has been filed. Therefore, it\u2019s an\nessential step to be followed.<\/p>\n\n\n\n<p><strong><em>Step\n4:<\/em><\/strong> Once the Patent Office receives an examination\nrequest, the Patent application is placed in a queue for the inspection. Once\nthe Patent examination has been inspected, the Patent Office will either be of\nthe opinion that the invention and application please all the necessities will\nsubsequently be granted as a Patent, or there will be oppositions raised\nthrough the First Examination.<\/p>\n\n\n\n<p><strong><em>Step\n5:<\/em><\/strong> The candidate has a time of six months to\nrespond to the FIR from the issuance date. It&#8217;s always recommendable to file\nthe reply as soon as possible so that the Patent Office can examine the\nresponse &amp; issue another examination report if required. The timely response\nis vital since a candidate have a total of six months from the issuance date of\nthe First Examination Report to reply to all the examination reports if there\nis more than one.<\/p>\n\n\n\n<p><strong><em>Step\n6:<\/em><\/strong> There is an extra provision of requesting the\nhearing after a First Examination Report. Post the filing and hearing response\nto the examination report. The candidate desires to appeal against the Patent\nOffice decision of declining the Patent application. Then they can reach out to\nthe <strong><em>IPAB\n(Intellectual Property Appellate Board), <\/em><\/strong>which is permitted to hear\nsuch appeals.<\/p>\n\n\n\n<p>It\nis crucial to know that the steps don\u2019t involve that candidates or their\nrepresentatives must wait to file an examination request until the application\nhas been published. The request for early publication or request for an\nexamination can be filed with the application of Patent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Expedited_Examination_Request_%E2%80%93_Protect_a_Patent\"><\/span>Expedited\nExamination Request &#8211; Protect a Patent<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According\nto the current rules, the eligibility criteria for the expedited examination\nshould be prolonged further as follows:<\/p>\n\n\n\n<ul><li>Small company;<\/li><li>A Government undertaking in the case of an Indian candidate or is the same entity in the case of a foreign candidate;<\/li><li>The candidate has chosen India as an ISA <strong><em>(International Searching Authority) or the IPEA (International Preliminary Examination Authority<\/em><\/strong><sup><a href=\"https:\/\/www.wipo.int\/pct\/en\/access\/isa_ipea_agreements.html\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong><em>) <\/em><\/strong>in a corresponding PCT application;<\/li><li>Female candidates ( in the case of the natural individuals) or at least one of the candidates should be a female;<\/li><li>The candidate who is suitable under an arrangement for the international application processing pursuant to an agreement between the IPO with another participating Patent Office.<\/li><\/ul>\n\n\n\n<p>The\nexpedited examination incurs extra charges. In case an examination request was\nalready filed, there is the provision to convert the regular examination\nrequest to an expedited response. If there was not any examination request\nfiled, the candidates or their representatives could directly file a request\nfor the expedited examination along with the applicable fee.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The steps taken for an increase in eligibility for expedited examination looks to be a step taken in the right direction, promoting candidates to look for Patent protection on time and contributing to protect a Patent.
