Any work which is protected by copyright, cannot be imitated, reproduced or copied by the other in any other ways. The term of copyright of a subject matter under the Copyright Act, in India is <em>60 years<\/em>.&nbsp; The entire procedure for copyright registration under the Copyright Act shall be discussed in class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to Section 13 of the Copyright Act, the protection of\ncopyright is given to the following work: &#8211; <\/p>\n\n\n\n<ul><li>Musical works<\/li><li>Literary works<\/li><li>Artistic works<\/li><li>Dramatic works<\/li><li>Architectural works<\/li><li>Cinematography films<\/li><li>Computer program\/software<\/li><li>Sound recordings<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_does_Copyright_not_protect\"><\/span>What does Copyright not\nprotect?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Copyright does not protect: &#8211; <\/p>\n\n\n\n<ul><li>Works which are not in tangible\nform<\/li><li>Names, Slogans, titles, short\nphrases, symbols, methods, designs or factual information. (however it may be\nprotected under trademark law)<\/li><li>Procedures, plans, ideas or\nconcepts, process, discoveries, guidelines and principle. (however it may be\nprotected under patent law or trademark law)<\/li><li>Works that are already in the\npublic domain and the original authorship of such work is not traceable <\/li><li>The already expired copyright\nworks<\/li><\/ul>\n\n\n\n<p>Copyright law is provided for almost all the visible things like\nbooks, scripts, films, photos, essays architecture, videos etc. and some\nintangible things like music. The most important criteria to determine whether\na particular work can be copyrighted or not, depends upon its <em>Originality<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_procedure_for_Copyright_Registration_under_the_Copyright_Act\"><\/span>The procedure for\nCopyright Registration under the Copyright Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_1_Filing_of_Application\"><\/span>Step 1: Filing of\nApplication <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The first step under the procedure for the <strong><a href=\"https:\/\/swaritadvisors.com\/copyright-registration\" class=\"text-primary\">Copyright registration<\/a><\/strong> under the Copyright Act is that the author of the original work or his agent on his behalf is required to file an application either through e-filing facility available on the official website of Copyright or physically at the copyright office or through the registered or speed post. <\/p>\n\n\n\n<p>The registration of each work requires a separate application to be\nfiled along with the prescribed fee of such work, with the Registrar. Further a\ndiary number shall be issued by the registrar to the applicant, upon the filing\nof the application. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_2_Examination\"><\/span>Step 2: Examination<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The next step after the application is submitted is the examination\nof the copyright application. A minimum of <em>30\ndays<\/em> period is taken by the examiner to review the application. The purpose\nof waiting period is to allow for raising objection in concern to the copyright\napplication by the others. In case where no objection is raised by the others,\nthe examiner shall continue further to review and scrutinize the application to\nlook for any discrepancy. <\/p>\n\n\n\n<p>If no <em>discrepancies<\/em> arise,\nand all the required documents and information is provided by the applicant,\nthe examiner shall proceed with the next step. However, in case where some\ndiscrepancies arise or found, a letter of discrepancy shall be sent to the\napplicant. Upon the reply of the applicant, a hearing shall be conducted by the\nregistrar. Once the discrepancy is removed the application shall be preceded to\nthe next step. <\/p>\n\n\n\n<p>In case where any <em>objection<\/em>\nis raised against the application, the registrar sends a letter to both the\nparties and they are called to be heard by the registrar. If the objection is\nrejected upon the hearing, the application shall proceed further for scrutiny\nand the discrepancy procedure mentioned above shall be followed. <\/p>\n\n\n\n<p>However, if the objection raised by someone is not clarified or the\ndiscrepancy is not resolved, the application shall stand rejected and a\nrejection letter shall be sent to the applicant for the same. At such point of\ntime, the procedure for copyright registration under the copyright act shall\nend here. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_3_Registration\"><\/span>Step\n3: Registration <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The last step that is involved in the procedure for copyright\nregistration under the Copyright Act is the registration. The registrar may ask\nfor the further documents if required from the applicant. Once the registrar is\ncompletely satisfied with the copyright application submitted by the applicant,\nthe Registrar of copyright shall enter the details of the copyright into the\nregister of copyrights and issue a Registration Certificate to the applicant. <\/p>\n\n\n\n<p>The procedure for Copyright Registration completes when the applicant is provided with the extracts of the Register of Copyrights (ROC). <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_register_for_Copyright\"><\/span>Who can register for\nCopyright?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The author or the creator of the original work can register for the\ncopyright. There is no age bar on applying for the procedure for copyright\nregistration. <\/p>\n\n\n\n<p><em>A Copyright Registration\ncan be done be: &#8211; <\/em><\/p>\n\n\n\n<ul><li>The author or the creator of\nthe work<\/li><li>Any person who claims to have\nobtained the ownership rights from the author or the creator of the original\nwork<\/li><li>An agent who has been\nauthorized to act on behalf of the author or the creator. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Criteria_for_the_protection_Under_Copyright\"><\/span>What are the Criteria for\nthe protection Under Copyright?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To get the protection under the Copyright Act and to be eligible to\napply for the procedure for copyright registration, the work should fulfil the\nfollowing criteria: &#8211; <\/p>\n\n\n\n<ul><li>The work must be an original\nwork and should not be copied from any existing sources. <\/li><li>The work must be in a tangible\nform and should be capable of being identified and recognized in a fixed form.\nHowever, some intangible works are also protected under the copyright law. <\/li><li>The work must surely be the\nfirst publication and should not be published before. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Rights_given_to_the_Author_or_the_creator_under_the_Copyright_Law\"><\/span>What are the Rights given\nto the Author or the creator under the Copyright Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 14 of Chapter III and 57 of chapter XI of the Copyright Act provides the author or the creator with the exclusive and some special rights. The judiciary already provides the author or the creator with the bundle of rights under copyright law. It imposes with the negative duty on\nthe others that does not allow them from using or getting the benefits from the\noriginal work done by the author without his consent. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2-_Economic_Rights\"><\/span>2- Economic Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This right provides the author to enjoy the financial benefits by\nearning the royalty by assigning the rights to the others either partially or\nfully. Every national copyright statute provides the following rights,\naccording to the international conventions: &#8211;<\/p>\n\n\n\n<ul><li>Distribution rights<\/li><li>Public performance rights<\/li><li>Adaptation rights<\/li><li>Rental rights<\/li><li>Display of work to the public\nrights<\/li><li>Reproduction rights<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3-_Moral_Rights\"><\/span>3- Moral Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The author is protected under the copyright law, even after he\nassigns his copyright work either partially or fully to someone. This right\ngrants the author to have his name kept on the work forever and protects it\nfrom any kind of modification or distortion or any other offensive action in\nconnection to the work, which would damage the reputation of the author. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedure for copyright registration under the Copyright Act is very important for the author or the creator to protect its original work from being infringed or used by others without his\/her permission. With the registration of copyright, it allows the original creator of the work to move to the court easily and get the person illegally copying his work punished.
