Therefore, the design should be registered under the Act to enjoy protection. But, it is even possible to safeguard a design under other legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Procedure_of_Registered_Designs\"><\/span>What is\nthe Procedure of Registered Designs?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>All stakeholders or candidates\ncan apply for Design Registration online via the official website of the\nController General of Designs, Patents, and Trademarks.<\/li><li>The online filing facility\ncomprises a comprehensive payment gateway that accepts electronic banking and\ncredit &amp; debit cards.<\/li><li>The <strong><em>Design Application Search Utility\n<\/em><\/strong>enables candidates to search for published design applications via\nseveral search inputs such as applicant&#8217;s name, application number country,\ndate of filing, state and publication date &amp; article name.<\/li><li>To apply for Design\nRegistration, the candidate should complete Form 1, which comprises its full\nname, article name, nationality, class number, address, and address for service\nin India. The candidate or its certified agent may sign the design application.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Registered_Designs_Cancellation\"><\/span>Registered\nDesigns Cancellation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>There is no specific provision to oppose the Design Registration under the Indian Law. But, there is a procedure for cancellation under which any interested individual can file a petition for the cancellation of registered designs anytime after the registration of design with a controller on any of the following grounds:<\/li><\/ul>\n\n\n\n<ol><li>If the design is not unique or\nnew;<\/li><li>If the design is already\nregistered in the past in India;<\/li><li>If the design not registered\nunder the Act;<\/li><li>If the design is not a design\nmentioned under Section 2 (d) of the Act;<\/li><li>If the design has been\npublished publicly in India or any other nation before the registration date.<\/li><\/ol>\n\n\n\n<ul><li>On the petition receipt for\ncancellation, the Design Office sends a copy of a petition and the evidence\nfiled to the registered proprietor.<\/li><li>Then, a registered owner files\na counter-statement and evidence at the design Office and delivers a copy to\nthe person who files the petition.<\/li><li>After the counter-statement\nreceipt &amp; evidence, the petitioner may file its reply statement &amp;\naffidavit evidence. After hearing the parties, a hearing is fixed, &amp; the\ncontroller rules on the petition &amp; issues an order.<\/li><\/ul>\n\n\n\n<p>Ownership\nRights Transfers and Changes According to the Indian Design Law, the right in a\nregistered design can be transferred via an agreement, transmission, licensing,\nand assignment. Design Registration of the title based upon assignment should\nbe filed with the Design Office within 6 months of implementation of the\nassignment instrument. Moreover, an extension of six months can be sought.<\/p>\n\n\n\n<p>There\nis no other method to extend the time one year after the effective instrument.\nThe Law also delivers for the recorded license, which should be done within six\nmonths of the issue; only a registered assignment or registered license\nconcerning registered design is admissible as evidence before the courts or in\nother proceedings. Hence, such an instrument should be registered with the\nOffice of Design.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> The procedural formalities are easy, cost-effective, and time-saving. But the applicants should follow the procedural necessities cautiously.
