This scheme was commenced to reach out to start-ups and safeguard &amp; encourage their IPR (Intellectual Property Rights) and thus promote creativity and innovation among entrepreneurs. The Scheme began on a pilot basis in Jan 2016 and was in force up to Mar 2020. The DPIIT (Department of Promotion of Industry and Internal Trade) has examined that the Start-ups Intellectual Property Protection Scheme is now broadening further for three years, that is, up to March 31, 2023.<\/p>\n\n\n\n<p>In\nIndia, start-ups that have limited human resources and resources can only\nuphold themselves via continuous evolutions in their innovations and development.\nThis makes Intellectual Property Right (IPR) Protection even more essential for\nstart-ups. <strong><a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\">Patent Registration<\/a><\/strong>), awareness and promoting creativity and innovation;<\/li><li>The Start-ups Intellectual Property Protection (SIPP) Scheme envisages guiding emerging technologies among start-ups and aiding them to commercialise them by way of giving access to high-quality Intellectual Property (IP) services &amp; resources.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Benefits_of_Start-ups_Intellectual_Property_Protection\"><\/span>What are the Benefits of Start-ups Intellectual Property Protection?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nare some significant benefits of Start-ups Intellectual Property Protection:<\/p>\n\n\n\n<ul><li>To encourage awareness and\npromote Intellectual Property Rights protection amongst start-ups, the scheme\nfor Startups Intellectual Property Protection launched;<\/li><li>The Government would pay\nsupposed professional fees for the service3s concerning getting the IPR\n(Intellectual Property Rights) to the advocates or Trademark agents in charge\nof handling the Intellectual Property Right process;<\/li><li>According to the scheme,\nfacilitators will not levy anything from a start-up. The fees are paid straight\nby the Government;<\/li><li>Start-ups can get Trademark,\nPatent, and Design services by paying them only needed legal fees, and\nprofessional fees are excluded as a part of the SIPP Scheme;<\/li><li>Start-ups can get a complete\nstart-to-end array of services under this Start-ups Intellectual Property\nProtection Scheme, consisting of general advice, helping in drafting\napplications, filing and preparing responses to examination reports, appearing\nat contest opposition, hearings and ensuring the final disposal of the\napplication of IPR (Intellectual Property Rights);<\/li><li>For effective execution of the\nscheme, the DPIIT has empanelled &nbsp;different facilitators, who are required to\nprovide Intellectual Property Right related services to start-ups;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_Criteria_for_SIPP_Scheme\"><\/span>Eligibility\nCriteria for SIPP Scheme<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nis the eligibility criteria for the Start-ups Intellectual Property Protection\nScheme:<\/p>\n\n\n\n<ul><li>In this scheme, a start-up is a\ncompany that has been registered in India&nbsp;\nor not more than seven years before the application;<\/li><li>The company shall cease to be a\nstart-up if its turnover for the early financial years has more than Rs. 25 crores\nor it has completed seven years from the registration date;<\/li><li>The company should be working\ntowards the development, commercialisation, or innovation of new products and\nprocesses or services which are driven by technology;<\/li><li>A start-up shall be entitled to\ngetting the benefits of this scheme only after it has procured certification\nfrom the start-up certification board;<\/li><li>The yearly turnover should not\nmore than Rs. 25 crores in any preceding financial year;<\/li><li>Moreover, the company is not\nformed by the splitting up or reconstruction of a business already in\nexistence.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Operation_of_the_Start-ups_Intellectual_Property_Protection_Scheme\"><\/span>Operation of the Start-ups Intellectual Property Protection Scheme<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The Government has also empanelled\nIntellectual Property facilitators (Trademark Attorneys and Patent Agents) who\nwill be working with Start-up&#8217;s filing &amp; prosecuting Patent applications;<\/li><li>The Start-ups Intellectual\nProperty Protection Scheme, firstly made to last until March 2020, has now been\nextended by three years to last until 31<sup>st<\/sup> March 2023. Around 44,534\nstart-ups have already been recognised by the DPIIT (Department for the\nPromotion of Industry &amp; Internal Trade) as of 24<sup>th<\/sup> February\n2021;<\/li><li>The plan comprises a fast-track\nexamination of Patent applications and a rebate in fees.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_Apply\"><\/span>Who can Apply?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any start-up acknowledged in terms of the notification of <strong><em>GSR 180(E)<\/em><\/strong><sup><a href=\"https:\/\/dipp.gov.in\/sites\/default\/files\/ru1159.pdf\" class=\"text-primary\"><strong><em>[1]<\/em><\/strong><\/a><\/sup><em> <\/em>published in Part 2, Section 3, Sub-Section (i) of the Gazette of India dated 17<sup>th<\/sup> Feb 2016, as may be changed from time to time. The Certificate of Registration (COR) given by DIPP may be confirmed from the Start-up India website.<\/p>\n\n\n\n<p>The\nstart-ups covered under the SIPP scheme will not be required to procure a\ncertificate of an entitled business from the Inter-Ministerial Board of\nCertification. But, start-ups will be required to give a self-declaration that\nthey have not availed funders in any other government scheme for the aim of\npaying the Patent agent\/Trademark Agent\/facilitator for prosecuting and filing\ntheir Intellectual Property application.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_Intellectual_Property_Right_IPR_for_Start-ups\"><\/span>Significance\nof Intellectual Property Right (IPR) for Start-ups<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nIntellectual Property Protection (SIPP) Scheme for Start-ups underscores the\nsignificance of protecting Intellectual Property Rights for a start-up. <\/p>\n\n\n\n<p>It&#8217;s\nideal for an initial stage of business to protect ownership over Intellectual\nProperty (IP) such as Patents, Brand Names, and Trademarks. This is because, in\nthe case of a possible violation, like someone else using a similar logo, name,\nor goodwill, it is easier to set up your rights over Intellectual Property.\nMost inventors, while taking a call on your start-up business&#8217;s worth, also\nfeature in the Intellectual Property that you may increase in future.
