Protection rights for a Design are only furnished for a time period of ten years, and that can be renewed once for an extra time period of five years. In India, to obtain <a href=\"https:\/\/swaritadvisors.com\/design-registration\" class=\"text-primary\"><strong>Design Registration<\/strong><\/a><strong>, <\/strong>the same has to be registered with the Design Office.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Necessities_for_Design_Registration_in_India\"><\/span>Necessities\nfor Design Registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nare some vital requirements for Design Registration in India:<\/p>\n\n\n\n<ul><li>The Design should be proficient\nto be judged only by the eye;<\/li><li>The Design shouldn&#8217;t be\ndisclosed to the public at massive in India or elsewhere in the globe by prior\nuse or a prior publication or in any other way;<\/li><li>The Design should be applied to\nthe work by an industrial process;<\/li><li>The Design shouldn&#8217;t comprise\nany Trademark or artistic creation or property mark as mentioned under the\nCopyright Act and the Trademark Act;<\/li><li>The Design should be\nsignificantly different from designs or a combination of designs that have already\nbeen registered or exists or revealed to the people at large;<\/li><li>The Design should be utilised\nin the article by an industrial procedure;<\/li><li>The Design shouldn&#8217;t comprise\nany of the entire functional features;<\/li><li>The Design should be unique or\nnew;<\/li><li>The features of Design should\nbe visible;<\/li><li>The Design shouldn&#8217;t comprise\nany shocking matter or obscene;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rectification_of_Design_%E2%80%93_Meaning\"><\/span>Rectification\nof Design &#8211; Meaning<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nprovisions concerning the rectification of Design in India are given under\nSection 31 of the Design Act, 2000, along with the Rules 39 &amp; 40 of the Design\nRules, 2001. In India, the Rectification of Design is filed in Form-17 as given\nin the Design Act, 2000 and the Design Rules, 2001. An individual can file an\napplication for the Rectification of the Design Registrar.<\/p>\n\n\n\n<p>The\napplication for Design Rectification can be filed on the following grounds:<\/p>\n\n\n\n<ol><li>Non-insertion or error of any\nentry;<\/li><li>Error or defect in any entry;<\/li><li>The entry was made without\nenough cause;<\/li><li>Entry remained wrongly on the\nDesign Register.<\/li><\/ol>\n\n\n\n<p>The\nRectification of Design can be done by way of expunging, varying, or making any\nentry. Design Rectification doesn&#8217;t comprise the Design Cancellation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Rectification_of_Design_in_India_under_the_Design_Act_2000\"><\/span>Procedure for\nRectification of Design in India under the Design Act, 2000<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following is the procedure for Rectification of Design under the <strong>Design Act, 2000 and Rules, 2001<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1917?locale=hi\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>:<\/p>\n\n\n\n<ul><li>On the application receipt for\nthe rectification of Design, the Design Controller should inform all the\nindividuals whose names are entered in the Design Register as all these were\nhaving a design interest. Such a rectification application is also required to\nbe published in the Patent Journal.<\/li><li>Any individual interested in\nthe registered Design can give an opposition notice to such an application for\nthe Rectification of Design within three months of time-period from the date on\nwhich the application was published in the journal.<\/li><li>The challenger is required to\nleave the written statement with the relevant evidence. The challenger is also\nneeded to begin the nature of their interest and the fact on which the\nchallenger bases their case &amp; is seeking aid. The challenger is required to\nfile their written statement with all the other required documents within 14\ndays of giving the opposition notice.<\/li><li>The Design Controller must\nforward a copy of the opposition notice together with the written statement\n&amp; the supporting evidence to the candidate of the application for Design\nRectification within 15 days from the receipt date of the statement &amp;\nrelevant evidence.<\/li><li>Suppose the candidate wants to\nchallenge the opposition notice. In that case, they have to file at Patent\nOffice, Kolkata, a counter statement and all required relevant evidence, if\nany, and should set forth all the sensible grounds upon which he or she is aim\nto challenge the notice filed by the challenger within one month from the date\non which the suggestion by the Design Controller was given, and deliver a copy\nof such counter-statement to the challenger simultaneously. The time duration\nof one month can be extended by the Design Controller. The extension can be\nprovided up to a maximum of three months.<\/li><li>After the counter statement&#8217;s\nreceipt and supporting evidence from the candidate of the application for\nDesign Rectification, the challengers can file their reply statement &amp;\nrelevant evidence by way of affidavits within one month from the delivery date\nof the counter-statement of the registered owner and the relevant evidence. The\nresponse evidence of the opponent should be severely limited to subject matters\nin the evidence given by the candidate. This duration of one month can be extended\nby the Design Controller up to three months. The challenger is required to\ndeliver a copy of their statement &amp; relevant evidence to the candidate at\nthe same time.<\/li><li>No extra evidence should be\ndelivered by any parties to the proceedings, except with the leave\/direction of\nthe Design Controller.<\/li><li>Where any document which is\nfiled &amp; is in a language other than English and is mentioned in any of the\nrelevant evidence or statement, an attested translation in copy in English is\nrequired to be provided.<\/li><li>Once the filing of statement\nand evidence is completed by the candidate and challenger, the Design\nController should give at least ten days of hearing notice of both the parties.<\/li><li>On receiving the hearing\nnotice, if either of the parties wants to be heard, such party have to file an\nintention notice to attend the hearing in Form 20 along with the fees provided\nfor the same.<\/li><li>Suppose either of the party is\naiming to depend on any publication at the hearing that is not described in the\npetition for Design Cancellation, any relevant evidence or statement. In that\ncase, they should give to the other party &amp; the Design Controller notice of\nsuch intention there, along with the details of publication. Such an intention\nnotice should be given at least fifteen days in advance by the party.<\/li><li>After hearing both parties or\nif neither of the party wishes to be heard, then without a hearing, the Design\nController should decide the application filed for Design Rectification and\nissue a speaking order for the same.<\/li><li>The final decision of the\nDesign Controller must be informed to both the parties and is required to be\npublished in the journal.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Rectification of Design is given in the Design Act, 2000 to make any modifications in the Design if there is any inconsistency in the Design. The process of Design Rectification can be only initiated once the Design Registration is filed. The Design Registration in India can furnish vital benefits to the business, comprising ownership of exclusive rights to manufacture &amp; sell the Design.
