A Trademark\ndifferentiates one product or service from its opponents\u2019 products or services.\nIt provides a brand value or recognition to a product of a company. When a\nTrademark is unique in nature from the products or services that it provides,\nit becomes easier for it to get registered. The brand name should be unique\nfrom the goods or services of any other company in the same market so that\ncustomers can easily identify such a trademark and differentiate it from its\nother competitors who are involved in a similar market.<\/p>\n\n\n\n<p>India\nis a common-law nation; it identifies Trademark use, so it is mandatory to\nregister a brand name or Trademark, but it is always recommendable to do so as\nTrademark Registration or Brand Registration provides extensive protection. Intellectual Property is divided into broad classes, i.e., Copyright and Industrial Patent. When an individual\u2019s Intellectual Property Rights are violated by\nanother person, remedies in the name of starting prosecution proceedings\nagainst such individual or person are provided under the Trademarks Act, 1999. Vs. Millet Oftho Industries and Others <\/em><\/strong>was the\nfirst to join the international market or safeguarding established foreign\nbrands under Indian Trademark Law or Medicine &amp; Healthcare.<\/p>\n\n\n\n<p>In\nthis instance, the Supreme Court of India extends the protection given by the\nIndian Trademark Law to a well-known international brand. An Indian business or\ncompany was barred from using the Trademark <strong><em>OCUFLOX<\/em><\/strong> by the court. The\ndecision of the court was made even the US corporation had not used the mark in\nthe Indian market &amp; that the mark had not been incorporated in India. The\nrespondent, in this case, was the first to enter the market &amp; use the mark,\nas per the court. Moreover, if the respondent was the first to enter the\ninternational market, the fact that they have not used the mark in India is\nunrelated. It also mentioned that in the healthcare &amp; medicine sector, any\nchanges for dishonesty &amp; confusion should be avoided at all costs while\nensuring that the interest of the public is not harmed.<\/p>\n\n\n\n<p>Courts have constantly, through their judgments, provided the role of IP in branding, whether it is technology, fashion, medicine, or arts. From this case, we see the role of IP in branding is essential. Although the respondent company didn\u2019t register their Trademark in India, still it was the first to enter the international market; it created robust goodwill, <strong>brand<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Brand\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>, and reputation for their company that without Trademark Registration in India, the court safeguarded its Trademark.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After\ndiscussing the role of IP in branding, it is concluded that a Trademark\nprovides statutory safety for a brand, while a brand can be characterised as\nthe representative part of a company&#8217;s image, which creates and develops by\ngenerating trust. Companies should be using Trademark protection to safeguard\nthe capital investment they made in developing their brand.
