Upon examination of\nthe <strong><em>IPKat\ncoverage<\/em><\/strong> of the problem including, the accurate background supporting\nthe claim becomes clear.<\/p>\n\n\n\n<p><strong><em>Case\nFacts<\/em><\/strong><\/p>\n\n\n\n<p>Sugar\nHero is a website run by Elizabeth Labau, and she&#8217;s a blogger. Through this\nsite, she shares her different, creative, self-made recipes in different ways,\nwhich comprise pictures, videos, etc. This website is her major source of\nrevenue, which is generated through advertisements &amp; affiliate sales. It is\nalso said to have collected a lot of beneficial attention for Ms Labau and\nmaking its full-time search. <\/p>\n\n\n\n<p>She\ncreated one recipe, which was a <strong><em>snow<\/em><\/strong> <strong><em>globe cupcake recipe, <\/em><\/strong>which\nbecame super popular amongst everyone. Afterwards, she published a video on her\nFacebook telling how to make snow globe cupcake recipes. It includes a rapid\noverview of the ingredients to be used and a detailed explanation of the recipe\nand the usage of elements in the recipe; there was no verbal command in the\nvideo; only a tune was played in the background.<\/p>\n\n\n\n<p><strong><em>Law\nApplied in the Present Case<\/em><\/strong><\/p>\n\n\n\n<p>Copyrights\nsafeguard the innovative works of the author, and the two videos, in this case,\nwould qualify as creative work &amp; they would be safeguarded to a certain\nextent under Copyright.<\/p>\n\n\n\n<p>The\ninventions mentioned in <strong><em>Section 102 of the Copyright Act <\/em><\/strong>mostly\ndeal with subject issues for Patents. To be entitled for a Patent, the\ninvention must be beneficial, innovative and unique. Moreover, in the United\nStates, an inventor has to file a Patent within a time of one year from the\nfirst public disclosure date or else the invention comes under the public\ndomain. In the case of snow globe cupcakes, most likely, they were not\npatented. Hence, anyone could make, sell, or use them in their judgment.<\/p>\n\n\n\n<p>Furthermore,\nCopyright protection will be entirely restricted in the videos of the Sugar\nHero as the videos are completed in definite sequential steps and in a\nprescribed manner. After examining both the videos, I believe there are enough\ngrounds of difference in both the videos &amp; the video of Food Network would\nbe non-violating and I assume that the suit of Sugar Hero to be victorious. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>So, in the end, one can go for Copyright a recipe and protect their food recipe from establishing ownership over it and having a date stamp on it.
