In this pandemic, every business or company is going online, and it has\nbecome predictable that a business or company will face this problem. In 2006, .IN Registry formulated policy names the INDRP Policy to regulate\nthe disputes like rapid increase in domain name disputes in the country.<\/p>\n\n\n\n<p>The INDRP Policy was drafted in accordance with the WIPO guidelines and the provisions of the <strong>IT Act, 2000<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/13116\/1\/it_act_2000_updated.pdf\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>. The INDRP regulates disputes regarding domain names, including the .Bharat Code or .IN at the end, like ssrana.in, amazon.in, or apple.in.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_can_you_file_an_INDRP_complaint\"><\/span>When can you\nfile an INDRP complaint?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>INDRP\nPolicy or Rules (Para 4) provides the ground for INDRP Compliant filing:<\/em><\/strong><\/p>\n\n\n\n<ul><li>First, always remember before filing INDRP compliant that the registered domain name should be similar or confusingly identical to your mark (Service Mark or <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\">Trademark<\/a><\/strong>) or the name in which you have the ownership rights;<\/li><li>There will be no legal rights of the Registrant in the registered domain name. Para 6 of the INDRP Policy gives examples of what can be termed as the Registrant&#8217;s legal rights &amp; interests:<ol><li>The Registrant is involved in the genuine distribution of products &amp; services under the domain name or a name similar to the domain name. <\/li><li>The internet users recognise the Registrant with the disputed domain name, whether he owns no rights con concerning mark under the <strong><em>Trademark Act<\/em><\/strong>.<\/li><li>There is no purpose on the part of the Registrant to divert any clients or ride on the goodwill linked with the Mark of Complainant. <\/li><\/ol><\/li><li>The Registrant should have registered the name of the domain in bad faith. <strong><em>Para 7 of the INDRP Policy <\/em><\/strong>gives examples of what can be called as bad faith:<ol><li>If the Registrant has registered or recorded the domain name for the sole purpose of renting, selling, or transferring it back to its actual owner (Complainant);<\/li><li>The Registrant registers the name of the domain before the mark owner to prevent the Compliant (actual owner) from registering that domain name;<\/li><li>If the Registrant has been utilising the domain to attract users to the name &amp; status of the Complainant by creating confusion as to any association or sponsorship between the Complainant and Registrant.<\/li><\/ol><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_after_filing_INDRP_Complaint\"><\/span>Process after filing INDRP Complaint<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/09\/Process-after-filing-INDRP-Complaint.png\" alt=\"Process after filing INDRP Complaint\" class=\"wp-image-8521\" width=\"490\" height=\"487\" srcset=\"https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/09\/Process-after-filing-INDRP-Complaint.png 979w, https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/09\/Process-after-filing-INDRP-Complaint-150x150.png 150w, https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/09\/Process-after-filing-INDRP-Complaint-300x298.png 300w, https:\/\/swaritadvisors.com\/blog\/wp-content\/uploads\/2021\/09\/Process-after-filing-INDRP-Complaint-768x764.png 768w\" sizes=\"(max-width: 490px) 100vw, 490px\" \/><\/figure><\/div>\n\n\n\n<ol><li><strong><em>Examine the Compliant<\/em><\/strong>:\nThe Registry will verify whether all the requirements under the procedural\nrules are met in the compliant. If yes, then the complaint is to move forward\nto the next phase. If no, the complaint is returned to the Complainant to\nremove any inconsistencies in the document and submit it again.<\/li><li><strong><em>Arbitrator Appointment<\/em><\/strong>:\nWithin five days of getting the complaint, the Registry appoints an arbitrator\nfrom its list of registered arbitrators.<\/li><li><strong><em>Award Passing<\/em><\/strong>:\nThe arbitrator, after hearing both the parties, passes an award within sixty\ndays or two months from the beginning of proceedings. He or she can also seek a\nthirty days extension, but only in exceptional cases.<\/li><li><strong><em>Intimation of Decision<\/em><\/strong>:\nOnce the arbitrator passes an award, then it is the registry duty to forward\nthe arbitrator&#8217;s decision to both parties within five working days.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Guidelines_to_be_followed_under_INDRP_Policy\"><\/span>What are the Guidelines to be followed under INDRP Policy?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nINDRP Policy has been released by the .IN Registry and it was drafted as per\nthe WIPO Guidelines and vital provisions of the IT Act, 2000.<\/p>\n\n\n\n<p>Following\nare the two most important rules that all parties must study:<\/p>\n\n\n\n<ol><li><strong><em>INDRP Policy (.IN Dispute\nResolution Policy)<\/em><\/strong>: It offers different grounds\nfor the INDRP compliant filing and contains figures establishing those grounds\n&amp; the remedies available to the parties. <\/li><li><strong><em>Procedure Rules for the INDRP<\/em><\/strong>:\nThese procedure rules highlight how to file an INDRP compliant, reply to it,\nalong with prescribed fees, communications, and other procedures that will be\nfollowed. <\/li><\/ol>\n\n\n\n<p><strong><em>The\nDispute Resolution Procedure under the INDRP:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The Complainant file their\ncomplaint along with the relevant documents with NIXI in an online application\nform;<\/li><li>The complaint shouldn&#8217;t&nbsp; be more than 5000 words;<\/li><li>The hearings can be more than\ntwo;<\/li><li>The relevant documents or\nproofs shall not be more than 100 pages overall;<\/li><li>A <strong><em>POA (Power of Attorney)<\/em><\/strong>\nshall be submitted with the complaint either by the aggrieved party or its\napproved representative;<\/li><li>Within five days of compliant\nreceiving, the Registry shall appoint an arbitrator from its registered\narbitrators&#8217; list;<\/li><li>Personal hearings are performed\nonly at the request of either party or both parties. The private hearing comprises\nteleconferencing &amp; video conferencing;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difference_between_INDRP_Policy_and_URDP_Policy\"><\/span>Difference\nbetween INDRP Policy and URDP Policy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<table class=\"wp-block-table\"><tbody><tr><td>\n  <strong>INDRP\n  Policy<\/strong>\n  <\/td><td>\n  <strong>URDP\n  Policy<\/strong>\n  <\/td><\/tr><tr><td>\n  It appoints a single\n  arbitrator to manage the arbitration proceedings, \n  <\/td><td>\n  The UDRP allows for a\n  managerial panel of one to three panelists.\n  <\/td><\/tr><tr><td>\n  In <strong><em>Para 4 of the INDRP Policy<\/em><\/strong>,\n  you need to prove that the disputed domain has been registered <strong><em>OR<\/em><\/strong>\n  is being used in bad belief.\n  <\/td><td>\n  But, in <strong><em>Para 4 (a) of the UDRP Policy, <\/em><\/strong>you\n  need to prove that the name of the domain has been registered <strong><em>AND<\/em><\/strong>\n  is being used in bad faith.\n  <\/td><\/tr><tr><td>\n  A party to the process of\n  INDRP may ask for a personal hearing with the arbitrator to current arguments\n  to prove the merits of their case.\n  <\/td><td>\n  Whereas The UDRP doesn\u2019t have\n  such a provision.\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Now the world is changing, and it has become a digital world; businesses have moved online, and so have crimes &amp; disputes.
