However, with the roar of social media, there has been a requirement for an individual law to deal with Copyright on digital platforms. In this blog, we will discuss Safe Harbor Provisions under DMCA.<\/p>\n\n\n\n<p>Provisions\nof the DMCA <strong><em>(Digital Millennium Copyright Act)<\/em><\/strong> that protect an <strong><em>OSP\n(Online Service Provider)<\/em><\/strong> from Copyright Infringement liability depends\non the actions of their users where definite conditions are met. Safe Harbor is a provision of a regulation or statute that states\nthat certain conduct will be considered not to infringe a provided rule. It is\ngenerally found in association with a more vague, overall standard. By\ncontrast, \u201cunsafe harbours\u201d describe conduct that will be considered to infringe\nthe rule. The objective of Safe Harbor Provisions under DMCA is to make sure\nthat no one except the real infringer or violater should be asked to indemnify.<\/p>\n\n\n\n<p><strong><em>Following\nare four Safe Harbor Provisions under DMCA:<\/em><\/strong><\/p>\n\n\n\n<ol><li><strong><em>Transmission Safe Harbor<\/em><\/strong>:\nWhen violating material is sent by end-users or others, the violating material is\nrouted, connected or transmitted. Therefore, it safeguards OSPs (Online Service\nProviders), especially telecommunications companies or entities, from such liability.<\/li><li><strong><em>Caching Safe Harbor<\/em><\/strong>:\nIt protects the service provider from liability for storing violating material\nfrom a 3<sup>rd<\/sup> part on a network\/system administrated or controlled by\nor for the OSP.<\/li><li><strong><em>Storage Safe Harbor<\/em><\/strong>:\nThe material of the user that is directed to be made or kept available on the\nOSP&#8217;s website may be violating. This category comprises the majority of online\nservices &amp; websites. Therefore, it safeguards OSPs from the liability that\ncomes with it.<\/li><li><strong><em>Information Location Tools Safe\nHarbor<\/em><\/strong>: By using information locating tolls, you may\nbe responsible for linking or referring users to a digital location containing\nviolating material or conduct. Therefore, it safeguards the Online Service\nProviders (OSPs) from such liability.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_Criteria_for_Safe_Harbor_Provisions_under_DMCA\"><\/span>Eligibility Criteria for Safe Harbor Provisions under DMCA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nSafe Harbor options permit immunity against Copyright claims under the US Laws\nwhen the source of a likely threat to the Copyright protection is the conduct\nof the OSP Online Service Producer&#8217;s end users.<\/p>\n\n\n\n<p><strong><em>Therefore,\nthe Safe Harbor valve doesn\u2019t safeguard against:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The Online Service Provider\u2019s direct violating activities;<\/li><li>Non-Copyright Claims, like <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-infringement\" class=\"text-primary\">Trademark Infringement<\/a><\/strong>, rights of publicity, unfair competition, defamation, etc.<\/li><li>The Online Service Provide performing in concert with users to create infringements;<\/li><li>Copyright claims under foreign laws.<\/li><\/ul>\n\n\n\n<p>Although\nthe DMCA doesn&#8217;t provide legal protection against Non-Copyright claims or\nforeign, it is common for Online Service Providers to offer a DMCA like notice\nand a takedown regime for other IP claims and for concerns that might occur\nunder foreign law. Regardless of the regular submission of a massive number of take-down notices and counter-notices, this provision of the DMCA has not been able to bridge the gap between the Copyright Infringement of content on the internet and the cases reported.
