With the elimination of various Boards &amp; Appellate Tribunals by <strong><em>Tribunals Reforms (Rationalization &amp; Condition of Service) Ordinance 2021<\/em><\/strong>, which was issued by the Indian President and was informed on <strong><em>4<sup>th<\/sup> April 2021<\/em><\/strong>. To deal with the IP matters, the creation of IP division by the Delhi High Court has been taken place. The\nreason behind the creation of the appellate board was quicker delivery of\njustice &amp; reduction of dependence on High Courts, but the appellate board\nfailed as there were various cases pending in the appellate board &amp; it was\nfacing problems regarding the shortage of staff. Following this ordinance, all\nthe pending or in progress cases of the IPAB were subsequently transferred to\nthe High Courts. Because of this, the High Court of Delhi suggesting the creation\nof IP division.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objectives_behind_the_Creation_of_IP_division_by_Delhi_High_Court\"><\/span>Objectives\nbehind the Creation of IP division by Delhi High Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare the objectives behind the creation of IP division by the Delhi High Court:<\/em><\/strong><\/p>\n\n\n\n<ol><li>New IPR filing;<\/li><li>Cancellation and revocation of applications;<\/li><li>Appeals from the Trademark Registrar, Copyright Registrar, Controller of Patents;<\/li><li>Appellate Proceedings &amp; Original Proceedings;<\/li><li>Writ petitions;<\/li><li>FAO (First Appeal from Order);<\/li><li>RFA (Regular First Appeals);<\/li><li>Intellectual Property (IP) Disputes;<\/li><li>All other proceedings that were defendable before the erstwhile <strong><em>IPAB (Intellectual Property Appellate Board)<\/em><\/strong> under the Copyrights, Patents, Trademarks, and Designs Act.<\/li><\/ol>\n\n\n\n<p>The\nprimary aim behind the creation of IP division by the Delhi High Court for\nexpedite clearance of disputes concerning IPR. The High Court of Delhi has been\nformulating rules &amp; regulations for the newly created body IPAB.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_does_the_Creation_of_IP_Division_Impact_the_IP_Cases_in_India\"><\/span>How\ndoes the Creation of IP Division Impact the IP Cases in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>High Courts in India naturally\ncarry higher worth than any other tribunal, so converting the IPAB to an\nextension inside the High Court of Delhi would significantly increase the\nsignificance of IP in India. The decisions given by the extension wing of a\nHigh Court shall clearly have an advantage, and higher significance as\nprecedents in future and due to the technical expertise of judges&#8217;\ndependability on those decisions would increase exponentially.<\/li><li>The IPAB&#8217;s problems were the\nlack of staff and non-appointment of the chairperson, which would hardly to a problem\nin any High Court;<\/li><li>This new IP dispute settlement\nwould outcome in a more consistent and efficient Intellectual Property\nredressal &amp; other High Courts would finally follow the same method. This is\nbecause most cases of the IPAB was appealed to the High Court of Delhi, so they\ncarry the required experience to deal with the IP disputes, and with the\nadoption of similar mechanisms by other High Courts, specialised bodies will\nsprout within the courts that will have proficiency in IP problems as they would\neven make something identical to <strong><em>Delhi High Court rules governing Patent\nCases, 2020 <\/em><\/strong>which would advise them as it would do in the case of Delhi\nHC.<\/li><li>There might be candidates or\nPatent owners who would have to wait for more, in other terms, waste their\nexploitation right (in case of Patents on the majority basis \u2013 time is less\nthan twenty years with two or three years wasted already on achieving\nregistration) being decreased as they have to wait &amp; lose more years for\nthe IP division to work on their fullest extent;<\/li><li>Since the IP division is an\nextension of the High Court, there would be higher litigation expenditure by\nthe candidates;<\/li><li>There will be an intended\napproach made by the judges who have technical expertise (as it is needed in\ncase of dealing Patent cases) and have faced IP problems earlier. This shall\nresult in consistent, streamlined, and predictable decisions. This new system\nwould abolish such confusion and would give several exposures to IP disputes.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Measures_Taken_BY_IPAB\"><\/span>Different\nMeasures Taken BY IPAB<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The judges\u2019 tenure should be\nextended and kept for longer periods so that they could create the required\ntechnical proficiency in any IP subject matter;<\/li><li>Because of the huge obeyance of\ncases, there are possibilities that candidates might have totally lost interest\nin their subject matters. So fixed time durations should be made for completing\nthe promises made before the court. This should be done specially for cases\nthat have been pending in the IPAB for more than one year. There must be a\ndiscouragement for any postponement should be considered;<\/li><li>Increase the number of judges\nin the IP division for swift justice.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion\n<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing the reason and impact of the creation of IP division by the Delhi High Court, it is concluded that constant delays were a big reason for scrapping the IPAB, but now, when it is added to the High Court, it may lead to more long delays which may defeat the objective of this current High Court order. IP owners would have to bear with issues as due to this, there might be a shortage of time for exploitation of their IP rights.
