Along with removing or deleting the content, they are supposed to take an online fingerprint of it and collect the same in their system so that the content wouldn&#8217;t be posted again until &amp; unless the dispute has been resolved. According to the Copyright Law, Takedown Notice should comprise various elements, and if the elements are missing, then the service provider has the authority to refuse to take down the content violating the Copyright of the owner or holder.<\/p>\n\n\n\n<p>In\nthe United States of America (USA), laws governing Takedown Notices are\nmentioned under the <strong><em>DMCA, 1998 (Digital Millennium Copyright Act). <\/em><\/strong>The law provides\nstrict punishment for Copyright Infringement and provides immunity to digital\nservice providers and <strong><em>ISPs (Internet Service Providers)<\/em><\/strong>\nlisted &amp; located in the United States of America, such as YouTube, in the\ncase of Copyright Infringement. Earlier, India didn\u2019t have any particular law\nproviding Takedown Notice for Copyright Infringement; it had only penalties for\nCopyright Infringement. However, due to increasing Copyright Infringements,\nIndia has begun issuing such notices to intermediaries who violate the\nCopyright of the owners.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Use_of_Takedown_Services_for_Copyright_Protection\"><\/span>What is\nthe Use of Takedown Services for Copyright Protection?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In\nprogress, Copyright Violations have led Copyright owners to use Takedown\nServices for Copyright Protection and protect their original content from being\nuploaded illegally. The use of Takedown Services for Copyright Protection is to\ninform ISPs that a concerned website has shown its content without their\nknowledge, thus violating the rights of the owners. The takedown notices are\nalso used to prevent access to any hateful, illegal, and abusive content\npublished on digital platforms. So, to ensure that such derogatory and unlawful\ncontent is not published by the people, the law has established a complaint\nredressal system that put intermediaries under an obligation to execute enough\nDue Diligence. <\/p>\n\n\n\n<p>Many\ndigital platforms give access to their users or any Copyright holder to raise\ncomplaints directly without any process concerning Copyright Violation with the\nplatforms, which help in taking down any content infringing the Copyright owner&#8217;s\nrights. Some even go to the extent of penalising the individual who published\nthe violating content by limiting their access to the relevant platform.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_to_File_a_Takedown_Notice_in_India\"><\/span>Process\nto File a Takedown Notice in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under <strong><em>Section 52 (1)(c) of the Copyright Act, 1957<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup>, an owner or holder of Copyright is required to issue a notice to the intermediary whose website displays or allows access to infringed or pirated content. <strong><em>Rule 75 of the Copyright Rules<\/em><\/strong> lays down the fundamentals of takedown and the process of providing the same. The following should be remembered while drafting the Takedown Notice:<\/p>\n\n\n\n<ol><li>The description should be\nenough to recognise the work. There are many similar contents released on the\ninternet every day, so the description must be definite and not unclear in order\nto stand out. A Copyright protected material should be clearly recognised on\nwebsites such as Facebook or YouTube before it may be removed.<\/li><li>Copy of the work is brief or\nextra storage should be a violating copy owned by the complainant, and it\nshouldn&#8217;t be mentioned under Section 52 or any other Section under the Act.<\/li><li>Person\u2019s information who\ncommits the crime by uploading the owner\u2019s content by violating their\nCopyright.<\/li><li>Details refer that the\ncomplainant is the only Copyright owner of the work. As a licensee, the\ncomplaint should comprise a license agreement copy along with the Copyright\nTakedown Notice.<\/li><li>Location of all details where\nthe work is stored. The notification of Copyright Takedown should provide a URL\nor link to the infringing work. If a website has a link or URL, its server can\nremove it quickly.<\/li><li>Undertaking that the\ncomplainant files an infringement case in the suitable court against the\nindividual who is accountable for releasing the violated content or work along\nwith producing orders of the court having jurisdiction within 21 days from the\nreceipt date of the notice.<\/li><\/ol>\n\n\n\n<p>In\nIndia, the notice must only be sent after the Copyright owner talks with a\nCopyright lawyer to entirely know the legal procedure and ensure that a robust\ncase is presented that doesn&#8217;t come under Section 52 of the Copyright Act.<\/p>\n\n\n\n<p>Moreover,\nthe Copyright Rules also lays down that as the receipt of the complaint is\nreceived by the individual accountable for the storage of the violated copy of\nthe original work, he is directed to remove the violated content within 36\nhours and has to take vital measures to avoid access for the same for 21 days\nfrom the receipt date of the complaint or till they receive an order\nrestraining them from giving access from the suitable court, whichever is\nfirst.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_Study_%E2%80%93_Takedown_Services_for_Copyright_Protection\"><\/span>Case\nStudy \u2013 Takedown Services for Copyright Protection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare some famous examples of Takedown services for Copyright Protection:<\/em><\/strong><\/p>\n\n\n\n<ol><li><strong><em>Union of India vs Shreya\nSinghal: <\/em><\/strong>In this case, one of the issues before the\nSupreme Court was that whether Section 19 of the Information Technology Act is\nconstitutionally valid for or not vis-a-vis <strong><em>Article 19 of the Constitution. <\/em><\/strong>The\ncourt was of a view that if the provisions of the Section are intermediaries,\nmet are rejected from liability. By going through Section 79 (3)(b) and Rule 3\nto hold that the knowledge mentioned in this Section should be attained\nexclusively via the method of a government agency or court order.<\/li><li><strong><em>Swami Ramdev vs Facebook, Inc.\nand Others<\/em><\/strong>: In this matter, defendants Facebook,\nGoogle, Twitter, and YouTube were ordered to remove URLs list from their\nrelevant platforms that were allegedly derogatory to the plaintiffs. The\nproposal was taken by Swami Ramdev, stating that defamatory content &amp; videos\nconcerning the book called &#8220;Godman to Tycoon&#8221; were posted on the\ndefendant&#8217;s platform. It was held by the Delhi HC (High Court) after\nconsidering the law on intermediary liability under the IT Act, 2000 and IT\nRules, 2011 that the intermediates are directed to take down &amp; block all\nsuch illegal content &amp; videos uploaded on their platform from IP address in\nIndia. For the content published outside India, they were directed to use\ngeo-blocking tools &amp; stop content viewership.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"IT_Rules_on_Takedown_Services_for_Copyright_Protection\"><\/span>IT\nRules on Takedown Services for Copyright Protection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In\nFebruary 2021, the Government introduced <strong><em>the IT (Intermediary Guidelines &amp;\nDigital Media Ethics Code) Rules, 2021<\/em><\/strong>. These IT Rules provides for\napplicable due diligence by an intermediary. Accordingly, the intermediary is\nrequired to circulate rules &amp; regulations, user agreement, or privacy\npolicy to notify their users not to show, change, transit, host, upload any\ninformation which results in violation of any Copyright, Trademark, Patent or\nany other IPR (Intellectual Property Rules).<\/p>\n\n\n\n<p>Moreover,\nthese rules provide the manner in which the intermediary has to obey Takedown\nnotice. It follows that when a mediator or intermediary receives a court&#8217;s\norder or is informed by the relevant Government or their agency regarding\nviolating content, it shall not host, publish, or store any illegal details\nprohibited under any law. It also furnishes for a complaint redressal mechanism\nto establish by the mediator. The intermediary or mediator is required to\nappoint a Grievance Officer who will receive all grievances against the rules\nviolation. The officer is required to admit the complaint within specified\ntimelines and arrange such a complaint within 15 days.<\/p>\n\n\n\n<p>However,\nas far as the Takedown Services for Copyright Protection are concerned, the new\nIT Rules have given a chance to the creators in case of any violation they can\ndirectly register their complaint with the officer with timely disposal of the\nsame.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After discussing the importance of Takedown Services for Copyright Protection, we can conclude that Section 52 (1)(c) of the Copyright Act gives the owner the exclusive right to issue a Takedown Notice to digital platforms ordering them to remove violated content from their website quickly. Earlier the intermediary&#8217;s liability towards the Copyright owners was secondary and was not liable for the same if the court&#8217;s order was not followed.
