class=\"text-primary\"><strong>design registration in India<\/strong><\/a>, any natural person, legal representative, or assignee can apply for the registration of design individually or collectively. The term \u201cperson\u201d encompasses a company, a partnership, a minor business, and a corporation. An application can also be submitted through an agent, in which case a power of attorney must be submitted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_that_are_needed_for_the_Procedure_for_Design_Registration_in_India\"><\/span>Documents that are needed for\nthe Procedure for Design Registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Documents\nthat are required to fulfil the procedure for Design Registration in India\nfollows:<\/p>\n\n\n\n<ul><li>A duly well-certified copy of the\noriginal\/certified copies of the extracts from all disclaimers;<\/li><li>All affidavits are required for the\nregistration;<\/li><li>Proper declarations;<\/li><li>Any other public document can be made available\non a payment of the fee;<\/li><li>One should make sure to file the affidavit in\nparagraph form. It shall include a declaration of truth and verifiability. As\nper the 4th schedule, the controller regulates the costs involved in the\nregistration process.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_Procedure_for_Design_Registration_in_India\"><\/span>Application Procedure for\nDesign Registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Below\nare the steps for submission of the application in respect of the procedure for\ndesign registration in India:<\/p>\n\n\n\n<p><strong><em>Step 1:<\/em><\/strong> Application\nfor registration of the design should be filled in on the prescribed form\n\u201cForm-1\u201d along with the prescribed fees.<\/p>\n\n\n\n<p><strong><em>Step 2-:\n<\/em><\/strong>Full\nname of the applicant, address and nationality of the applicant. Name of the\narticle to which design is applied.&nbsp; The\nclass and sub-class of the article under the Locarno Classification embody the\ndesign.<\/p>\n\n\n\n<p><strong><em>Step 3:<\/em><\/strong> The\napplication for the registration of design should be signed either by the\napplicant or by his authorized agent, but For a small entity, Form 24 &amp; documentary\nevidence thereof need to be submitted along with Form 1. The application shall\nbe submitted in four copies, all alike on durable paper of size 210mm x 296.9\nmm with a suitable margin of the article where drawings, photographs, tracings\nor other representations, including computer graphics, should clearly show the\nfeatures of the design from different views.<\/p>\n\n\n\n<p><strong><em>Step 4:<\/em><\/strong> &nbsp;A declaration of novelty and disclaimer (if\nany) in respect of mechanical action, trademark, word, letter, numerals should\nbe endorsed on each representation sheet which should be duly signed and dated.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Examination_and_Approval_of_the_Application\"><\/span>Examination and Approval of the\nApplication <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Procedure\nfor Design Registration in India commences when Each application for the\nregistration of a design shall undergo the examination; however, acts and rules\nare amended from time to time. The design application shall be examined in the\norder in which the same application is filed under section-5 and section-44 of\nthe design act 2000. During the examination of the application for the\nregistration of the design, if any defect and objections are noticed in the\naforesaid application, a communication shall be made to the applicant or his\nagent at the address of service in respect of the defect and objection. The\ntime period of six months shall be given to the applicant for the removal of\ndefects and objections from the application, which may be extended up to a\nfurther three months in case of a request made by the applicant by paying the prescribed\nfee before the expiration of the stipulated time period of six months. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Acceptance_and_notification\"><\/span>Acceptance and notification <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A\ndesign application is said to be accepted when all the defects and flaws have\nbeen rectified by the authority. It is then notified in the patent office\njournal, which is published every Friday. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Publication_of_registered_design\"><\/span>Publication of registered\ndesign<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The controller, after the registration of a design, shall\npublish the particulars of the design in the manner as prescribed &amp;\nthereafter, the design shall be open to public inspection.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Refusal_of_the_application_of_design\"><\/span>Refusal of the application of\ndesign <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If the\nflaws specified by the controller are not corrected, the applicant will be\ngiven a hearing. The controller will decide whether or not to accept the\napplication after hearing it. Further, the decision of the controller shall be\ncommunicated to the applicant or his agent, stating the reasons for the decision.\n<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Appeal_against_the_decision_of_the_controller\"><\/span>Appeal against the decision of\nthe controller<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The aggrieved\nperson can appeal against the decision of the controller refusing to register a\ndesign to the High court within three months from the date of the decision of\nthe controller. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Duration_and_Validity\"><\/span>Duration and Validity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nvalidity and duration of the design shall be of 10 years, and it can be further\nextended to the next five years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Design is the exclusive right of the proprietor, and it shall be valid for 10 years and can be extended to a further 5 years.
