The\nSupreme court offered a broader view of Trademark usage, saying that it might\nbe<\/p>\n\n\n\n<p>non-physical and that there\nwas no reason to restrict the user&#8217;s ability to use the Trademark on goods or\nsell goods carrying the brand.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_registration_process_of_the_Trademark\"><\/span>The registration process of the Trademark<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Step-1<\/strong>&nbsp;An application for <a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\"><strong>Trademark Registration<\/strong><\/a> is supposed to be submitted to the Trademark Office, then the preliminary scrutinization of the Trademark would begin. This is to assess the genuineness and accuracy of the factual details.&nbsp;<\/p>\n\n\n\n<p><strong>Step-2<\/strong>&nbsp;After the receipt of\nthe Trademark application, the registrar shall publish the owner&#8217;s mark, sign,\nand other Trademark works. It means the printing of<\/p>\n\n\n\n<p>Trademark name symbols and\nboth in the Trademark journal.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Step-3<\/strong>&nbsp;At this point, the Trademarked\nname or logo, or both, has been published in the Trademark Journal, inviting\nany objections.&nbsp;<\/p>\n\n\n\n<p><strong>Step-4<\/strong>&nbsp;&nbsp; If in case there is no more objections or\noppositions to the mark are received, the application is approved. Then it\nwould be labelled &#8216;Registered.&#8217; When the Trademark applicants may start\nutilizing the Trademark sign next to the logo or name, the application is\ncomplete.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_a_Trademark\"><\/span>Validity of a Trademark<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, the validity of a\nTrademark is granted for ten years from the date of registration of the Trademark\nshown on the certificate. The conditions are- <\/p>\n\n\n\n<ul><li>When the applicant wants to commence a business and subsequently\nregister it under the Companies Act, as a result, non-use while waiting for the\nTrademark to be assigned to that firm is acceptable.<\/li><li>The mark&#8217;s owner wants for it to be used by someone else. As a\nresult, if you&#8217;re waiting for the Trademark to be registered in the name of\nsomeone else, you won&#8217;t be able to remove it.<\/li><li>In Special commercial conditions \u2014 If the non-utilization of a Trademark\nis not due to a mistake\/omission on the part of the owner, but rather to\nunanticipated circumstances. For example, any legislation or regulation that\nplaces limits on the use of a specific brand. Some businesses may need to wait\nfor international or domestic permissions as well. As a result, they may have a\nreason to utilize the mark in the interim.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Limitation_on_the_ground_of_Non-use_of_Trademark\"><\/span>Limitation on the ground of Non-use of Trademark&nbsp; <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em><strong>Section 47<\/strong><\/em>&nbsp;of the <strong>Trademark act, 1999<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Indian_trademark_law\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> implies that once the Trademark is registered, it can be removed upon the application filed before the concerned body for its removal on the following grounds:-&nbsp; <\/p>\n\n\n\n<ul><li><em><strong>Invalid Intention to use the Trademark<\/strong><\/em>&#8211; an application for the\nremoval of the Trademark can be made by any person against the owner of the Trademark\nif he has reason to believe that the proprietor of the Trademark does not have\nthe valid Intention to use it. &nbsp;Moreover,\nthere should have been no bona fide use of the Trademark concerning such\nproducts or services for the previous three months before filing the\napplication under this section.<\/li><li><em><strong>No use of registered Trademark more than five years of its\nvalidity<\/strong><\/em>&#8211;\nIf a registered Trademark has not been utilized concerning such products or services\nfor a continuous period of five years or more can be withdrawn from the\nregister.&nbsp;<\/li><\/ul>\n\n\n\n<p>In the matter of&nbsp;<em><strong>Kabushiki Kaisha Toshiba v. TOSHIBA<\/strong><\/em>\n<em><strong>Appliances<\/strong><\/em><strong>&nbsp;in 2008, the validity of a Trademark\nwas examined by the court, and <\/strong>it was upheld that the desire to\nuse a Trademark that is being considered for registration must be bonafide and\nauthentic.&#8221; &#8220;When a Trademark is registered, it grants a significant\nright,&#8221; the division bench continued. It aims to differentiate between\nitems produced by one person and those created by another. As a result, a\nperson who does not intend to use the Trademark in good faith is unlikely to\nget his goods registered to prevent others from doing so.&#8221; Advertising\nwithout actually promoting any products or services does not qualify as bona\nfife use of the Trademark for this provision. The use of a registered Trademark\nover the internet or on a website may, in some cases, be considered legitimate\nusage. However, an online proposal for goods or services is legal provided it\nis accompanied by the capacity to supply the products or services in\nIndia.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>We conclude that<strong>&nbsp;<\/strong>a Trademark can be utilized and registered by the owner in their name so that the government can protect their Trademark.
