Since the&nbsp;<strong><em>Designarch\nConsultants Private Limited<\/em><\/strong>&nbsp;is claiming that they have \u201c<em>Burj<\/em>\u201d\nas its flagship hotel. However, Justice Jayant Nath allowed the use of the Trademark\n\u201cBurj\u201d for an ongoing project which has been under construction for the last\nten years in India. The Court has stated in its order that \u201cAn injunction order\nhas been passed in favor of the plaintiff and against the defendants,\npreventing the defendants, among others, from using the trademarks like\nBurjbangalore, Burjmumbai, Burjdelhi, Burjgurugram, and Burjgurgaon, or any\nother similar trademark, Till the pendency of current Lawsuit. Trademark can be recognized as a phrase, logo, slogans, bands, symbols, etc. The trademark shall be valid for 10 years from the date of its registration. Trademark is the recognition of your good and services; Trademark shall provide Legal protection to your interest and services from infringement and helps you to guard against counterfeiting and fraud.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Facts_and_Analysis_of_the_Conflict_on_Using_Trademark_%E2%80%9CBurj%E2%80%9D\"><\/span>Facts and Analysis of the Conflict on Using Trademark\n\u201cBurj\u201d&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The High Court of Delhi,\nconsidering the Conflict on using Trademark \u201cBurj\u201d expressed its views by\npassing an injunction against&nbsp;<strong><em>Designarch Consultants Private\nLimited&nbsp;<\/em><\/strong>and instigating others also not to use the Trademark\n\u201cBurj\u201d in future projects as long as the Mark \u201cBurj\u201d is the monopoly of the\nhotel chain&nbsp;<strong><em>Jumeirah beach resort LLC<\/em><\/strong>. Although, According\nto the Court, Jumeirah beach resort LLC does not have a monopoly on the\ntrademark over the commodities or class of goods it does not operate. It went\non to say that the plaintiff&#8217;s registration and use of the composite mark\n&#8220;Burj Al Arab&#8221; did not grant it a right to the word &#8220;Burj&#8221;\nin and of itself. However, the High Court dismissed the contention while\nconsidering the precedent M\/S South India Beverages Pvt Ltd. Vs. General Mills\nMarketing Inc. &amp; Anr. division bench held that the principle \u201c anti\ndissection\u201d The scrutinization of the constituent elements of a composite mark\nis not subject to an absolute embargo. The Court did, however, take note of the\ndefendants&#8217; claim to have been in the company for the last ten years in terms\nof the mark \u201cBURJNOIDA.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_study\"><\/span>Case study<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li><strong>JUMEIRAH BEACH RESORT LLC Vs. DESIGNARCH CONSULTANTS PVT LTD &amp; ANR\u00a0<\/strong><\/li><\/ul>\n\n\n\n<p><strong><em>Issues-<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<ol><li>Whether the similarities between the plaintiff&#8217;s and defendant&#8217;s marks are so \u00a0\u00a0close visually, phonetically, or otherwise<\/li><li>Whether a temporary injunction should be granted.<\/li><\/ol>\n\n\n\n<p><strong><em>Judgment-&nbsp;<\/em><\/strong>The High Court of Delhi passed the ruling while considering the Conflict on using Trademark \u201cBurj\u201d. So, Court held thatthe plaintiff&#8217;s trademark rights were violated and the defendants are not restricted from utilizing the trademark \u201cBURJNOIDA\u201d for the residential project. Although, Defendant is not permitted to create any new projects using the Trademark \u201cBurj.\u201d in future. The defendants are only entitled to use the mark \u201cBURJNOIDA\u201d for the current project. An injunction order is issued in favor of the plaintiff and against the defendants, barring the defendants from using the Trademarks BURJBANGALORE, BURJMUMBAI, BURJDELHI, BURJGURUGRAM, and BURJGURGAON, or any other similar <a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\"><strong>Trademark<\/strong><\/a><strong>,<\/strong> though the case is pending in court.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_Conclusion\"><\/span>&nbsp;Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>We conclude that the High Court of Delhi expressed its views on the Conflict on Using Trademark \u201cBurj\u201d between the plaintiff and defendants.\u00a0<strong><em>JUMEIRAH BEACH RESORT LLC Vs. DESIGNARCH CONSULTANTS PVT LTD &amp; ANR.\u00a0<\/em><\/strong>The Courtallowed Defendant to use the trademark \u201cBurj\u201d for an ongoing project which has been under construction for the last ten years in India.
