An inventor can file applications of multiple Patents in\nmultiple countries for the same invention, but not in the same country. The\nissuance of Double Patenting arises when there are two or more pending Patent\napplications for the same invention. If an applicant or inventor submits the 1<sup>st<\/sup>\nPatent application on a particular date (ABC) and another Patent application (2<sup>nd<\/sup>\napplication) for the same invention on date XYZ. Then the 2<sup>nd<\/sup>\napplication would be deemed a Double Patent, and the Patent will not be\nextended for the 2<sup>nd<\/sup> filing of the Patent application. Double\nPatenting problems can arise only if the second application is published or a\nPatent has been issued or granted.<\/p>\n\n\n\n<p>Through\na Patent, an inventor or applicant informs the public regarding the essential\ninvention. A Patent primarily states the invention&#8217;s nature, the validity of\nright and the ID of its owner. An inventor cannot be granted two Patents for\none invention. The Patent itself is only an inventor&#8217;s right that too for a\nlimited period of ten years. As soon as the Patent expires, the invention will\nbe available for the general public. Numerous applications for one Patent could\nresult in infringement. In most Patent systems internationally, Double\nPatenting is impermissible. The only\ncondition required is common ownership. If it exists, then there will be a case\nof Double Patenting or an attempt to do the same.<\/li><li><strong><em>Claimed Subject Matter<\/em><\/strong>:\nPatent Laws avoid prolonging Patent Rights that are against the law. Double\nPatenting arises if similar or identical claims are there.<\/li><li><strong><em>Other Patent applications\nshould be Granted or Pending<\/em><\/strong>: Conflict of claims or\nDouble Patent can arise only when the other application is published or alive\nor granted a Patent.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Double_Patenting_in_India\"><\/span>Double\nPatenting in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, there is such a provision stating the invalidity of Double Patenting. But, it can be concluded from <strong><em>Section 46(2) of the Patents Act, 1970<\/em><\/strong>. The said provision states that only one Patent can be granted for a single invention. However, an objection of Double Patenting may be raised in the case of a Patent application claiming a similar invention as in another Patent by the same applicant, even if the effective date of application filing under consideration is earlier than that Patent. For instance, in cases where a later-filed application gets granted before the earlier-filed application, an objection of claims with a similar scope may be raised at the time of prosecution of the earlier-filed <a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\"><strong>Patent registration<\/strong><\/a> application.<\/p>\n\n\n\n<p><strong><em>Section\n46(2), Section 16, Clause 5.2, and Section 13(1)(b) Indian Patent Act, 1970<\/em><\/strong>\nrelates to prior claiming if two applications claim the same invention by the\nsimilar applicant, even if the date of filing is different, it will be the\nmatter of Double Patenting.<\/p>\n\n\n\n<p><strong><em>Clause\n5.2:<\/em><\/strong><\/p>\n\n\n\n<ul><li>An earlier claiming document search will be with the inventor&#8217;s name\/applicant&#8217;s name, or both. So it is better to avoid patenting;<\/li><li><strong><em>In the search report, the examiner includes:<\/em><\/strong><\/li><li>The application number;<\/li><li>The <strong>Patent Classification<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Patent_classification\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> (IPC);<\/li><li>The relevant mentions their number &amp; date of publication, and other information.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Terminal_Disclaimer\"><\/span>Terminal\nDisclaimer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There\nare 2 different types of Double Patenting in the United States of America (USA)\none is Statutory, and the second is Non-Statutory or obvious. Filing a Terminal\nDisclaimer is a method to overcome a Patenting rejection in case of or\nNon-Statutory Patenting. It says that the second Patent application expires at\nthe same time when the first Patent will be feasible. It is relevant only if\nboth applications are similar or identical.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPO_Conclusions\"><\/span>EPO Conclusions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\noutline of the EPO conclusions for the prohibition of Patenting with referral\nto the increased board of appeal is as follows:<\/em><\/strong><\/p>\n\n\n\n<ul><li>There is no forthcoming\nprovision in the <strong><em>European Patent Convention (EPC)<\/em><\/strong> that disallows Double\nPatenting;<\/li><li>It is not obvious whether the\nPatenting bar is a part of the convention or not;<\/li><li>Both <strong><em>Article 76(1) EPC &amp; Article\n63(1) EPC<\/em><\/strong> don\u2019t have scope for the Patenting counter;<\/li><li>There was no amendment in <strong><em>Article\n139(3) EPC<\/em><\/strong>;<\/li><li><strong><em>Article 60(1) EPC<\/em><\/strong>\nis not the foundation of Patenting;<\/li><li><strong><em>Article 125 EPC<\/em><\/strong>\ncannot initiate a new ground of refusal for a bar on Patenting &amp; others.<\/li><\/ul>\n\n\n\n<p>Hence,\nthe matter of Double Patenting is entirely left to National Law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>India has attracted worldwide attention with the constant development of its IPR (Intellectual Property Rights) system.
