But, because\ndevices &amp; drugs must undergo a prolonged review process at the <strong><em>FDA\n(Federal Drug Administration)<\/em><\/strong> before commercial use\/launch, related\nPatent is filed long before FDA consent. Patent Term Extension is designed to\nrestore some of the Patent terms \u201clost\u201d during the Federal Drug Administration\nreview process.<\/p>\n\n\n\n<p>The Patent Term can be prolonged for a maximum of five years, only if the extension will not cause a Patent Term to extend for more than fourteen years which is a total remaining Patent Term. These fourteen years are restrained by the date the pharmaceutical product receives regulatory consent for the expiration of the Patent. The Patent Term Extension has only been granted from the actual expiry date of <a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\"><strong>Patent Registration<\/strong><\/a>, including <strong><em>Patent Term Adjustment (PTA)<\/em><\/strong>. In the case where an incurable disclaimer is filed, the extension of the Patent Term is measured from the expiry date to the disclaimer date, not from the date the Patent expires in the nonexistence of a terminal disclaimer. The Indian Government first brought up the\nsuggestion for Patent Term Extension in the situation of the 2<sup>nd<\/sup>\ncommittee appointed on the direction of the <strong><em>Hon\u2019ble Delhi High Court in the\nNitto Denko case<\/em><\/strong> \u2013 the primary purpose of considering PTE for the time\nbeing lost in Patent application processing. The committee concluded that the\ntwenty-year Patent Term that was originally provided for 7 or 14 years was\ndelayed, and nothing prevents the inventor or applicant from taking steps for\nregulatory approval\/consent and commercialisation while the Patent application\nis pending.
