India also became a signatory to many global\ndeclarations, which strengthened its Patent Laws, and a particularly\nsignificant step was becoming a member of the TRIPS system.<\/p>\n\n\n\n<p>Divisional\nPatent Application describes applications filed after the&nbsp; Patent application because of the multiple\ninventions being mentioned. The Divisional Patent Application ensures that the\nmultiple inventions of the inventor are safeguarded separately. In this manner,\nthe objections raised for the Patent report are also resolved in a correct\nmanner. This safeguards the interest of the inventor. When you file an\napplication with multiple inventions mentioned in it, the application will\nresult in a lack of unity or consistency. In this matter, separate applications\nhave to be filed, which will comprise inventions apart from the first one\nmentioned. The actual application will become the parent application of a\nPatent. The Divisional Patent Applications are considered as filed at the same\ntime as parent applications, i.e., they get the same filing date. They can also\nclaim the same priority.<\/p>\n\n\n\n<p><strong><em>Section 16 of the Patent Act, 1970<\/em><\/strong><sup><a href=\"https:\/\/legislative.gov.in\/actsofparliamentfromtheyear\/patents-act-1970\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup><strong><em> <\/em><\/strong>includes the provision for part of applications in India. This provision gives that such a claim for extra application should have been laid down in the complete specification concerning the first application. Moreover, it also states that such additional applications should be made with a full specification that shouldn&#8217;t have anything other than what was stated in the actual application. Such an application can be filed by the inventor if he or she desires so or if any objection is uplifted because of the full specification concerning more than one invention. <\/p>\n\n\n\n<p>There\nis a clear necessity of difference between inventions in the same applications\nstated, and <strong><em>Section 10(5)<\/em><\/strong> confirms the same. According to Section 16(3), it\nis vital that the claims mentioned in the full specifications of the Divisional\nPatent Application should be dissimilar from that of the other as in India; a\nclaim for the same invention is not permitted. The Controller has the power to\ncheck this.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Conditions_for_Filing_Divisional_Patent_Applications\"><\/span>What are the\nConditions for Filing Divisional Patent Applications?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following\nare the conditions for filing Divisional Patent Applications:<\/em><\/strong><\/p>\n\n\n\n<ol><li>If the applicant utters a wish\nto do so, or;<\/li><li>In order to deal with the issue\nexpressed by the Controller.<\/li><\/ol>\n\n\n\n<p>Therefore,\nthe claims sought to be separated from the parent Patent application and\nregistered in the Divisional Patent Application must be based on the matter\nrevealed in the provisional specification already filed in relation to the 1st\nstated application, i.e., &#8220;if the invention&#8217;s claims revealed in one\nPatent application do not relate to a single invention or to a group of the\ninventions creating a single inventive concept, the candidate can file a\nfurther application as Divisional Application out of that application either of\ntheir own or when the Controller raises the objection of claiming more than one\ninvention. <\/p>\n\n\n\n<p>Moreover,\nwhere any overlapping of the claims in the patent application with the\nDivisional Application is viewed, the Controller may seek the changes in the\nprovisional specification of the Divisional Application to confirm that there\nis no overlapping of claims between these applications. The later application\nshouldn&#8217;t comprise any claim that is already claimed in the parent application\nshouldn&#8217;t comprise any matter not revealed in substance in the provisional\nspecification of the Patent application.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Divisional_Patent_Application_be_filed_at_any_time\"><\/span>Can a\nDivisional Patent Application be filed at any time?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>Indian Patent Act <\/em><\/strong>(IPA) states that an individual who has filed a Patent application under the Indian Patent Act may, at any time before the issuance of the <a href=\"https:\/\/swaritadvisors.com\/patent-registration\" class=\"text-primary\"><strong>Patent Registration<\/strong><\/a>, file a further application regarding an invention revealed in the provisional specification already filed in respect of the first application, if he or she so desires, or to remedy the objection uplifted by the Controller on the level that the claims of the provisional specification relate to more than one invention.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Outcome_of_Filing_a_Divisional_Patent_Application\"><\/span>Outcome of\nFiling a Divisional Patent Application<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nDivisional Application and the provisional specification accompanying it are\nconsidered to have been filed on the same date as the Patent application &amp;\nthe additional application is regarded as a substantive application and\ninspected when the request for inspection is filed within the specified term. The\nPatent granted on a Divisional Application has a time period of <strong><em>twenty\nyears<\/em><\/strong> from the filing date of the parent patent application.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evaluation_in_Case_of_Claims_in_the_Application_Involve_Multiple_Distinct_Inventions\"><\/span>Evaluation in\nCase of Claims in the Application Involve Multiple Distinct Inventions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Now\nwe all understand that there has to be a variety in inventions to file\nDivisional Patent Applications. Most of the time, the Controller objects to the\nfiling of such an application, specifying either that the application didn\u2019t\ninclude multiple inventions or that the claims can be covered under the parent\napplication &amp; hence there was no need for the division. Hence, there is\nhave to correctly outline when it can be said that there is a variety of\ninventions so that the correct Divisional Application of a Patent can be filed.\nFor this case, in the <strong><em>Esco Corporation<\/em><\/strong> case, it was seen\nby the Appellate Board that accordingly&nbsp;\nSection 7 of the Patents Act 1970, every application of Patent has to be\nfiled for one invention. Hence, a single inventive concept is only permitted\nper application as per the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To wind up, the current process by Controllers to assess if the claims of Divisional Patent Application find their origins in the parent application is only comparing words, which is not too effective. Nowadays, the Divisional Application has become a tool to mislead the authorities.
