India, as a\nmember of <strong><em>the WTO (World Trade Organisation)<\/em><\/strong>, performed the <strong><em>Geographical\nIndications of Goods (Registration &amp; Protection) Act, 1999<\/em><\/strong>, from\nSeptember 15, 2003.<\/p>\n\n\n\n<p>Like\nall IPRs, a Geographical Indication is a non-physical asset that creates a\nlegal claim to future benefits through the exclusive rights and privileges\nattached to it. The Geographical Indication products are usually\nagricultural\/manufactured\/natural items like handicrafts etc. It\u2019s an\nindication\/symbol to recognise a specific product. GIs are an essential part of\nthe development which advances economic interests. These Geographical\nIndication Tags are a tool to safeguard the ownership rights on natural\nresources &amp; manufactured goods. Geographical Indications cannot be rented,\nsold, transferred as they are jointly owned by the state. Products having\nGeographical Indication Tags or GI Tags prevent the illegal use of products\n&amp; improve financial gain to the producers by exporting the products.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_is_a_Geographical_Indication_Tag_issued_in_India\"><\/span>How is a\nGeographical Indication Tag issued in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nGeographical Indication Tag or GI Tag is issued as per the <strong><em>Geographical Indications of Goods\n(Registration &amp; Protection) Act, 1999. <\/em><\/strong>The application for\nGeographical Indication (GI) is open to all the producers of products or an\norganisation. The application must comprise the geographical map of the region\nor area in the country where the products are manufactured and the goods&#8217; class\nto which it shall apply. It must be in the prescribed form, and a specific fee\nmust be submitted with a signature.<\/p>\n\n\n\n<p>The application will be examined by groups of authorities. It is obligatory to obtain a Geographical Indication registered to claim any rights concerning such indication. A product having a GI Tag prevents illegal use of products and improves financial profit to the producers by exporting the products.&nbsp; A Geographical Indication product price increases in the global market as the exports increase. <strong><em>Section 21 of the Geographical Indication Act <\/em><\/strong>states that <a href=\"https:\/\/swaritadvisors.com\/registration-of-geographical-indication\" class=\"text-primary\"><strong>Geographical Indication Registration<\/strong><\/a> gives a right to file a suit for infringement. <strong><em>Section 23<\/em><\/strong> certifies that there is prima facie evidence of ownership &amp; validity of Geographical Indication (GI).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Law_Related_to_GI_and_Geographical_Indication_Tags\"><\/span>Law Related to\nGI and Geographical Indication Tags<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\n<strong><em>TRIPS\nAgreement<\/em><\/strong> set down minimum standards for the protection of Geographical\nIndication that all WTO members must provide. <strong><em>Section3 (Part II) of the TRIPS\nAgreement <\/em><\/strong>provides all standards regarding the scope, availability, and\nuse of Geographical Indication.<\/p>\n\n\n\n<p><strong><em>Article\n22 of TRIPs pacts with the safety of Geographical Indication (GI). The\nprovision has been mentioned below: <\/em><\/strong><\/p>\n\n\n\n<ul><li>Geographical Indications (GI)\nidentify a product as originating in the area of a member country where a given\ncharacteristic of the product is attributable to its geographical origin;<\/li><li><strong><em>The member countries must\nprovide legal means for the prevention of :<\/em><\/strong><\/li><li>Using or presenting the product\nto misinform the public from the geographical origin of the good;<\/li><li>Any such use of that product\ncomprises an act of unfair competition within the ambit of Article 10bis of the\nParis Convention (1967).<\/li><li>The member nation shall permit\nthe legislation of cancel or refuse a Trademark for the Geographical Indication\nregarding the products not originating in the territory comprised, if the use\nof that product by the member nation may mislead the public from the correct place\nof origin.<\/li><\/ul>\n\n\n\n<p><strong><em>Article 23 of TRIPS<\/em><\/strong> gives additional security for the Geographical Indication for spirits &amp; wines. Along with this, there are certain treaties managed by the <strong>WIPO<\/strong><sup><a href=\"https:\/\/www.wipo.int\/portal\/en\/index.html\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> that deal partly or entirely with the safety of Geographical Indication like the Lisbon Agreement, Protocol for the Madrid Agreement, Lisbon Agreement, Paris Convention, and Madrid Agreement.<\/p>\n\n\n\n<p>The\nlaw-making measures taken in India in compliance under TRIPS are the enactment\nof the GI of Goods (Registration &amp; Protection) Act, 1999, which came into\naction in September 2003 along with the <strong><em>GI of Goods (Registration &amp; Protection)\nRules, 2002<\/em><\/strong>. Geographical Indication Tags have been provided in India\nfor many vital goods like Basmati Rice, Darjeeling Tea, Kanchipuram Silk,\nKohlapuri Chappal, etc., for many of which the Indian Government has to fight\nthe legal battle for decades in the International Courts to get the tag in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Position_of_GI_Tags_in_India\"><\/span>What is the\nPosition of GI Tags in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As\nwe already know that a GI (Geographical Indication) is a sign or name which is used\non products to distinguish them from others because they acquire a certain\nquality, usage of any traditional methods in their production, or enjoy a\nreputation due to their geographical origin. Geographical Indication has dated\nits 1<sup>st<\/sup> usage in France in the early 20<sup>th<\/sup> century known\nas <strong><em>AOC\nor Appellation d\u2019origine Controlee<\/em><\/strong>, but it has spread to various\nnations comprising India who are members of the WTO by the <strong><em>WTO Agreement <\/em><\/strong>on TRIPS,\nwhich got concluded in 1994.<\/p>\n\n\n\n<p>The\nGeographical Indication Tags in India are granted as per the provisions of the\nGI Act, 1999, which came into effect from 2003 by the <strong><em>GI Registry under the Department\nof Industry Promotion and Internal Trade Ministry of Commerce &amp; Industry<\/em><\/strong>.<\/p>\n\n\n\n<p>Any\nproducer, any organisation, an association of persons, or authority established\nby or under the law can apply to obtain to get a Geographical Indication Tags\nor GI Tags, and the application moved in such a view should be written in the\ncorrect format along with a prescribed fee to the proposed authority. A GI Tag\nis valid only for ten years, although it can be renewed from time to time for a\nfurther time period of ten years each through every subsequent renewal.\nDarjeeling Tea became the 1sy GI Tag issued product in India since the number\nof registrations &amp; applications has increased quickly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>GI\nAct, 1999 is still changing, and its grounds are still not very strong to\nsafeguard its infringement. Geographical Indication Laws are new to India and\nrequire strict explanation to give complete protection against infringement.
